Marsha Smolev, Executive Assistant
The meeting began at 5:45 PM.
Commissioner Sawyer Moved that the Commissioners go into Executive Session to discuss strategy with respect to litigation and reconvene in Open Session. Commissioner Collins Seconded the Motion. Roll call:
Commissioners Sawyer – aye, Wey – aye, Flynn – aye, Collins – aye,
Leland – aye.The Commissioners invited Mrs. Borer and Marsha Smolev to stay.
Discussed was a letter from the Law Offices of Harry C. Beach, Re: Withholding of Wages/Breach of Contract, dated November 4, 2002, regarding the salaries of his clients Airport Manager, William Weibrecht and Assistant Airport Manager, Sean Flynn. Mrs. Borer noted the need to respond within fourteen days of the date of the letter.
Some Commissioners voiced discomfort at Commissioner Dan Flynn’s presence at the table during the discussion that included issues involving his son, Sean Flynn, and asked for a decision by the Ethics Commission on the subject. Commissioner Flynn said he was also uncomfortable with the situation, but felt he could stay since the County Manager and majority of the County Commissioners had put his son in a position where he ‘has to sue his father.’
Upon further discussion, Commissioner Flynn left (6:37 PM.) Discussion continued.
Commissioner Alley Moved that the Commissioners return to Open Session (6:45PM.)

Commissioner Alley Moved that the Commissioners respond to the letter dated November 4, 2002 from Attorney Harry Beach by saying: “We received your letter of November 4, 2002 and reviewed it in Executive Session, at a portion of which Dan Flynn (father of Sean Flynn) participated. We are referring your letter to outside counsel for advice. We will respond to your letter as soon as possible.”
Commissioner Sawyer Seconded the Motion. The Vote to approve the Motion was Unanimous.
At 6:52 p.m. Chairman Leland called for a short recess.
