Zoning Board of Appeals Minutes 07/23/14
FINAL
Present for the Board of Appeals and attending the meeting were:  Allison Burger, Chairman, Chris Murphy (arrived at 5:26 PM), Frank LoRusso, Russell Maloney, Todd Christy and Chuck Hodgkinson.  Also attending were Reid Silva, Greg Milne and John Abrams.  Wendy Weldon and Allen Healy were absent.     

Ms. Burger opened the meeting at 5:00 PM and appointed Alternate Todd Christy as a voting member.  She explained to Mr. Silva that there are only four voting members for his hearing which requires a unanimous vote for approval.  Mr. Silva wanted to proceed and open the hearing.  

REID SILVA FOR NORTH STAR REALTY TRUST (GRAEME FLANDERS); Article 8 Section 8.3; 4 Tucker Trail; Map 33 Lot 55:  Ms. Burger opened the public hearing at         5:15 PM.  Mr. Silva reviewed the plan to demolish the existing non-conforming dwelling that is approximately 2 feet from the southeast lot line on a pre-existing, non-conforming, 1.3-acre lot and construct a new single-family residence with a roof ridge height that will not exceed 18 feet above mean, natural grade.  The location of the new house will be no closer than 15 feet from the southeast lot line.  The existing garage will also be demolished.  He mentioned the project is in the Nashaquitsa Pond Coastal District and the Conservation Commission has approved the plan with conditions.

The Site Review Committee report was read for the record.  After brief discussion and with no comment from the public a motion was made to close the hearing at 5:25 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the plan as presented and dated 6/26/14 with the condition that the Board of Health must approve the septic plan before obtaining a building permit.  The motion was seconded and with no further discussion passed unanimously with four in favor.  Mr. Murphy arrived at 5:26 PM.

ADMINISTRATION:  The June 25, 2014 meeting minutes were reviewed and approved as presented with four in favor and one abstention (Mr. Christy).

The Board reviewed the draft (#10) of the Jessica Roddy proposed Zoning Bylaw Article 6 Section 6.12 – Exception for Accessory Apartments.  The Board discussed the bylaw and agreed it is very difficult to understand.  They asked Chuck H. to invite Ms. Roddy and Ms. Weidner to the next ZBA meeting to discuss the draft bylaw.

Ms. Burger is a member of the Town Committee for Squibnocket and explained the Committee is reaching out to the Town permitting boards seeking comments or regulatory suggestions.  After discussion the Board agreed that it would not be appropriate to comment at this time but, would like a chance to comment on the Committee’s ultimate recommendations.

The next meeting will be August 27, 2014 @ 5:00 PM.  

With no further business to conduct the meeting adjourned at 5:58 PM.
