Conservation Commission Minutes - 2002/12/17
The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, December 17, 2002 beginning at 7:30 p.m.  Members present were Chairman Friend Weiler, Samuel Butcher, Brendan Halligan, Anne Hill, Mark Mahoney, Arthur Vautrain and Joseph Grady, Conservation Administrator. Thomas Gill was absent.

CONT’D. PH/PM, MURPHY, CONGRESS ST., SE 18-1167, DELINEATION
Representing the applicant was Mark Casey of South Shore Survey Consultants, Inc.  Mr. Weiler read a letter from the applicant, Edward Murphy, regarding the drainage culvert.  Mr. Grady reported on his review of the plan.  Mr. Grady disagreed with several flag locations and asked to meet with the applicant’s consultant, Norman Hayes in the field.  Mr. Mahoney made a motion that was seconded to continue this public hearing/public meeting to January 21, 2003 at 7:50 p.m.  The motion passed unanimously.

PM, DUXBURY CONSTRUCTION CO., 834 TEMPLE ST., SEPTIC
Representing the applicant was Freeman Boynton.  The proposed project was a septic system upgrade with the only work within the buffer to bordering vegetated wetlands being the installation of the septic tank and pump chamber.  Mr. Mahoney made a motion that was seconded to issue a negative determination that a Notice of Intent is not required.  The motion passed unanimously.

CONT’D. PH, MASS. HIGHWAY, ROUTE 3, DELINEATION, SE 18-1170
Representing the applicant were Tom Hession of Mass. Highway, Kate Barnacle from ENSR, and Maryann Magner from Edwards & Kelcey.  Mr. Grady reported that the plan was revised as a result of several site visits.  Mr. Grady recommended acceptance of the wetlands delineation as shown on the revised plan dated December 2002.  Mr. Mahoney made a motion that was seconded to confirm the delineation as shown on the revised plan.  The motion passed unanimously.

PH, BRODIL, 68 GOOSE POINT LN., SEPTIC, SE 18-1179
Representing the applicant was Paul Brogna of Seacoast Engineering Co.  The proposed project was a septic system upgrade with the soil absorption system located 93 feet from bordering vegetated wetlands.  Mr. Brogna noted the system was designed for a 4-bedroom house for safety reasons and that the applicant had no plans to expand the existing 3-bedroom dwelling.  Mr. Mahoney made a motion that was seconded to write the Orders of Conditions.  The motion passed unanimously.

Since the DEP file number had been issued Mr. Mahoney made a motion that was seconded to write the Orders of Conditions.  The motion passed unanimously.

CONSULTANT INTERVIEWS – DUXBURY BEACH ORDERS OF CONDITIONS
The Commission interviewed Stan Humphries of Ocean and Coastal Consultants, Leslie Fields of The Woods Hole Group, and Norman Hayes of The BSC Group for consideration as consultant to the Commission.  Mr. Weiler instructed the applicants to submit a scope of services and cost to be reviewed at the next meeting on January 7, 2003 at 7:30 p.m.

ADMINISTRATIVE MATTERS
The Commission reviewed a Chapter 61A purchase and sale for parcel 110-055-001 off South Street by Edgar Loring, Inc.  Mr. Grady reported that no portion of the parcel in Duxbury is buildable.  Mr. Butcher made a motion that was seconded to recommend to the Board of Selectmen to not exercise the Town’s option of first refusal to purchase parcel 110-055-001.  The motion passed unanimously.

Mr. Grady reported on a problem of tree cutting on a parcel off Ocean Ave. without a permit.  The Commission instructed the Conservation Administrator to determine who owns the property and to advise the owner and renters to not do any further cutting without permission from the Commission.

The Commission instructed the Conservation Administrator to send a memo to the Board of Appeals regarding Webster Point 40B application and to indicate that the ZBA should not grant a waiver of the local wetlands bylaw until the applicant has filed for review of a wetlands delineation under the State Wetlands Act.

Mr. Grady reported on a revision to the plan for extension of the pier at 307 Bay Rd. (SE 18-1130) that would realign the location of the gangway and float.  Mr. Butcher made a motion that was seconded to accept the revision to the pier as shown on the revised plan dated 12/11/02 for project SE 18-1130.  The vote was 5 – 0 so the motion passed  Mr. Mahoney recused himself from this discussion and vote.

A motion was made and seconded to accept the minutes of the meeting of 9/24/02 as written.  The vote was 5 in favor and 2 abstentions (Weiler and Halligan).  The motion passed.

A motion was made and seconded to accept the minutes of the meeting on 10/8/02 as amended.  The motion passed unanimously.

A motion was made and seconded to accept the minutes of the meeting of 10/22/02 as written.  The motion passed unanimously.
A motion was made and seconded to accept the minutes of the meeting on 11/5/02 as written.  The motion passed unanimously.

The Commission postponed action on the request for a Certificate of Compliance for SE 18-941 since the Conservation Administrator had not completed a site inspection.
