Minutes of Public Meeting on September 14, 2009

On September 14, 2009 at 7:30 the Derry Conservation Commission met in the lower level Cable TV meeting room at the Municipal Center.  The following members were present: R. Buzzanga, B. Ferrante, M. Ives, E. Sarcione, D. Wiley, alternates P. Kinsella sitting for J. Arruda, M. Page sitting for P. Dionne and council representative N. Wetherbee.

Chair’s Report
Correspondence:
Benson’s bill for $1.99.  Treasurer B. Ferrante will check to see if it was DCC expenditure.

NH DES letter stating deficiencies at Warner Hill Rd. are corrected

NH DES letter stating deficiencies at Jackman Rd. are corrected

NH DES letter stating a Shoreland Impact Permit was issued for Taylor Brook Lane with 14 conditions

An application was made for a standard dredge and fill on Fordway Rd.

Derryfest
September 19 setup at 7:30 AM and closedown at 5:00 PM.  M. Ives arranging for tables and chairs, D. Wiley will pick up on Friday. Setup with M. Page and D. Wiley. P. Dionne has maps, banner, etc. P. Kinsella has DCC pamphlets. Closedown  with D. Wiley and R. Buzzanga.

Site Plan Review:

Todd Connors of Sublime Civil Consultants presented plans for a Tsienneto Rd. three story office building with 24,000 sq. feet and 115 parking spaces. There is no direct wetland impact.  The property will drain toward the back and have a separator for petroleum runoff and then a swale.  A site walk was scheduled for Monday September 21 at 5:00 PM.  

Zoning Ordinance Presentation:

Bob Mackey, Code Enforcement Officer explained some Derry town zoning ordinances including relation to state and federal laws.  He explained restrictions on activities for wetland, flood plain, groundwater/aquifer, prime wetland, earth removal and shoreland protection.  He provided members with handouts of FAQs on the Comprehensive Shoreland Protection Act (RSA 483-B).  He also spoke about the new Derry animal ordinance.  In response to request by D. Wiley, B. Mackey says he has some copies of the town ordinances in the office for DCC members to pick up.  

Conservation Areas:

Cole Marsh – dam construction to be complete this week
Broadview – P. Kinsella to establish collection area for blighted plants and contact gardeners
Weber – DCC thanks Derry Pathfinders for cleanup of area
Martin easement area – M. Ives to work with P. Ferdinando on cleanup of poison ivy

Other:

R. Buzzanga has observed the culvert on Morrison Rd. at a seasonal stream. He requested that one or two other members join him in assessing the situation. He will arrange a time with available members.  

M. Ives will contact Jamestown, the picnic bench company that J. Arruda had been working with that we are interested but will wait until next spring to make a decision.  N. Wetherbee mentioned the possibility of buying benches through the state to obtain a quantity discount.  E. Sarcione mentioned the possibility of benches constructed of all metal with no wood, as being less vulnerable to vandalism.  

A motion was made by E. Sarcione that the commission go to a non-public meeting per RSA 91-A:3-(d) “Consideration of the acquisition, sale or lease of property which, if discussed inpublic, would likely benefit a party or parties whose interests are adverse to those of the general community.”  The motion was seconded by M. Page.  Approved unanimously, 7-0.
