The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, April 13, 2004 beginning at 7:30 p.m. Members present were Chairman Friend Weiler, Samuel Butcher, Thomas Gill, Brendan Halligan, Joseph Messina, Barbara Kelley, and Arthur Vautrain. Joe Grady, Conservation Administrator was also present.
PH, ANDERSON, 46 CRANBERRY DR., SE 18-1256
Representing the applicant was Joe Webby of Webby Engineering Co. The proposed project is construction of a septic system, addition, and garage in the buffer to bordering vegetated wetlands. Mr. Webby submitted a letter from the neighbors in support of the project. The project meets the regulations. Mr. Butcher made a motion that was seconded to issue Orders of Conditions. A vote (6 – 0) was taken and the motion passed.
CONT’D. PH, HUMMOCK, LLC, GURNET RD., SE 18-1191, SE 18-1192, SE 18-1193, SE 18-1194, SE 18-1195, SE 18-1220, SE 18-1221, AND SE 18-1222
Representing the applicant were Dan Orwig and Sterling Wall from Daylor Consulting Group. The Commission’s consultant Stan Humphries was also present. Mr. Humphries reviewed his letters dated 2/3/04 and 4/8/04. The Commission discussed filling and flooding issues. Mr. Butcher questioned whether the proposed project would have any cumulative detrimental effects. Mr. Halligan asked about maintenance of the proposed culvert and requested the applicant submit a maintenance plan. Mr. Peter Williams from Vine Associates who was representing the Duxbury Beach Residents Association submitted a letter dated 4/6/04 with his comments on the project, but noted he has not seen all the new information submitted by the applicant. Mr. John Mann of 241 Gurnet Rd. questioned the moving of lot lines on the
plan and the location of the proposed boardwalk on the public access to the beach. Mr. Robert Simonelli, 250 Gurnet Rd. raised questions about flooding. Mr. Joe Deady, 257 Gurnet Rd. spoke about his concerns about flooding and blockage by debris in the culvert. Mr. Robert Dodds, 33 Ocean Rd. North voiced his concerns about flooding. Mr. Grady asked that the hearing be continued to allow a thorough review of the revised plans. Mr. Vautrain made a motion that was seconded to continue the public hearing to April 27, 2004 at 8:15 p.m. A vote 6 – 1 (Butcher) was taken and the motion passed.
ADMINISTRATIVE MATTERS
The Commission postponed action on a request for a Certificate of Compliance for SE 18-1205 since the applicant needed to submit some photographs of the project.
The Commission reviewed a request for a Certificate of Compliance for SE 18-41. The request indicated the work was never done and the Orders have expired. Dr. Gill made a motion that was seconded to issue a Certificate of Compliance noting that the work never commenced. A vote (7-0) was taken and the motion passed.
The Commission reviewed expenditures from the Conservation Fund. Mr. Butcher made a motion that was seconded to expend from the Conservation Fund a total of $1,107.50 for two bills from Town Counsel for legal services. A vote (7 -0) was taken and the motion passed.
Mr. Grady updated the Commission on the Jaycox Chapter 61 proposal.
The Commission reviewed the draft minutes of the meeting on 2/24/04. Mr. Vautrain made a correction to page 3. Mr. Butcher made a motion that was seconded to approve the minutes of the meeting on 2/24/04 as amended. A vote (7 – 0) was taken and the motion passed.
Mr. Grady updated the Commission on the Chapter 40 B applications for Duxbury Crossing and Duxbury Farms.
