Chilmark Board of Selectmen December 20, 2016 Meeting Minutes
Present: Chairman Warren Doty, Bill Rossi, Jim Malkin.

At 3:00 PM Chairman Doty called the meeting to order in Conference Room # 1 of the Town Hall in open session. Pursuant to Massachusetts General Laws Chapter 30A, section 21 (a) (3) the chairman stated that the board would go into executive session to discuss litigation strategy with Town Counsel, that having the discussion in public session would have a detrimental effect on the town’s litigation position, and that the board would reconvene in open session after the executive session.
In a roll call vote, the board voted to enter executive session with Town Counsel and the Executive Secretary in attendance. Jim Malkin – Aye Bill Rossi – Aye Warren Doty – Aye
EXECUTIVE SESSION 3:02 PM – 3:34 PM.
3:34 PM Board reconvened in Regular Session
The chairman asked if there was any business in regular session.
Police Chief Brian Cioffi
Mr. Malkin moved and Mr. Rossi seconded a motion to accept the resignation as tendered by the Chief of Police, Brian Cioffi; that the board waived the 30 day notice required under the chief’s employment contract; that the resignation is effective immediately; he will be paid through the end of this pay period using personal hours; and that the board authorizes Selectman Bill Rossi to negotiate with Tim Rich to be the acting chief of police. SO VOTED: Three Ayes.
Selectman Malkin requested that the Chairman write a memo to all town staff informing them of this action.
The board directed the Executive Secretary to write the memo to town staff; and a letter informing Mr. Cioffi that the Selectmen accepted his resignation, that it was effective immediately, that he would be paid through Sunday using 24 hours of Personal leave, and that he turn in all town equipment and property.
Selectman Malkin will inform the Chair of the Human Resources Board of these actions.
There being no further business to act on, the chairman declared the meeting adjourned at 3:45 PM.
