Zoning Board of Appeals Minutes 09/24/14
FINAL
Present for the Board of Appeals and attending the meeting were:  Allison Burger, Chairman,  Chris Murphy, Wendy Weldon, Todd Christy, Frank LoRusso and Chuck Hodgkinson.  Also attending were George Sourati, Lynne Fifield, Neil Withers, Neil Logan, Sarah Dunbar Morris and Kris Horiuchi.  Allen Healy and Russell Maloney were absent.     

Ms. Burger opened the meeting at 5:00 PM and appointed Alternate Todd Christy as a voting member.  

GEORGE SOURATI FOR SARAH DUNBAR MORRIS; Article 4 Section 4.2A1;                 113 Hammett Road; Map 4 Lot 6:  Ms. Burger opened the public hearing at 5:05 PM.           Mr. Sourati reviewed the site plan dated 8/25/14 and the architectural plans dated 8/19/14 to construct a 784 sq. ft., two-bedroom guesthouse on a 3.8-acre parcel in a location that meets the minimum 50 foot setback distance from the lot lines.  He added the hip roof will be less than 18 feet above mean, natural grade.  The Board asked if the Board of Health (BOH) has approved the guesthouse septic plan.  Mr. Sourati said they have not yet met with the BOH.  After discussion among the owner, architect and Board a motion was made to close the hearing at 5:17 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the site plan as presented dated 8/25/14 and architectural plans dated 8/19/14 with the following Special Conditions:  1. The applicant shall obtain Board of Health approval for a guesthouse septic solution before obtaining a Building Permit.  2.  The applicant shall confirm with the Building Inspector whether or not the roof skylight is a window or a “flat roof” and meets the minimum roof pitch requirements.  3.  If the roof design is changed to the Building Inspector’s satisfaction, the applicant does not need to return to the ZBA for approval.  The motion was seconded and with no further discussion passed unanimously with five in favor.

GEORGE SOURATI FOR SARAH DUNBAR MORRIS; Article 4 Section 4.2A3;                113 Hammett Road; Map 4 Lot 6:  Ms. Burger opened the public hearing at 5:20 PM.          Ms. Horiuchi reviewed the site plan (A-1) for a 15’ X 51’ built-in swimming pool.  Supporting site plans A-4 and A-5 dated 9/19/14 and a pool fencing detail plan dated 9/14/14 were also discussed.  The equipment will be in an enclosed vault.  The pool enclosure will use a combination of the walls of the house, parts of the retaining wall and small black mesh fencing in the wooded area.  There are no plans for a pool water heater at this time.

The Board commented about the large bush near the house blocking view of the pool and the Japanese Snow Drop tree that will need to be pruned.  The Board also suggested an alternative fencing solution.  After much discussion a motion was made to close the hearing at 5:50 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve an amended plan as agreed and the pool location as shown on the site plan A-1 dated 9/19/14 with the following Special Conditions:  1. The applicant shall return with a revised site plan and pool enclosure layout for approval by the ZBA Chairman before obtaining a Building Permit.  2.  A new Special Permit application must be filed if the installation of a pool water heater is desired.  3.  The large bush next to the house shall be pruned and maintained to a point that opens the view of the pool through the windows behind the bush.  4.  The Japanese Snow Drop tree shall be trimmed and maintained to keep clear sight lines to the pool from the house.  5.  A winter safety cover shall be installed.  6.  The applicant shall obtain approval of a standpipe location from the Fire Chief before obtaining a Building Permit.  7.  All windows and doors on the main house that are within the pool enclosure shall have alarms that perform as outlined in Massachusetts Building Code for as long as the house is a part of the pool enclosure.  If at a future date the house is renovated or the pool enclosure design changes, the applicant shall return to the ZBA for approval of the new enclosure design.  The motion was seconded and after brief discussion passed unanimously with five in favor.  

DISCUSSION LYNNE FIFIELD FOR TONY SHALHOUB & BROOKE ADAMS;     Article 4 Section 4.2A1; 205 South Road; Map 25 Lots 107, 108.2:  Mr. Withers thanked the Board for its time and explained a Special Permit was granted for a 766 sq. ft. guesthouse on October 23, 2013.  An existing detached bedroom was converted to a guesthouse by adding a kitchen.  Lynne would like to review a proposed change to the kitchen and the total area of the guesthouse will increase to 775 sq. ft.  The Site Review Committee report for the proposed change was read for the record.  The Board explained the process of how a change to a previously permitted plan is reviewed.  After discussion a motion was made to declare the change as significant thus, requiring the re-notification of abutters and placing new advertising to re-open the public hearing.  The motion was seconded and with no discussion passed unanimously with five in favor.

ADMINISTRATION:  The July 23, 2014 and August 27, 2014 meeting minutes were reviewed and unanimously approved.
The November and December ZBA meetings will be scheduled as follows because of the holidays:

        Tuesday, November 18, 2014 @ 5:00 PM.  Site Visits Monday, Nov. 17 @ 3:00 PM.
        Tuesday, December 16, 2014 @ 5:00 PM.  Site Visits Monday, Dec. 15 @ 3:00 PM.

With no further business to conduct the meeting adjourned at 6:12 PM.
