Zoning Board of Appeals Minutes 9/12/06
FINAL
Present for the Board of Appeals and attending the meeting were:  Bill Rossi, Chair, Peter Knight, Chris Murphy, Rodney Bunker, Wendy Weldon, Barbara Armstrong and Chuck Hodgkinson.  Also present:  Carly Look and Elise Elliston.  Absent was Frank LoRusso.  

Mr. Rossi opened the meeting at 7:02 PM.

MINUTES:  The August 8, 2006 minutes were reviewed and discussed.  A motion to approve the minutes as amended was made, seconded and unanimously approved.

CARLY LOOK FOR ALAN PORITZ POOL SPECIAL PERMIT:  Carly Look explained some minor changes to the built-in swimming pool plans that were approved by the Board in December 2005.  After a brief discussion the Board unanimously agreed the changes to the pool fencing, relocated garage and stairs were not appreciably different than the original plan and approved the changes as presented.

CHRIS ALLEY FOR LINDAUR/FINBURY:  Mr. Rossi opened the continued public hearing at      7:10 PM and read a letter from the applicant requesting a continuance to October 10, 2006 @ 7:25 PM.  A motion to accept the request was made, seconded and unanimously approved.

ABUTTERS VS. GIRL SCOUTS:  Chuck H. updated the Board on the MVC review and process for this project.  The Board’s review of the appeal filed by the abutters to revoke the building permit issued on April 11, 2006 has been frozen because of the MVC review.  If the MVC formally votes on the decision reached at their September 14th meeting, the ZBA will re-open the continued hearing on October 10, 2006 @ 7:40 PM.

ELISE ELLISTON DISCUSSION; KLOSS PROPERTY MAP 4 LOT 23.2:  Ms. Elliston reviewed the changes to her plans to move the current house to a new foundation.  Her calculations indicate that the house’s roof ridge and deck railing heights will be in full conformity at the new location.  The Board asked Ms. Elliston to have the Building Inspector confirm her calculations and if he agrees, she will not need to apply for a Special Permit to move the house and bring it into full conformity.  If this is done the existing “non-conforming” classification of the house will no longer exist.

EXECUTIVE SESSION SEPTEMBER 19 @ 6:00 PM:  Chuck H. informed the Board that town counsel would like to give them an update on a legal matter in executive session next Tuesday, September 19 @ 6:00 PM.  The Board agreed to schedule and post the meeting accordingly.

NEW ZBA REGULATION GL CH. 44 SECTION 53G: The Board reviewed a draft regulation that is consistent with GL Ch. 44 Section 53G.  It enables to Board to hire an outside consultant if needed at any time at the applicant’s expense.  Upon review a motion to adopt the regulation as drafted pending final approval by town counsel was made, seconded and unanimously approved.

With no further business to discuss the meeting adjourned at 7:25 PM.
