FINAL
Present for the Board of Appeals and attending the meeting were: Bill Rossi, Chair, Peter Knight, Chris Murphy, Frank LoRusso, Rodney Bunker and Chuck Hodgkinson. Absent were Barbara Armstrong, Wendy Weldon and Michael Halbreich. Also present: David Handlin and Clara Batchelor (for Hubschman), Jimmy Fuhrer (for Middleton, Feuerstein, Eddy & Berlin) and Hillary Noyes-Keene.
Mr. Rossi opened the meeting at 7:00 PM.
MINUTES: The December 13, 2005 minutes were reviewed. A motion to approve the minutes as presented was made, seconded and unanimously approved.
DAVID HANDLIN & CLARA BATCHELOR FOR HUBSCHMAN POOL: Mr. Rossi opened the public hearing at 7:10 PM. David Handlin and Clara Batchelor summarized the construction and landscape plans for a built-in swimming pool and separate equipment shed. Mr. Rossi read a letter from abutter Ray Kellman that endorsed the Hubschman plans. Mr. Handlin was given another copy of Chilmark’s pool specifications with special mention of regulation # 6 requiring an off site water source for the initial filling of the pool. After much discussion the Board was satisfied that the plans were consistent with Chilmark’s pool regulations while adding the equipment shed should be insulated to dampen noise. The tight joints on the stone veneer/pool enclosure were approved and will be confirmed by the
Building Inspector. Mr. Handlin has already received standpipe location approval from the Fire Chief.
With no further discussion a motion to approve the “Pool Enclosed Plan” dated 7/2/05 as presented with the condition that the pool’s construction will meet Chilmark’s pool specifications and the equipment shed will be well insulated to reduce noise was made, seconded and unanimously approved.
DAVID HANDLIN AND CLARA BATCHELOR FOR HUBSCHMAN TENNIS COURT: Mr. Rossi opened the public hearing at 7:25 PM. Mr. Handlin summarized the proposed tennis court plans, fence materials and pointed out there will be no artificial lighting. After discussion the Board complimented Mr. Handlin on his thorough understanding of the by-laws that is reflected in his plans. A motion to approve the “Bid Set Plan” dated 7/2/05 was made seconded and unanimously approved.
JIMMY FUHRER FOR MIDDLETON, FEUERSTEIN, EDDY AND BERLIN: Mr. Rossi opened the continued public hearing at 7:40 PM. Mr. Fuhrer summarized the plans to construct a shed roof covering over a bluestone patio. He explained that its purpose is to provide weather protection for the main entrance to the guesthouse. Mr. Rossi read a letter from the Chilmark Planning Board dated January 9, 2006 for the record. After much discussion of the plans, the by-law and the Planning Board’s letter the Board concluded that the proposed construction does not increase the structure’s roof mass in a manner that is detrimental to the neighborhood.
Mr. Rossi recommended writing a letter to the Planning Board that thanks them for their input and explains the Board’s decision.
A motion to approve the plans as presented and dated 1/10/06 was made seconded and unanimously approved.
ROLAND KLUVER: Mr. Rossi opened the public hearing for a zoning variance under Article 11 Section 11.6C2d at 7:55 PM. The applicant requested a continuance to February 14 at 7:10 PM. A motion to accept the request for a continuance to February 14th at 7:10 PM was made, seconded and unanimously approved.
HILLARY NOYES-KEENE: Mr. Rossi opened the public hearing at 8:10 PM. Ms. Noyes-Keene summarized the plans to add a covered porch to the addition that is currently under construction. Mr. Rossi read two letters of consent from the abutters that are within 100 feet of the proposed construction. With no further discussion a motion to approve the plans as presented and dated 1/10/06 was made, seconded and unanimously approved.
2005 ANNUAL REPORT: A draft of the 2005 ZBA annual report was reviewed and approved with minor changes.
With no further business to discuss the meeting adjourned at 8:25 PM.
