Conservation Comm. Minutes - 2003/12-02

The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, December 2, 2003 beginning at 7:30 p.m.  Members present were Samuel Butcher, Thomas Gill, Brendan Halligan, Anne Hill, and Joseph Messina. Friend Weiler and Arthur Vautrain were absent.  Joe Grady, Conservation Administrator was also present.  Mr. Butcher was Acting Chairman.

CONT'D. PM, O'SULLIVAN, 959 MAYFLOWER ST., DECK
The applicant, James O'Sullivan submitted an engineer's certification on the coverage calculation.  The proposed project conforms to the regulations.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the proposed deck.  A vote (5-0) was taken and the motion passed.

PH, WIEMEYER, 20 ISLAND CREEK RD., DECK, SE 18-1238
The applicants, Andrew and Kimberly Wiemeyer were present for the discussion.  The Notice of Intent application was a result of an enforcement order for construction of an observation platform and brush clearing in the buffer to a pond and bordering vegetated wetlands.  The applicant also proposes extension of the deck adjacent to the house.  Mr. Butcher asked the applicant to calculate the impervious coverage within the 100-foot buffer.  Mr. Wiemeyer presented a letter from the Realtor attesting that there was a previous observation platform in the same location.  The Commission noted the structure would be grandfathered, but asked the applicant to create a vegetated buffer between the lawn and the wetlands.  The Commission directed the applicant to prepare a landscape-planting plan and present it at the next meeting.  Mr. Halligan made a motion that was seconded to continue this public hearing to January 27, 2004 at 7:35 p.m.

PH, SPRIGGS, 661 WASHINGTON ST., S.F. DWELLING, SE 18-1241
Representing the applicant was Shawn Dahlen.  The proposed project is to demolish the existing dwelling and construct a new single family dwelling and garage within the buffer to salt marsh and land subject to flooding.  The existing coverage ratio is 21.1% and the applicant proposes to reduce coverage to 17.8% by removing asphalt driveway and walkways.  A small section of the garage would extend outside the existing footprint of the dwelling.  Mr. Butcher noted that it was a big project on a small lot in a sensitive area and recommended a site visit for the Commissioners.  Mr. Butcher also asked the applicant to replace existing lawn along the edge of the wetlands with vegetation.  Mr. Messina made a motion to continue this public hearing to December 16, 2003 at 8:15 p.m.  A vote (5-0) was taken and the motion passed.

PH, DUFFY, 68 GOOSE POINT LN, ADDITION, SE 18-1242
Representing the applicant was Shawn Dahlen.  The proposed project was demolition of a section of the existing dwelling and construction of new additions.  The closest point of the proposed addition to the wetlands is 41 feet.  The existing coverage within the 100-foot buffer is 17.6% and the applicant is proposing to decrease it to 15.3% by reducing the amount of pavement in the driveway.  Dr. Gill commented that the plan is too confusing to read and asked the applicant to submit separate plans showing existing and proposed conditions.  Mr. Messina made a motion that was seconded to continue the public hearing to December 16, 2003 at 8:25 p.m.  A vote (5-0) was taken and the motion passed.

CONT'D. PH, HUMMOCK LLC, GURNET RD., SE 18-1191, SE 18-1192, SE 18-1193, SE 18-1194, SE 18-1195, SE 18-1220, SE 18-1221 & SE 18-1222
The applicant submitted a written request for continuation of the hearing.  Mr. Halligan made a motion that was seconded to continue the public hearing to January 6, 2004 at 8:10 p.m.  A vote (5-0) was taken and the motion passed.

PM, DUXBURY CONSTRUCTION CO., 397 WASHINGTON ST., WATER LINE & PARKING AREA
Representing the applicant were Freeman Boynton and Ted Nichols from Battelle Labs.  It was noted that the public meeting notice advertised the wrong lot number.  The sense of the Commission was to readvertise the meeting notice for December 16, 2003 at 7:40 p.m. and discuss the project at that time.

PM, DUXBURY CONSTRUCTION CO., 60 POWDER POINT AVE., SEPTIC
Representing the applicant was Freeman Boynton.  The proposed project is a septic system upgrade and the only work within the 100-foot buffer to bordering vegetated wetlands was installation of the pump chamber.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the septic system upgrade.  A vote (5-0) was taken and the motion passed.

ADMINISTRATIVE MATTERS
Mr. Messina made a motion that was seconded to pay from the Conservation Fund a bill for $247 for Town Counsel's legal services for land acquisitions.  A vote (5-0) was taken and the motion passed.

Mr. Grady reported that trees have been cut on the town landing abutting the property at 222 Powder Point Ave.  The property owner was to establish a limit of work line prior to work beginning on his property.  Mr. Grady asked that the Commission vote to issue an enforcement order in violation of the Orders of Conditions and to authorize the expenditure of $300 to hire a tree appraiser to assess the damage and value of the cut trees.  Mr. Butcher made a motion that was seconded to issue an enforcement order to the property owner of 222 Powder Point Ave. for tree cutting on town property in violation of Orders of Conditions SE 18-1189.  A vote (5-0) was taken and the motion passed.  Mr. Butcher made a second motion that was seconded to approve the expenditure of funds up to $300 from the Conservation Fund to hire a tree expert to determine the value of the cut trees.  A vote (5-0) was taken and the motion passed.

Meeting adjourned at 9:30 p.m.
