Conservation Comm. Minutes - 2003/09-09

The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, September 9, 2003 beginning at 7:30 p.m.  Members present were Thomas Gill, Brendan Halligan, Anne Hill, Joseph Messina, and Arthur Vautrain. Friend Weiler and Samuel Butcher were absent.  Mr. Vautrain was Acting Chairman.  Joe Grady, Conservation Administrator was also present.


PH, TOWN OF DUXBURY, BOLAS & BIANCA RDS., WATERMAIN
Representing the applicant was Brian Giovanoni of Amory Engineers.  Mr. Giovanoni explained the project, which was replacement of the watermains on Bolas Rd., Bianca Rd. and Turkey Ridge Ln.  All catch basins would be protected with hay bales and siltation fencing.  Mr. Grady reported there will be seven wetland crossings and the contractor will need to submit a water management plan prior to any excavation.  The existing pipes at the crossings will be sealed.  No DEP file number had been issued.  Ms. Hill made a motion that was seconded to continue this public hearing to September 23, 2003 at 7:45 p.m.  A vote (5 - 0) was taken and the motion passed.

PM, DUXBURY DPW, STREET DRAINAGE, MAINTENANCE
Tom Daley, DPW Director explained the project, which was routine maintenance work to the existing street drainage system.  He will work closely with the Conservation Administrator for work near wetlands.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the maintenance work.  A vote (5 - 0) was taken and the motion passed.

Mr. Vautrain reported that the Commission would like to review these three Notice of Intent applications simultaneously with the five other applications filed by Hummock LLC.  The Commission scheduled a site visit for October 5, at 8:00 a.m.  Dr. Gill made a motion that was seconded to continue these hearings to September 23, 2003 at 8:00 p.m.  A vote (5 - 0) was taken and the motion passed.

PH, GIUMETTI, 17 PRIOR FARM RD., POOL, SE 18-1219
The applicant, Cattina Giumetti explained the project, which was to construct a pool, 65 from the wetlands, and a pool shed, 50 feet from the wetlands.  The project conforms to the regulations.  Dr. Gill made a motion that was seconded to issue Orders of Conditions.  A vote (5 - 0) was taken and the motion passed.

PM, DUXBURY CONSTRUCTION CO., 15 QUAIL RUN, SEPTIC
The applicant was not present so the Conservation Administrator explained the project.  The proposed project was a septic system repair and the only work within the 100-foot buffer to bordering vegetated wetlands was installation of the septic tank and pump chamber.  The plan showed the tanks located 49 feet from the wetlands.  The Commission requested that the tanks be moved outside the 50-foot setback to the wetlands.  Mr. Halligan made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the septic system repair, subject to the applicant moving the tanks a minimum of 50 feet from the wetlands.  A vote (5 - 0) was taken and the motion passed.

PH, FISHER, 52 OCEAN RD. NORHT, S.F. DWELLING, SE 18-1223
Representing the applicant were Sheila Fisher, John Fisher, and Tony Fisher.  The proposed project was to demolish the existing structure and construct a new single family dwelling on a breakaway panel foundation.  Mr. Grady reported the structure should be on an open pile foundation elevated above the 100-year flood elevation and that the applicant was only permitted 500 square feet of hardened surface on the site.  The pile foundation could be enclosed with lattice. The Commission asked that the applicant submit a plan for a pile foundation and to calculate the impervious coverage on the lot.  Mr. Halligan made a motion that was seconded to continue the public hearing to September 23, 2003 at 7:50 p.m.  A vote (5-0) was taken and the motion passed.

PM, KERNS, 95 SUMMER ST., SEPTIC
Representing the applicant was Joe Webby of Webby Engineering.  The proposed project was a septic system upgrade with the only work within the 100-foot buffer to wetlands was installation of the septic tank and pump chamber and the filling-in of the old cesspools.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the septic project.  A vote (5 - 0) was taken and the motion passed.

ADMINSTRATIVE MATTERS
The Conservation Administrator recommended issuance of a Certificate of Compliance for SE 18-1089.  Dr. Gill made a motion that was seconded to issue the Certificate of Compliance.  A vote (5-0) was taken and the motion passed.

The Commission postponed action on the requests for Certificates of Compliances for SE 18-1143 and SE 18-1135.  Each needed a plan of the impervious coverage.

The Conservation Administrator recommended issuance of a Certificate of Compliance for SE 18-1174.  Dr. Gill made a motion that was seconded to issue a Certificate of Compliance.  A vote (5-0) was taken and the motion passed.

Dr. Gill made a motion that was seconded to spend $25 from the Conservation Fund for new bike pedals.  A vote (5-0) was taken and the motion passed.

The Commission reviewed the draft minutes of the meeting of 5/20/03 and made two minor grammatical changes.  Dr. Gill made a motion that was seconded to accept the minutes of the meeting of 5/20/03, as amended.
