Conservation Comm. Minutes - 2003/09-16

The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, September 16, 2003 beginning at 7:30 p.m.  Members present were Chairman Friend Weiler, Samuel Butcher, Thomas Gill, Brendan Halligan, Anne Hill, Joseph Messina, and Arthur Vautrain.

Representing the applicant were members of the technical committee of the DBR, Inc.   Members included Al Vautrinot, Shawn Dahlen, Margaret Kearney, Kay Foster.  Also present for the public hearing was the Conservation Commission's consultant Leslie Fields of The Woods Hole Group.  

The Chairman began the meeting with a brief summary of items to be covered tonight: continue the review of the draft Orders of Conditions, Standard Operating Procedures (SOP), comments from the Beach Committee, and a letter from Town Counsel.

The applicant had submitted a request for extension permits for the Orders of Conditions SE 18-860, SE 18-861 and SE 18-862.  Mr. Weiler read a letter from Town Counsel dated 9/11/03 that recommends the Commission extend the Orders the maximum of three years or until the new Orders of Conditions become effective.  The Commission discussed how long to extend the Orders.  Mr. Butcher made a motion that was seconded to extend the Orders of Conditions for SE 18-860, SE 18-861, and SE 18-862 to October 27, 2006 or until the new Orders of Conditions SE 18-1198 become effective.  A vote (6 in favor, 0 opposed and 1 abstention (Gill)) was taken and the motion passed.

The Commission and applicant continued the review of the draft Orders of Conditions.

The Commission reviewed the comments regarding the draft Orders from the Beach Committee.  Representing the Beach Committee was Joe Conway.

The next item discussed were Standard Operating Procedures.  Mr. Butcher explained the reasons for the SOP.  More work was needed on the SOP.

The Chairman asked the audience for any comments and questions.  Ms. Kathleen Romano of 27 Carr Rd. questioned the effect of vehicle trips on the habitat of migratory birds and whether the applicant has met its burden of showing no impacts to the beach.  Mr. Vautrinot responded that the applicant's technical committee has hired consultants to study the beach and these consultants report no measurable degradation of the beach.   Mr. Vautrinot also commented that a vast amount of Duxbury Beach is not opened to the public.    Mr. Weiler commented that the Commission has not noticed any detrimental effects to the beach or found any studies that support detrimental effects to beaches as a result of vehicle trips.

Mr. Butcher made a motion that was seconded to continue this public hearing to October 28, 2003 at 7:30 p.m.  A vote (7-0) was taken and the motion was passed unanimously.
