Zoning Board of Appeals Minutes 06/25/14

Present for the Board of Appeals and attending the meeting were:  Wendy Weldon, Chairman, Allison Burger, Vice Chairman, Chris Murphy, Frank LoRusso, Russell Maloney and Chuck Hodgkinson.  Also attending were Reid Silva and Martha Cottle.  Todd Christy and Allen Healy were absent.     

The meeting came to order at 5:02 PM.  

REID SILVA FOR THE RONNIE PLANALP REVOCABLE TRUST; Article 4           Section 4.2A3; 275 South Road; Map 24 Lot 163.4:  Ms. Weldon opened the public hearing at 5:05 PM.  Mr. Silva reviewed the plan to clear land for approximately ½ of a proposed 60’ X 120’ tennis court and fencing in a location that meets the minimum 50-foot setback distance from the lot lines.  No outdoor lighting will be installed as outlined in the bylaw.  The tennis court is within the South Road Roadside District.

The Board discussed the observations made at the site visit and read the Site Review Committee report for the record.  A letter to the Board from Martha Cottle was also read for the record.     Ms. Cottle added her brother and the Kalkin family are also concerned with tennis court noise.  The Board pointed out it has not received any correspondence from the Kalkin family.

Article 4 Section 4.2 of the bylaw was read aloud.  Mr. Silva suggested additional vegetation as screening may help dampen the noise.  The Board mentioned the road noise from South Road is audible at the site and asked Ms. Cottle if she hears noise from the owner’s pool.  Ms. Cottle said no.

After much discussion about noise mitigation and with no further comment from the public a motion was made to close the hearing at 5:35 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the site plan dated 5/22/14 with the following special conditions that will be met at the time of construction:  1.  A level berm shall be added along the south side of the court and fencing, placed as close to the fence as feasible and planted with thick, sound-deadening vegetation.  The berm height on this side shall be six feet above the court surface.  2.  A level berm shall be added along the west side of the court and fence, placed as close to the fence as feasible and planted with thick, sound-deadening vegetation.  The berm height along this section shall be five feet above the court surface.  3.  The disturbed area outside the fence along the east side of the court shall be re-vegetated with thick, sound-deadening vegetation and extend as close to the fence as feasible.  4.  The berm and planting plan shall be approved by the Chair of the Zoning Board of Appeals before a building permit is obtained.  5.  All vegetation shall be maintained and replaced as needed.  The motion was seconded and with no further discussion passed unanimously with five in favor.

ADMINISTRATION:  The May 28, 2014 meeting minutes were reviewed and approved as presented by consensus.

The Board discussed that it’s time to rotate the Chair and Vice Chair positions.  A motion was made to appoint Allison Burger as Chairman and Russell Maloney as Vice Chairman for the next year.  The motion was seconded and passed unanimously with five in favor.

The next meeting will be July 23, 2014 @ 5:00 PM.

With no further business to conduct the meeting adjourned at 5:55 PM.
