Present for the Board of Appeals and attending the meeting were: Bill Rossi, Chair, Wendy Weldon, Peter Knight, Frank LoRusso, Michael Halbreich, Barbara Armstrong and Rusty Walton. Absent: Chris Murphy and Rodney Bunker. Also present: Sam Sherman for Kay Matschullat and abutters Judie Flanders (Matschullat and Halbreich) and Rex Williams (Halbreich).
Mr. Rossi opened the meeting at 7:00 PM with the following agenda:
- Michael Halbreich; 414 North Road; Map 20 Lots 58 & 59.
- Sam Sherman for Kay Matschullat; 34 Flanders Lane; Map 26 Lot 28.
- Ed Barrett and Catherine Deese; 1 North Road; Map 1 Lot 001.
NEW CASES
MICHAEL HALBREICH was recused as a ZBA member for his application and proceeded to summarize his plans to expand the pre-existing, non-conforming single family residence located at 414 North Road. He explained that a family room (potential future bedroom) will be developed in the existing basement as part of this project. Other specifications included: the addition will have a ridge height of 14’ 9” (less than the existing house); The open deck area on the west side will become a screened porch; a covered porch will be added to the expansion on the south side.
Abutter Rex Williams asked when the present renovation work will be completed and was assured all of this work will be finished by mid-June. He was also promised the new construction proposed with this application will not start until after Labor Day, September 5, 2005.
Mr. LoRusso made a motion to approve the plans as presented. Mr. Knight seconded. The vote was unanimous in favor.
SAM SHERMAN, architect for Kay Matschullat, reviewed the plans for the project. The specifics included a portion of the existing deck that is within the required setback will be removed; two small units will be added on opposite sides of the building and will be within the required setbacks; the house will have six bedrooms – with the possible conversion of an outlying structure into a detached bedroom at a later date; the septic system is alleged to have capacity for seven bedrooms; the existing flat roof will be replaced with a gable roof with a maximum height of 21 feet.
Mr. Rossi, with Mr. LoRusso concurring, insisted the pool safety issues must be dealt with at this point – not delayed until the landscape architect develops a plan. Mr. Sherman indicated the landscape architect would meet with the Conservation Commission and then return to the ZBA for approval of the plans for a new driveway and pool surroundings. After discussion, Mr. Sherman agreed to have the pool’s safety fence installed before starting any construction.
Mr. Rossi read a letter from abutter Allen Flanders that encouraged the ZBA to approve the application.
Mr. Knight made a motion to approve the application with five conditions: 1. A four-foot high fence erected at pool level must surround the swimming pool. 2. Construction shall not begin until the pool safety fence is in place and has been inspected and approved. 3. The pool is not to be used until it and the safety fence comply with the Chilmark ZBA permanent swimming pool regulations. 4. The Certificate of Occupancy shall not be issued until the pool meets the permanent swimming pool regulations. 5. The Chilmark ZBA must approve all landscape plans relating to the pool and pool equipment.
Mr. LoRusso seconded the conditional approval. The vote was unanimous in favor.
ED BARRETT AND CATHERINE DEESE did not appear for their hearing. Mr. LoRusso made a motion to continue the hearing for this application to May 10, 2005. Ms. Weldon seconded. The vote to continue was unanimous in favor.
OTHER BUSINESS
The Minutes from the March 8, 2005 ZBA hearing were reviewed but could not be approved because of an inadequate quorum.
Mr. LoRusso made a motion to adjourn the meeting. Ms. Armstrong seconded. The vote was unanimous and the meeting was adjourned at 8:15 PM.
