Chairman’s Report

  • Police Blood Drive on January 23, 2009 had 450 participants
  • Frost Festival will be held on February 6 – 8, 2009
  • February 21, 2009 is an 80th Anniversary Celebration of the Derry Memorial Post 1617 along with the Derry Auxiliary Post 1617.
  • Community Profile April 4, 2009 WRB Middle School
  • Boards & Commission open positions are posted and reappointment and new interested persons must have their intent in by February 27, 2009.
  • Hearing at State House in Concord on February 11, 2009 regarding HB641 changes in State retirement system. (Submit letters to Chairman Metts)
  • Citation for Cecile Fait in celebration of her 105th Birthday
Administrator’s Report
                        *****   Auditor’s Presentation – FY2008 Report

Bob Vachon gave a slide presentation regarding the Town of Derry’s Comprehensive Annual Financial Report for Year Ending June 30, 2008.

Total revenues exceed budget estimates by $300,000.  Total Expenditures of $35M are $2M less than final budgeted amounts.  Significant savings include: Police & Animal Control also Finance.  Actual Revenues exceeded Actual Expenditures by $1.5M.  Local Government recommends between 8 -17% in Retained Fund Balance.  The Town of Derry has 16.1%.  No significant condition was found during the audit under Internal Controls.  He Congratulated the Town on the continuing efforts to maintain the highest level of internal controls.  He stated that given the Town’s strong fund balance, strong internal controls and procedures that he felt the town was in an excellent position to successfully weather the current national financial crisis.  

Frank Childs explained there was however a discrepancy with the Trustees of the Trust Fund report that the Bank of America provided to the Finance Department.  The total balances did not balance within themselves but the finance ledgers were accurate. An amended report was filed with the state.
                                        
Public Forum – non agenda items

Mike Houle, Derry Police Department – The Derry Police patrolman union is at an impasse. They would like receive the same outcry from the public that the Fire Department received a few months ago regarding their contract.

Al Dimmock, High St –Spoke in regards to the newspapers article regarding the sand at the Transfer Station.  The article condemned the Town Administrator for not allowing access to the sand pile during Sundays & Monday.  Mr. Dimmock wanted to compliment the Town Administrator for saving the Town Taxpayers for doing this as there is misuse of the sand by certain people.

Councilor Wetherbee requested to Table the vote on item 09-08 and 09-10 as Councilor Benson was not present.  The Charter objection made at the last meeting was due to Councilor Carney not being present.  There was discussion on the Charter objection vs. tabling the same item.

Councilor Wetherbee Motioned to table until February 17, 2009 meeting, seconded by Councilor Chirichiello Vote: 4-2-0 (Fairbanks, Coyle)

09-09   Advisory Ballot Question / Charter Study
Chairman Metts read the non binding questions to be placed on the ballot approved by Legal Counsel.

Councilor Wetherbee requested to withdraw his question to be placed on the ballot.  Chairman Metts suggested it be put to a vote.  Councilor Wetherbee raised a Charter Objection which stopped further consideration of the item at this meeting.

Councilor Wetherbee Motioned to table until February 17, 2009, seconded by Councilor. Chirichiello Vote: 4-2-0 (Fairbanks, Coyle)

09-15   Rockingham Road Sewer Line Extension Easement Deed

Tom Carrier reviewed the staff report.

Motion: The Derry Town Council authorizes the Town Administrator and the Chairman of the Town Council to accept and execute the Rockingham Road Sewer Line Easement Deed as shown on the plan entitled “ Lot Line Adjustment Plan- RITE AID (STORE 03310-10) 52 Rockingham Road, Rockingham County, Derry NH Plan no. D34995.  Moved by: Councilor Coyle, seconded by Councilor      Vote: 6-0-0

                                                                                       
Public Forum – non agenda item

Open Public Forum 6-0-0                                                         
Al Dimmock, High St – thanked Kevin Coyle & Janet Fairbanks for submitting their name for re-election.   Spoke regarding the snowplowing of sidewalks.  He doesn’t feel the job the sidewalk blower does is good enough.   Therefore the children going to the school bus walk in the street.

Council Requests / Open Discussion      

Councilor Carney moved to reconsider the table items 09-08 and 09-10, seconded by Councilor Fairbanks.   Vote: 3-3-0 (Wetherbee, Chirichiello, Metts) motion failed

There was council discussion on the rules of the “Town Charter” and “Robert’s Rules” were reviewed.  

Councilor Coyle voiced his opinion on the actions taken this evening.
Councilor Wetherbee voiced his opinion on the vote.
Councilor Fairbanks voiced her opinion on the vote.       
Councilor Chirichiello voiced his opinion on the discussion.

Councilor Carney motion to adjourn.
