DUKES COUNTY COMMISSION
EXECUTIVE SESSION
March 23, 2005
County Administration Building
At a regular meeting of the Dukes County Commission, Mr. Sawyer made a motion, seconded by Mr. Strauss, to go into executive session to discuss litigation, and not return to open session. The motion was unanimously approved on a roll-call vote, as follows: Mr. Sawyer, yes; Mr. Wey, yes; Mr. Strauss, yes; Mr. Alley, yes; Mr. Jason, yes; Mr. Leland, yes.
Chairman Alley called the executive session to order at 6 p.m. Present were all of those in the preceding paragraph, plus County Manager E. Winn Davis and Executive Assistant Brian S. Kinal, who took these minutes.
Mr. Davis said Michael Gilman, who is representing the County in the lawsuit by Weibrecht et al, has submitted a well-written brief in the case. He said Mr. Gilman discovered a 1974 statute that supports the County’s position that the County Commissioners have control over salaries at the airport.
In another matter, Mr. Davis said it might become necessary to file suit against those towns that are refusing to pay the Veterans Agent assessment. He said Kopelman & Paige law firm, which has submitted a proposal to become the County’s general counsel, might have a potential conflict because the firm also represents Tisbury, which is one of the towns that have refused to pay.
Mr. Sawyer moved, seconded by Mr. Wey, to adjourn. The motion passed unanimously. Adjournment was at 6:15 p.m.
