Zoning Board of Appeals Minutes 02/24/16
FINAL
Present for the Board of Appeals and attending the meeting were Russell Maloney, Chairman,    Chris Murphy, Todd Christy, Wendy Weldon, Allen Healy and Chuck Hodgkinson.  Also attending were Reid Silva and George Sourati.  Allison Burger and Frank LoRusso were absent.     

Mr. Maloney opened the meeting at 5:00 PM and appointed alternate members Todd Christy and Allen Healy as voting members for the evening’s agenda.  

GEORGE SOURATI FOR MATHEW CESTAR; Article 11 Section 11.6A2(b)(i)(a);            12 Hill Land; Map 32 Lot 40:   Mr. Maloney opened the public hearing at 5:05 PM.              Mr. Sourati reviewed a site plan dated 1/4/16 and explained this project is technically in the shore zone of a Coastal Great Pond—Stonewall Pond.  He added the property is under a purchase and sale agreement.  The buyers would like to add 250 sq. ft. to a pre-existing, non-conforming single-family residence.  The Board was quite familiar with the house and asked if new floor area is being added or if the proposed dormer is creating new living space over existing floor area.  Mr. Sourati wasn’t sure, re-measured the site plan and said 35 sq. ft. of new floor area is being added to create the additional 250 sq. ft. of space.  The Board discussed how this is a very sensitive area for archaeological discoveries.  The Site Review Committee report was read for the record along with a letter from an abutter.  After more discussion and with no public comment a motion was made to close the hearing at 5:40 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the addition of 250 sq. ft. as shown on the site plan dated 1/4/16 with the following special condition.  The Board of Appeals shall send a letter to the Wampanoag Tribe of Aquinnah that describes the project and suggests a representative perform a site visit with the engineer before any excavation begins.  The motion was seconded and with no further discussion passed unanimously with five in favor.

REID SILVA FOR PAUL SLAVIN AND SUSAN WAITZKIN; Article 6 Section 6.6;              6 Eddy Farm Rd.; Map 25 Lot 1.2:  Mr. Maloney opened the public hearing at 5:45 PM.       Mr. Silva explained the property is under a purchase and sale agreement and said the buyers would like to tear down the existing house and build a new one.  He reviewed a site plan dated 2/1/16 showing the footprint of the existing house and that of the proposed new house.  Two corners do not meet the minimum setback distance from the lot lines.  The closest part of the structure will be approximately 16 feet from one lot line and 18 feet from another lot line.        Mr. Silva then reviewed the signed agreement between the seller and buyer that was filed at the Registry of Deeds in book 1395, page 329 on January 6, 2016.  The agreement allows for the design.  The seller is also the abutter whose other property is within 100 feet of the new house.  The Board concluded the signed agreement satisfies the requirement for a written letter of consent.  With no public comment a motion was made to close the hearing at 5:55 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the site plan dated 2/1/16 as presented.  The motion was seconded and with no further discussion passed unanimously with five in favor.
       
ADMINISTRATION:  The January 27, 2016 meeting minutes were reviewed and approved as presented by consensus.  The next meeting will be March 23, 2016 @ 5:00 PM.

With no further business to conduct the meeting adjourned at 6:00 PM.
