Conservation Comm. Minutes - 2004/11-09

The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, November 9, 2004 beginning at 7:30 p.m.  Members present were Chairman Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, and Donald Merry.  Joe Grady, Conservation Administrator was also present.  Joseph Messina and Holly Morris were absent.

PM, DUXBURY CONSTRUCTION CO., 609 FRANKLIN ST., SEPTIC
Representing the applicant was Freeman Boynton.  The proposed project is installation of a septic tank and pump chamber in the buffer to bordering vegetated wetlands.  An existing lawn area is located between the proposed work and the wetlands.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required.  The vote was 5 – in favor; 0 – opposed.  Motion passed.
PH, SNUG HARBOR BOATWORKS, 30 RAILROAD AVE., SITE DEVELOPMENT
Representing the applicant were Paul Brogna of Seacoast Engineering Co. and John Daley from Snug Harbor Boatworks.  Mr. Brogna explained the project.  Issues raised include drainage, water quality, and proximity of the boat storage to the wetlands.  The Commission requested the applicant show the riverfront area, re-flag the wetlands, and move the impervious cover farther from the wetlands.  Another concern of the Commission was exterior servicing of boats and storage of any hazardous material.  An abutter, Mr. Morgan Lamarche from Millbrook LLC voiced concern about the proposed mounded septic system.  For aesthetic reasons, he asked if the septic system could be moved and screened from Railroad Ave.  Ms. Kelley made a motion that was seconded to continue this public hearing to December 21, 2004 at 8:00 p.m.

PH, STRIEBEL, DINGLEY DELL ESTATES, INC, ROADWAY & DRAINAGE, SE 18-1287
Representing the applicant were Roman Striebel and Engineers Mark Flaherty and Tyler Nemes.  Mr. Flaherty explained the project which was to subdivide the existing property to create an additional lot.  Work within the buffer to a pond and bordering vegetated wetlands included relocation of the roadway, drainage swale and water quality pond.  The applicant needed to show the Zoned Wetlands and Watershed District on the site plan.  Dr. Gill also requested the proposed cul-de-sac be moved out of the wetlands.   In order to review the proposed drainage the Commission recommended hiring an outside consultant.  Ms. Kelley made a motion that was seconded to exercise the consultant fee and retain the services of Walter Amory to review the proposed project.  The vote was 5 – in favor; 0 – opposed.  Motion passed.  Ms. Kelley made another motion that was seconded to continue the public hearing to December 7, 2004 at 8:15 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed three requests for Certificates of Compliances.  Ms. Kelley made a motion that was seconded to issue a Certificate of Compliance for SE 18-1188, 185 Depot St.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

Ms. Kelley made a motion that was seconded to issue a Certificate of Compliance for SE 18-1183, 735 Bay Rd.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

Ms. Kelley made a motion that was seconded to issue a Certificate of Compliance for SE 18-1206, 55 Cushing Dr.  The vote was 5 – in favor; 0 opposed.  Motion passed.

The Commission reviewed a request for an Extension Permit for SE 18-1106, 137 Gurnet Rd.  Dr. Gill made a motion that was seconded to issue a 3-year extension permit for SE 18-1106.  The vote was 5 – in favor; 0 opposed.  Motion passed.

The Commission reviewed expenditures form the Conservation Fund.  Dr. Gill made a motion that was seconded to authorize the spending of $2,870 from the Conservation Fund for an intern ($2650) and the Swanson Field Cleanup ($220).  The vote was 5 – in favor; 0 – opposed.  Motion passed.
