The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, May 21, 2002 beginning at 7:30 p.m. Members present were Chairman Friend Weiler, Molly Bartlett, Samuel Butcher, Brendan Halligan, Anne Hill, Mark Mahoney, Arthur Vautrain and Joseph Grady, Conservation Administrator.
1. PUBLIC HEARING – WETLAND BYLAW
The Commission held a public hearing to review the proposed changes to the wetlands bylaw. Present for the discussion was Joanne Muramoto from Horsley & Witten. The Commission reviewed each page and Ms. Muramoto will incorporate the changes discussed into the document. Ms. Doanne Andresen of 700 Franklin St. submitted a proposed change regarding exemption from permits for maintenance or improvements to agricultural lands. The Commission would have Town Counsel review the language for Ms. Andresen’s proposed amendment. A motion was made and seconded for the conditional approval of the revised wetland bylaw as discussed this evening subject to the Chairman and Conservation Administrator resolving issues discussed with Town Counsel. The motion passed unanimously.
2. PUBLIC HEARING - MERRY CONSERVATION LAND MANAGEMENT PLAN
The Commission reviewed the draft management plan as prepared by David Clapp of Massachusetts Audubon Society. One issue discussed with the abutters, Brendan and Lisa Keohan of 188 West St. was public access and parking for the property. The Commission agreed to locating the parking area 300 feet down West St. in an existing pull-off that is located halfway between this property and the Waiting Hill property. A fence would be installed along the property line. Mr. Mahoney made a motion that was seconded that the Duxbury Conservation Commission adopt the Management Plan for the Merry conservation land, as amended. The motion passed unanimously.
3. ADMINISTRATIVE MATTERS
The Commission had preliminary discussion regarding soliciting consultants to review the Commission’s Rules & Regulations. The Conservation Administrator would check into the cost for a consultant.
Mr. Weiler reported on the meeting he had with the Duxbury Beach Reservation, Inc. regarding the Orders of Conditions for the Beach.
Mr. Mahoney made a motion that was seconded to spend up to $1,000 for office furniture from the Conservation Fund. The motion passed unanimously.
The Commission reviewed a request from the Board of Selectmen whether to exercise first refusal under MGL Chapter 61A for a one-acre portion of parcel 100-021-000 being sold by Edgar Loring Inc. to an abutter. Mr. Butcher made a motion that was seconded to recommend to the Board of Selectmen not to exercise its right of first refusal for this land sale. The motion passed unanimously.
