The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, March 18, 2003 beginning at 7:30 p.m. Members present were Chairman Friend Weiler, Samuel Butcher, Thomas Gill, Anne Hill, Mark Mahoney, Arthur Vautrain, and Joseph Grady, Conservation Administrator. Brendan Halligan was absent.
PM, MASS. HIGHWAY DEPT., ROUTE 3, MAINTENANCE
Representing the applicant were Bill Travers and Tom McGuire. Mr. McGuire explained the project, which was to rehabilitate sections of Route 3 from Route 14 to Route 3A. Where needed, siltation barrier will be installed, but all work will be done in the existing roadway pavement. Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The vote was 5 in favor and 0 opposed. Ms. Hill arrived after the vote. The motion passed.
PH, BENTINCK-SMITH, 192 POWDER POINT AVE., ADDITION, SE 18-1187
Representing the applicant were Ailene Wilson from AM Wilson Associates and Jim Cronburg from Silvia & Silvia Associates. The proposed project is to reconstruct the foundation under the existing dwelling, demolish and reconstruct a portion of the existing dwelling, and construct one addition. A section of the house to be removed is located 8 feet from the top of the coastal bank. The existing asphalt walkways around the house will be removed. The existing shed and generator pad will be relocated outside the buffer zone. New drywells will be installed for roof runoff. Mr. Mahoney commented he had an issue with the dwelling's proximity to the coastal bank and asked the applicant consider rebuilding the structure farther from the edge of the coastal bank. Ms. Wilson commented that the proposed
project conforms to zoning regulations and if the project was moved it may require a variance from zoning. The Commission asked the applicant's representatives to talk to the applicant and consider redesigning the project to get it farther from the wetlands. The Commission requested that a foundation plan be submitted. Mr. Butcher made a motion that was seconded to continue the public hearing to April 15, 2003 at 7:50 p.m. The motion passed unanimously.
PH, DONOVAN, 109 BIANCA RD., ADDITION, SE 18-1190
The applicant, John Donovan explained the project, which was to construct a garage addition and relocate the driveway within the buffer to bordering vegetated wetlands. The applicant submitted the calculated coverage ratio of 11.2%. The project conforms to the regulations. Mr. Mahoney made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.
PM, BAY FARM ASSOC., BAY FARM RD., AQUATIC WEED TREATMENT
The applicant sent a written request asking for a continuation of the public meeting to April 1, 2003 at 7:35 p.m. Mr. Mahoney made a motion that was seconded to continue this public meeting to April 1, 2003 at 7:35 p.m. The motion passed unanimously.
PH, SEALUND, 69 HORNBEAM RD., S. F. DWELLING, SE 18-1196
The applicant, Kevin Sealund explained the project, which was to demolish the existing dwelling and construct a single family dwelling and swimming pool within the buffer to bordering vegetated wetlands and coastal bank. A retaining wall approximately 37 feet from the edge of the wetlands would be constructed and the area toward the dwelling filled and graded. The applicant submitted a revised plan that relocated the septic system as requested by the Board of Health. The applicant's engineer, Aaberg Associates submitted a letter regarding the coastal bank delineation. The applicant also requested to perform vista pruning. Mr. Butcher asked the applicant how he was planning to access the shore. The Commission requested the applicant submit a landscape plan showing proposed landscaping seaward of the
retaining wall and to mark the trees to be pruned. The coverage ratio within the 100-foot buffer is 14.9%. The proposed project conforms to the regulations. Mr. Butcher made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.
PM, HARRINGTON, TEMPLE ST., DELINEATION
Representing the applicant was Alan Vautrinot of Vautrinot Land Surveying Co. Mr. Vautrinot submitted a revised plan based upon a site visit with the conservation Administrator. Mr. Mahoney made a motion that was seconded to accept the wetlands line as shown on the revised plan and to issue a positive determination that any work within 100-feet of the line would require filing of a Notice of Intent. The motion passed unanimously.
ADMINISTRATIVE MATTERS
Dr. Gill made a motion that was seconded to issue a Certificate of Compliance for SE 18-1042, 252 Enterprise St. The motion passed unanimously.
The Commission reviewed a letter from Paul Brogna regarding adding to piles for the boatlift at Santelli, SE 18-1052. The Commission felt the additional piles fell within the scope of the original Orders of Conditions.
The Commission reviewed a request for a Triathlon at Duxbury Beach. The Commission needed more specifics before it could make a recommendation.
The Commission reviewed a request from Team Saquish Row to have a rowing event on the bayside of Duxbury Beach on May 17, 2003. The Commission had no problem with the event.
Mr. Weiler reported on a meeting he attended regarding Duxbury Beach and reviewed a letter regarding the annual maintenance work on the beach this spring.
Mr. Butcher made a motion that was seconded to spend $120 from the Conservation Fund to pay for the printing of the Town meeting handouts for the Wetlands Bylaw.
