The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, February 8, 2005 beginning at 7:30 p.m. Members present were Dianne Hearn, PersonNameBarbara Kelley, Donald Merry, Joseph Messina, and Holly Morris. PersonNameJoe Grady, Conservation Administrator was also present. Samuel Butcher and Thomas Gill were absent. Joseph Messina was Acting Chairman.
PM, addressStreetMASSACHUSETTS HIGHWAY DEPT., ROUTE 3A, RESURFACING
Representing the applicant were Tom McGuire and Bill Travis. The proposed project is maintenance and repaving work for Route 3A. Mr. McGuire also explained several locations where drainage would be corrected. Mr. Merry made a motion that was seconded to issue a negative determination that a Notice of Intent is not required with the understanding that the mitigation for the drainage would be corrected as shown on the site plan. The vote was 5 – in favor; 0 – opposed. Motion passed.
PM, PITTENGER, AQUACULTURE GRANT
Mr. Merry and Mr. Grady recused themselves from this public meeting. The applicant, Daniel Pittenger explained his aquaculture grant, northwest of Hunt’s Flat Guzzle in placePlaceNameDuxbury PlaceTypeBay. Ms. Morris made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The vote was 4 – in favor; 0 – opposed. Motion passed.
PH, DUXBURY CONSTRUCTION CO., AMEND OC, SE 18-1284, addressStreet70 PETERSON RD.
Representing the applicant was Freeman Boynton. The proposed project
was to amend the Orders to include a connection that architecturally tie together the two sections of the dwelling. A section of the addition located within the 50-foot setback from the wetlands will be constructed on sonotubes. The Commission asked the applicant to consider a buffer between the pond and lawn area. Currently the existing lawn goes to the edge of the pond. Patricia Peterson of addressStreet275 Peterson Road voiced concern about clearing work done on the overgrown brush along the pond. Mr. Grady reported he met with the contractor prior to the work being done. Mr. Boynton will check with the homeowner regarding the vegetated buffer. Ms. Kelley made a motion that was seconded to continue the public hearing to March 1, 2005 at 8:40 p.m. The vote was 5 – in favor; 0 –
opposed. Motion passed.

Representing the applicant was Paul Brogna of Seacoast Engineering Co., who submitted revised plans per review by the Conservation Administrator. Mr. Brogna explained the revisions. Ms. Kelley made a motion that was seconded to issue Orders of Conditions based on the revised plan. The vote was 5 – in favor; 0 – opposed. Motion passed.

Representing the applicant were Wesley Langeland and Paul Brogna. Mr. Brogna explained the revisions to the plan. In order to conform to the Zoning Bylaw, the pier was shortened so the last piles extended only 2 feet from the edge of the salt marsh; however, the ramp to the float was lengthened in order to have the float in the location as originally proposed. Mr. Grady had concern about the platform being located over the salt marsh. The Commission reviewed a letter from the Division of Marine Fisheries. The Commission was still waiting for review by the Harbormaster. Ms. Morris made a motion that was seconded to continue the public hearing to March 1, 2005 at 8:50 p.m. The vote was 5 – in favor; 0 – opposed. Motion passed.
PH, DUXBURY CONSTRUCTION CO., addressStreet38 LANDING RD., SE 18-1297
Representing the applicant were Freeman Boynton and the property owner, William Bingham. The proposed project is to demolish the existing dwelling and to construct a new single family dwelling. Mr. Boynton submitted a revised plan based on review by the Conservation Administrator. The project conforms to the regulations. The applicant agreed to replace existing lawn along the salt marsh with a 10-foot undisturbed vegetated buffer. Mr. Merry made a motion that was seconded to issue Orders of Conditions. The vote was 5 – in favor; 0 – opposed. Motion passed.
PM, BAYSIDE MARINE, addressStreet433 WASHINGTON ST., DOCK MAINTENANCE
Representing the applicant was J.R. Kent. The proposed application is for a Chapter 91 license for routine maintenance of existing docks. The Commission indicated that any configuration changes to the docks would require filing a Notice of Intent. Ms. Morris made a motion that was seconded to issue a positive determination that any changes to the plan required filing a Notice of Intent. The vote was 5 – in favor; 0 – opposed. Motion passed.
PM, DUXBURY CONSTRUCTION CO., 94 PARTING ROCK RD., SEPTIC
The applicant was not present so Mr. Grady explained the plan. The proposed project was a septic system upgrade with the only work within the buffer to bordering vegetated wetlands is installation of the septic tank and pump chamber. Mr. Merry made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The vote was 5 – in favor; 0 – opposed. Motion passed.

The Commission postponed action on the request for a Certificate of Compliance for SE 18-377.
The Commission reviewed the letter from the Duxbury Beach Reservation, Inc regarding annual maintenance work at placePlaceNameDuxbury PlaceTypeBeach.
