Non-Public minutes of Session I 4/21/09 made public. In a 4-3-0 vote Gary Stenhouse was awarded a one year extension on his contract from July 9, 2009 – July 8, 2010.
Councilor Carney asked for a “Moment of Silence” on behalf of a Derry fallen solider Adam Kugelowski who passed away on April 6, 2009.
Chairman’s Report
Chairman Metts read a thank you letter from Jon Reeves to the Fire Department for their assistance when they answered a medical call at his home.
On April 18th, there was a very successful cleanup day around town, the Rail Trail also had a cleanup day and in the morning was the official start of the Little League with a parade from MacGregor Park to the ball field.
The Budget Session will not take place this Thursday April 23rd instead it will be April 30th.
May 3rd the VFW Post 1617 Sunday at 2:00 pm is Loyalty Day.

09-49 Appointment to Boards and Commissions
Paul Doolittle has requested to be appointed to the Conservation Commission as a 1-yr alternate.
Councilor Coyle moved to appoint Paul Doolittle to the Conservation Commission for a 1yr Alternate, seconded by Councilor Benson Vote: 5-1-1 (Carney and Fairbanks)
Maria-Silva Hatch has requested to be appointed to the Zoning Board.
Councilor Coyle moved to appoint Maria-Silva Hatch as a 1-yr Alternate, seconded by Councilor Benson Vote: 6-0-1 (Fairbanks)
James Webb has requested to move to a full member on the Zoning Board for a 1 yr term.
Chairman Metts moved to appoint James Webb as a full member on the Zoning Board to finish Chris Lunetta’s term seconded by Councilor Carney Vote: 7-0-0
There are still two openings on the Zoning Board as alternates.
Public Forum – Non Agenda Items

John Burtis, Lorri Rd – questioned if there would be a vote on the DEDC getting money.
Maureen Rose, Windham Rd – She is not in favor of removing one of the public forums. She has sent a memo to the Town Administrator to see if Cable 17 can run a ticker when budget meetings will be held instead of waiting to view the lineup. Not in favor of funding the DEDC.
Mike Houle, Negotiator for Derry PD Patrolman – Commented on a recent article he read. He asked why management hasn’t accepted the contract. He asked why the negotiations could not be seen on CTV17.

Public Hearing
09-38 Neighborhood Stabilization Program Grant
Fred Tompkins and Mr. Milz gave an overview of the goals created by the Derry Housing and Redevelopment Authority. He reviewed the plans for construction of approximately 14-18 units of elderly housing at the former Floyd School. Mr. Milz stated among the goals, the DHRA plans to continue to reduce and eventually eliminate the need for Town funding assistance to DHRA. Town Administrator Stenhouse and George Sioras have been assisting with this project and working with Robert Fleig.

Maureen Rose, Windham Rd – questioned who was going to manage this? She’s not in favor of
this and there isn’t sufficient parking.
(Fred Tompkins stated that there is sufficient parking and the DHRA would be the manager and owners of the property)
Al Dimmock, High St – disagrees with plan
John Burtis, Lorri Rd - disagrees with plan and believes that the problem with this building is a bigger fix than the dollar amount available.
Greg Ives, Fairfax Ave – There are several factors here, the money has to go somewhere where is it going to go, there is a cap on this money. If the units are built this will help the DHRA not requiring town funds for its administration of housing. It seems correct to spend the money here and support the town in developing additional revenue for the town.

Move that the Town Council authorize the Town and the Derry Housing Authority to apply for and accept a Neighborhood Stabilization Grant in an amount not to exceed $3 Million for purposes of the Housing Authority acquiring and developing the Floyd School as elderly housing*. Motion by: Councilor Benson seconded by Councilor Wetherbee.
Amended motion: *and the Town to receive funds to demolish the unsafe structure at 38 Maple St. Vote: 5-1-1 (Coyle) (Carney)
09-23 Amend the Code of the Town of Derry –
Sub-Chapter 36 of Chapter 30-2 (H) Miscellaneous
Requirements – Fire Alarm Systems
Chief Klauber and Brett Scholbe gave an overview of the ordinance and sent out 168 letters to buildings effected by this ordinance

John Burtis, Lori Rd – praised Chief Klauber and staff on the work of this ordinance. However he doesn’t feel this is the proper time to initiate new fees.
Dennis Reed, Sports Zone – He addressed all the fee increases that his business has received in the past year. He also doesn’t believe this increase is proper at this time. Feels it has been frontloaded.
Ron Howe, Director of Building and Grounds for Pinkerton Academy – the town schools and PA would be charged for this and he has a problem with the schools paying for this because what they would do is just increase tuition to cover the costs. It’s a wash. Also the PA budget is already locked in place for another year. Hopefully they can work on this with the town.
John Burtis, Lorri Rd – Stated the false alarm ordinance should be put into effect but not under this ordinance.
Mark Louder, President Salem & Derry Chapter of Landlords – his group is against this ordinance as it is an additional burden on them.
Betty Bretzsnider, E Broadway – Apartment building owner can’t afford this ordinance. (This building does not apply to ordinance)

Councilor Wetherbee moved to table indefinitely. This should be revisited when times are better.
Councilors discussed different issues within the ordinance.
Chairman Metts requested that Section 3616 – 3616.7 False Alarm to be resubmitted. He would also like to know how many addresses fall into this category of 3-8 false alarms.
Councilor Carney requested a phase in fee structure for the 3614 – 3615.
Old Business
09-31 VOTE - FY 2010 Public Health Network Grant
Move the Derry Town Council approve the application for and to authorize the Town Administrator to accept and expend the 2010 Public Health Network Grant in the amount of up to $100,000. Motion by: Councilor Carney, seconded by Councilor Benson. Vote: 7-0-0
09-33 VOTE - Administrative Support Staff Local #1801 AFSCME
Contract
Council discussed their opinions on these contracts.
Move that the Derry Town Council approve the collective bargaining agreement between the Town of Derry and the American Federation of State, County and Municipal Employees Local #1801 Administrative Staff Support unit from July 1, 2007 to June 30, 2011 and authorize the town Administrator to sign the Agreement on behalf of the Town of Derry. Motion by: Councilor Benson, seconded by Councilor Wetherbee. Vote: 5-2-0 (Fairbanks, Coyle)
09-34 VOTE - Professional, Administrative and Technical Employees Contract
Councilors discussed effects of this because most of the members are at top of their scales.
Move that the Derry Town Council approve the collective bargaining agreement between the Town of Derry and the Professional, Administrative and Technical Employees unit from July 1, 2007 and June 30, 2011 and authorize the Town Administrator to sign the Agreement on behalf of the Town of Derry. Motion by: Councilor Benson, seconded by Councilor Wetherbee. Vote: 5-2-0 (Fairbanks, Coyle)
New Business
09-50 DEDC Funding Request
Councilor Coyle motioned to Table - Changed to postpone until the May 5th meeting, second Councilor Wetherbee. Vote: 4-3-0 (Fairbanks, Carney, Coyle)
09-51 Charter Election Dates
Council discussed the various options for day of the week and date.
Move to have a Public Hearing by Councilor Wetherbee (no second)
Tuesday June 2nd or June 9th. Town Clerk to check with School Department
Councilor Carney motioned to hold the “Special Election” at Hood School on June 9, 2009, seconded by Councilor Coyle. Vote: 7-0-0 (pending verification of Hood School)
09-52 Public Forum – Non Agenda Items – Council Discussion
Council discussed different opinions regarding the second Public Forum and the reasons that they would like to dismiss this second forum. Some Councilors were in disagreement with removal of the second forum.

Al Dimmock, High St – feels he is being stifled with the removal of the second public forum.
John Burtis, Lorri Rd – It’s unfortunate that an entire group of people are being penalized.
He believes this is a mistake
Doug Newell, English Range Rd – He is also disappointed. The reasons for removal are bizarre.
Maureen Rose, Windham Rd – She is distressed over the Councilors decision.

Council Requests / Open Discussion
Councilor Coyle – Wanted to clear the public record. He had asked during the Budget Hearing if a claim for $50.00 was being pursued in court. He was told that town was not. He was contacted by the person who the claim is against and in fact the town is.
