Selectmen's Meeting Minutes 07/10/18
Chilmark Board of Selectmen    July 10, 2018    Meeting Minutes
Present: Chairman James Malkin, Warren Doty and Bill Rossi. Tim Carroll, Fire Chief David Norton, Police Chief Jonathan Klarèn, Clarissa Allen, Margaret Maida, Wayne Iacono, Howard Grimm, Clark Goff, Alexandra London Thompson, Ebba Hierta, Rich Saltzberg, Landry Harlan and MVTV videographer.

At 7:00 PM   Chairman Malkin called meeting to order in the Selectmen’s meeting room.
Chairman Malkin said we will take items from agenda out of order if a person is here to address them.

Minutes:
Draft minutes from May 15, 2018, June 5, 2018 and June 19, 2018 were reviewed, corrections were made.  Mr. Rossi moved to approve these 3 separate meeting minutes as corrected. Mr. Doty seconded the motion. SO VOTED: 3 Ayes

Jen Delorenzo -Summer School Yoga:
Ms. Delorenzo presented the Selectmen with her request to hold the summer school initiative yoga camp. Ms. Delorenzo said the principals at both Chilmark and West Tisbury Schools recommended utilizing the Chilmark Community Center as both schools have late summer construction happening and an alternate space is needed. Ms. Delorenzo said on average it costs student’s families $200.00 for 4 days of camp.

Mr. Doty said we usually offer free programs. Ms. Delorenzo said the fee helps to pay for the instruction but also the financial assistance for kids who qualify through the free lunch program to attend. Mr. Rossi said if you are charging a fee you should pay our regular rental of $200.00 a day. Ms. Delorenzo said that would be prohibitive for the program. Discussion ensued.

Mr. Doty moved that if this is a school endorsed program and we have letters of endorsement from both the Chilmark and West Tisbury Principals we will allow the use of the Community Center for the desired dates at the end of August and waive the rental fee. Br. Rossi said the cleaning deposit is still required Mr. Rossi seconded the motion. SO VOTED: 3 Ayes

Library- Parking:
Library Director Ebba Hierta and Library Trustee member Candy Schweder were present to discuss the parking request at Chilmark School. Ms. Hierta said we are requesting you reconsider posting no parking signs at the Chilmark School. Ms. Hierta said the library staff parks there as well as patrons when the Library lot is full. Chilmark Community Center Director Alexandra London Thompson said she had requested the signs so during the drop-off and pick-up for children attending the summer pre-school program they could have a safe area.
Ms. Hierta said there are some businesses that are using the space to store items. Discussion ensued. Selectmen agreed to not post signs at this time and to follow up on policy of who is using and how parking lot is being used.    

Beach - Crab Corner:
Beach Committee Chairman Clarissa Allen and members Margaret Maida and Wayne Iacono were present to discuss this beach item. Chairman Malkin said we received an email from the Beach Superintendent requesting clarification for the Crab Corner area.

Beach Continued…
Ms. Allen said we are allowing people to go into the water at Crab Corner at their own risk. There will not be staff in the Crab Corner area. Parents will have to watch their own kids as they are accepting the risk. Ms. Allen said we allow kayaks and rowboats past the groin. Mr. Rossi said the Selectmen support the Beach Committee policy on these matters.

Mr. Doty asked how the past 2 weeks went at the Chilmark beaches. Ms. Allen said all went well and people really like Squibnocket. Ms. Maida said that the lot has not had to turn anyone away; seems that when it is about to be full a space opens up for a new arrival. Ms. Maida reported that the Beach Department has staffed Squibnocket with a gate guard and a beach guard from 9:00 AM to 5:00 PM. Ms. Allen said Mr. Murphy the Animal Control Officer will be going to Squibnocket after 5:00 PM to ensure people are not bringing their dogs till after 7:00 PM when they are allowed. Ms. Maida said the dogs are allowed before 9:00 AM and after 7:00 PM.
Ms. Maida said folks who could not access a beach (disabled) are really happy to be able to utilize Squibnocket Beach.  

Police Department:
Chief Klarèn said the Vineyard Transit Authority (VTA) had a bus that was too small July 5th to accommodate all of the people at the Menemsha Shuttle parking lot. Since then the VTA has replaced it with a larger bus and all is running smoother. Mr. Doty asked for information about the Boathouse Road parking. Chairman Malkin said he has received many concerns about the parking on Boathouse Road and recommended inviting all of the lease holders to attend the next Selectmen’s meeting July 24, 2018. Chief Klarèn said he doesn’t want parking on the left (channel) side of the road as that causes public safety issues.       

Chief Klarèn discussed meeting with manager of the Galley and working on a pedestrian safe area for the patrons to keep clear of vehicle traffic.

Chief Klarèn said he would like to install no parking signs along North Road by the entrance to the Flea Market to notify drivers that they cannot park there if lot is full. Chief Klarèn said the signs would be necessary only from June to September. Mr. Doty moved to approve Chief Klarèn’s no parking signs on North Road plan. Mr. Rossi seconded the motion.
SO VOTED: 3 Ayes  

Public Safety Building Site Committee:
Mr. Rossi reported that the Committee recommended seeking the property that abuts the town hall (Emmett Carroll’s property) and to consider the Tri Town Ambulance be in a separate building on that property. Discussion ensued. Mr. Doty recommended the reconfigured building on the already owned land here beside town hall and to consider leasing parking spaces from Emmett Carroll. Selectmen decided to seek plans to submit a permit with the Conservation Commission to go forward with this sight plan that we have reviewed by Pacheco Ross. Mr. Rossi said this building is estimated to cost $6,000,000.00 to $7,000,000.00. Mr. Doty said we will also talk more with Emmett Carroll about parking lease on his property for town employees. Mr. Carroll said a next step could be to seek completed plans for a Conservation Commission Notice Of Intent (NOI).
Public Safety Building Continued…
Some issues that will be addressed by our engineer at Vineyard Land Surveying for the NOI are:
  • On site water retention
  • Diversion of surface water runoff
  • Parking surfacing materials
Mr. Doty moved to take the Pacheco Ross Plans as submitted and reviewed to Vineyard Land Surveying and request them to work on plans for NOI application. Mr. Rossi seconded the motion.  SO VOTED: 3 Ayes

Land Acquisition Executive Session:
This agenda item was tabled.

Season Updates from Departments:
Highway:
Mr. Carroll said the Highway Department has been working with some equipment that has failed but has since gotten the equipment repaired. Highway has hired another part-time / seasonal employee to keep up with roadside maintenance.   

Harbor:
Chairman Malkin said there was an issue with a boat needing water at the fuel dock. Chairman Malkin said he has asked both Harbormaster and Fuel Dock Manager to come to the next Selectmen’s meeting to discuss that issue. Other than that issue the Menemsha Harbor is running smoothly.  Mr. Doty asked if the electrical issues with pedestals were fixed yet. Chairman Malkin confirmed all up and running well.  Mr. Doty said he has an issue with tall grass around the Harbormaster shack and around the Comfort Station. Mr. Carroll said the Harbormaster requested that the Highway Department not cut the area at the shack as they had honey bees in the flowers there. Police Chief Klarèn said on the topic of tall grass the Menemsha shuttle lot parking needs trimming so people don’t park hot cars on dry grass possibly causing a fire. Mr. Doty said we have mowed the grass there twice already this season but we will do so again soon.

Chilmark Preschool - Request for Proposals (RFP) and Lease:
Chairman Malkin said town counsel has reviewed the lease and RFP. Mr. Carroll said the term of lease should be discussed. Mr. Carroll suggested 5 year terms but the paralegal made it 1 year terms. Mr. Doty supported 5 year terms as did Chairman Malkin. Mr. Carroll said renewal also needs discussion. Mr. Doty recommended 3 renewals. Mr. Carroll said termination also needs to be discussed. Discussion ensued.  Selectmen supported 5 year terms with 3 renewals.
Using comparative criteria; awarding the lease for the Chilmark preschool is up to the discretion of the Chilmark Board of Selectmen.  

Mr. Doty moved to accept the documents reviewed tonight as the lease and RFP for the Chilmark Preschool. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes

Mr. Carroll said this will need to be advertised with the central registrar. Chairman Malkin directed Mr. Carroll to move forward in this preschool project.
4 North Ridge Road:
Mr. Rossi reported that he got a quote from Vineyard Land Surveying to prepare the land for sale.   Mr. Rossi explained that there is an estimated $9,000.00 fee to the auctioneer if we reject bids as too low. Discussion ensued. Mr. Doty recommended spending up to $10,000.00 from Selectmen’s other purchase services budget line to prepare the property for auction.
Mr. Rossi seconded the motion. SO VOTED: 3 Ayes

Martha’s Vineyard Regional High School Building Committee - Representative:
Chairman Malkin said he asked Marshall Carroll if he would be interested and Marshall said he would think about it. No other recommendations were made at this time.

Center Fort Living - Representative:
Mr. Doty said he has asked 2 different people if they would serve on the board as Chilmark representative and neither can commit at this time. Chairman Malkin said he had the same experience.  Mr. Carroll recommended Max McCreery. Mr. Doty said he would like to ask Judy Worthington and Chairman Malkin said he would ask Max McCreery as there are 2 seats on the board vacant at this time.

Conservation Commission - Appointment:
Chairman Malkin said we have received a written request from Maureen Eisner to be reappointed to the Conservation Commission.

Mr. Doty moved to appoint Maureen Eisner as a Conservation Commissioner.
Mr. Rossi seconded the motion. SO VOTED: 3 Ayes

MIIA (Insurance)- Credits and Invoices:
Mr. Carroll said aside from the Police Department updating their policies none of the other departments are participating in the ongoing training opportunities that add to the credits from MIIA. Chairman Malkin asked if the Selectmen needed to take action about MIIA. Mr. Carroll said you can either take a credit or a grant back.
Mr. Doty moved to take credit to be applied to our invoice. Mr. Rossi seconded the motion.
SO VOTED: 3 Ayes

Harbor Boat:
Chairman Malkin asked for an update about the new harbor boat. Mr. Carroll said no one has responded to our request for proposal other than the original company we discussed at previous Selectmen meeting. Mr. Carroll said the Accountant told him we could not sign a contract with that company until Selectmen pinpointed where the money was coming from to pay the amount over the appropriation amount. Mr. Doty moved to take the amount needed (approximately $1,700.00) from the Harbor Department boat maintenance budget line. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes

MCPPO Real-estate Class:
Mr. Carroll said he will be attending this course tomorrow (7/11/18) in preparation to the 4 North Ridge Road sale.

Menemsha Pedestrian Paths Update:
Mr. Doty said he has had meetings with Janet Weidner (Planning Board) and they are working with Bill Brewster the traffic planner and talked with Police Chief Klarèn about the pedestrian safety measures by the Galley. Mr. Doty said there has been discussion with neighbors about clearing all the bushes by the Greenebaum property. Selectmen intend to move forward removing invasive species at the site.
Solar Lights- Harbor:
Mr. Carroll said the Harbor Department has installed the solar lights that he gave them on the new floating dock. Mr. Carroll said they were not terribly expensive so if they look like they would work for the area we can add them to the other dark areas (at night) in the harbor.

Signs for Menemsha:
Mr. Carroll said the no parking signs have been ordered and he is working with the Vineyard Transit Authority for Menemsha shuttle lot parking signs.

Island Housing Trust (IHT)- CPC:   
Mr. Carroll said the IHT has provided the contract agreement paperwork for signatures for the CPC funding that was approved at Annual Town Meeting. Mr. Doty moved to have Chairman of the Selectmen sign the paperwork for the IHT to receive the CPC funds. Mr. Rossi seconded the motion.
SO VOTED: 3 Ayes  

Cemetery Commissioners:
Chairman Malkin said the Cemetery Commissioners are requesting Selectmen to attend a visit to the Abel’s Hill Cemetery on Thursday July 12th at 2:00 PM. Mr. Doty said he would attend.

At 8:45 PM with no further agenda items for discussion Mr. Doty moved to adjourn. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
