The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, August 20, 2002 beginning at 7:30 p.m. Members present were Chairman Friend Weiler, Samuel Butcher, Thomas Gill, Brendan Halligan, Anne Hill, Arthur Vautrain, and Joseph Grady, Conservation Administrator. Mark Mahoney was absent.
1. CONT'D. PH, NOOK HILL REALTY TRUST, SE 18-1157
Since the DEP file number had been issued, Mr. Butcher made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.
2. PH, LAST, 0 HIGH ST., DRIVEWAY & GRADING, SE 18-1159
Representing the applicant were Attorney Robert Galvin and Terry McGovern from Stenbeck & Taylor, Inc. Mr. McGovern explained the project, which was to install a driveway and utilities and perform grading for a new single family dwelling in the buffer to bordering vegetated wetlands. The project conforms to the regulations. Mr. Butcher made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.
3. PH, HERMAN, 154 BIRCH ST., LANDSCAPING
The applicant, Mark Herman explained the project, which was to remove overgrown brush and trees on an abandoned cranberry bog. He wanted to restore the open vista and indicated that in the past he was able to flood the bog for skating. Mr. Butcher commented that the regulations restrict alteration to resource areas and that he would not be in favor of mowing the area. Mr. Weiler suggested that the applicant consider hand cutting in a limited area as opposed to clear-cutting the bog. No DEP file number had been issued because DEP asked for a more detailed plan. Dr. Gill made a motion that was seconded to continue this hearing to September 10, 2002 at 8:00 p.m. The motion passed unanimously.
4. PH, TIBBETTS, 40 SO. RIVER LN. WEST, ADDITION, SE 18-1158
Representing the applicant was Paul Brogna of Seacoast Engineering Co. The proposed project was construction of an addition in the buffer to bordering vegetated wetlands. Mr. Brogna submitted a revised plan that included the impervious coverage calculations. The proposed project conforms to the regulations. Mr. Butcher made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.
5. CONT’D. PH, BAYSIDE MARINE, 433 WASHINGTON ST., SE 18-1126
The applicant submitted a written request to continue the public hearing. Mr. Butcher made a motion that was seconded to continue this public hearing to September 24, 2002 at 7:40 p.m. The motion passed unanimously.
6. PM, DUXBURY CONSTRUCTION CO., 357 TEMPLE ST., SEPTIC
Representing the applicant was Freeman Boynton. The proposed project was installation of a septic system with the only work within the buffer to bordering vegetated wetlands being the installation of the septic tank and pump chamber. Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The motion passed unanimously.
7. CONT'D. PH, SCHIEN, 19 OCEAN RD. SOUTH, ADDITION, SE 18-1154
The applicant, Steven Schien was present for the discussion. Mr. Schein presented a plan that showed the work with regards to the bulkhead wall. He indicated he had extended the wall. Mr. Butcher commented that the issue was the extension of the wall without a permit and explained that a foundation may cause funneling of storm water so normally foundation-type structures were not approved on a barrier beach. The Commission discussed whether removal of the work would cause more impact or should they require some mitigation. It was noted that the impact of the grandfathered structure would outweigh the impact of the wall extension on the barrier beach. The Commission requested the removal of 76 square feet of concrete slab as mitigation. It was also noted that the applicant had removed an
existing concrete deck. Mr. Butcher made a motion that was seconded to write Orders of Conditions for the construction of the retaining wall with the understanding that an additional 76 square feet of concrete slab will be removed. The vote was 5 in favor and one abstention (Vautrain). The motion passed.
8. ADMINISTRATIVE MATTERS
Mr. Weiler gave an update on Duxbury Beach.
A motion was made and seconded to issue Certificates of Compliances for SE 18-931 and SE 18-980, projects at 77 Depot St. The motion passed unanimously.
A motion was made and seconded to issue a Certificate of Compliances for SE 18-1013 (Bouchie). The motion passed unanimously.
A motion was made and seconded to spend $80 from the Conservation Fund for the Commission's share of the cost of mowing the Swanson field. The motion passed unanimously.
A motion was made and seconded to spend $72 from the Conservation Fund for copies of the maps in the Open Space Plan. The motion passed unanimously.
A motion was made and seconded to accept the $100 gift for the Conservation Fund from the staff of the Village of Duxbury to commemorate the 100th birthday of Lansing Bennett's mother on behalf of the memory of Lansing Bennett. The motion passed unanimously.
The Commission discussed how to proceed with the issue of deer hunting on conservation land.
