Chilmark Board of Selectmen Meeting Minutes July 21, 2015
Present: Chairman Jonathan Mayhew, Warren Doty, Bill Rossi, Tim Carroll, Jessica Roddy,
Ann Wallace, Isaiah Scheffer, Will Reich, Brendan O’Neil, Rob Kendall, Robert Lionette,
Lindsey Scott, Ben Retmier, Alex Elvin, Representative from Eversource and the General Contractor for 7 Brickyard Road and videographer Lynn Christoffers,
At 7:30 PM Chairman Mayhew called meeting to order in the Selectmen’s meeting room.
Minutes:
Draft minutes from July 7, 2015 were postponed.
Shellfish:
Shellfish Constable Isaiah Scheffer introduced his recommendation for the position of Assistant Shellfish Constable. Mr. Will Reich told the Selectmen a bit about himself. Mr. Doty said he was present during the interviews for the position and said Mr. Reich is a good candidate for the position of Assistant Shellfish Constable.
Mr. Doty spoke about this position having possible changes made to it in the future. The changes would be increasing the hours making the position a year-round position. At this time the position of Assistant Shellfish Constable is a seasonal position with 714 variable hours.
Mr. Scheffer is working on a recommendation of a position that would be brought to the Human Resources Board for review and recommendations. Mr. Doty said this increase is not budgeted in the FY16 budget and possibly could be put on a fall Special Town Meeting.
Mr. Doty moved to appoint Will Reich as Assistant Shellfish Constable. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
Mr. Scheffer discussed the experimental dock fixed upweller (a water flow nursery for shellfish seeds) that will use tidal flow instead of electricity. This will be open to all oyster farmers in Chilmark.
Mr. Scheffer reported no eelgrass has emerged in NashaQuitsa Pond this season. There will be a researcher coming from Environmental Protection Agency to dive and investigate. Mr. Scheffer said he will report their findings when we get them. Chairman Mayhew said Menemsha Pond has a good amount of eelgrass. Mr. Doty asked that Mr. Scheffer have a look at Stonewall Pond. Mr. Scheffer said he will investigate Stonewall Pond.
Public Hearing:
At 7:40 Pm Chairman Mayhew opened the public hearing for Eversource petition to install utility conduit and connect Utility Pole #5/71 to resident site at 7 Brickyard Road Chilmark. The General contractor and a representative from Eversource were present. Discussion ensued.
At 7:44 PM Mr. Rossi moved to close the public hearing, Mr. Doty seconded the motion.

Mr. Doty moved to approve Eversource’s petition. Mr. Rossi seconded the motion.

Public Hearing:
At 7:45 PM Chairman Mayhew opened Public Hearing for: New Housing Homesite Regulations and Guidelines submitted by the Housing Committee.
Jessica Roddy of the Housing Committee was present to present the guidelines and regulations. Ms. Roddy discussed all of the additions and alterations to Guide and Regulations. Chairman Mayhew said the Housing Committee did a very good job in reviewing and preparing the recommendations. At 7:53 PM Mr. Doty moved to close the hearing. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
Mr. Rossi moved to approve the changes as presented in these documents reviewed tonight at this public hearing. Mr. Doty seconded the motion. SO VOTED: 3 Ayes
Squibnocket Project Update:
Mr. Carroll said that Chuck Hodgkinson was unable to attend tonight but asked that Selectmen review and approve the contract from Public Archaeological Laboratory (PAL). This contract invoice would be financed by the Coastal Zone Management grant funds. Mr. Hodgkinson’s information stated that the Archaeological Survey must be completed prior to the start of the parking lot construction and skiff launch construction.
Mr. Doty moved to approve and award PAL the Archaeological Survey, Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
Mass. Department Of Transportation (DOT) Requirement:
Selectmen’s Office received the Title VI / Nondiscrimination Assurance Requirement document from the Mass. DOT. Selectmen reviewed this document, Mr. Rossi moved to approve and sign this Title VI document. Mr. Doty seconded the motion. SO VOTED: 3 Ayes
Squibnocket Pond:
Mr. Carroll said Aquinnah has written a request to hire a company to survey Squibnocket Pond town line. In the request sent from town administrator Adam Wilson it stated that Aquinnah would pay for the entire bill to have Squibnocket surveyed to define the town boundary line between Aquinnah and Chilmark.
All Island School Committee Negotiations (AISCN):
School Superintendent Matthew D’ Andrea wrote a letter asking to have a Chilmark representative from the FinCom partake in the All Island School Committee contract and budget negotiations for the coming budget year. Mr. Carroll said Richard Williams was our representative in the past and that Jim Malkin asked to be the representative at this time.
Mr. Rossi moved to appoint Mr. Malkin to the All Island School negotiations committee.
Mr. Doty seconded the motion. SO VOTED: 3 Ayes
Rotary Club’s Cycle MV / Chilmark Community Center (CCC):
Director of the Island Rotary Club has requested permission to utilize the roads and CCC exterior as a rest stop October 3, 2015. The Rotary club will supply its own portable toilets for the event. Mr. Doty moved to approve this request. Mr. Rossi seconded the motion.

Vineyard Conservation Society (VCS) / Conservation Restriction (CR):
Brendan O’Neil and Robert Kendal were present to request Selectmen’s approval of the Conservation Restriction on the “Thelma Cossuta” estate. The VCS has documented unanimous approval from the Chilmark Conservation Commissioners and the Chilmark Assessors as well.
Mr. O’Neil said that the intention of the VCS is to sell the property and have the proceeds support the VCS.
Mr. Rossi moved to approve and sign this CR. Mr. Doty seconded the motion.

Tri Town Ambulance (TTA):
Mr. Carroll said that the Selectmen can move to appoint Ben Retmier as Acting Chief for Tri Town Ambulance for 60 days. Chairman Mayhew said that Mr. Retmire has been doing a good job. Mr. Rossi asked if that would be long enough. Mr. Carroll said that this can come to them again if needed. Mr. Doty moved to appoint Mr. Retmire as Acting Chief of TTA. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
Mr. Retmire presented the Selectmen with his recommendations for appointments to the TTA.
- Jason Blandini as fulltime TTA EMT/Paramedic
- Matt Montanile promoted to full time EMT/Paramedic
- Allison Graczykowski as 20 hour week Administrative Assistant / Clerical
Mr. Rossi moved to approve these recommendations. Mr. Doty seconded the motion.

Town Clerk Request:
Selectmen’s Office received a request from the Town Clerk to have them review and appoint the following as Chilmark Election Officers: Michele Leonardi (D), Jane Greene (D)
Joan Jenkinson (R), Holly Thackeray Norton (R), Deborah K. Silliman Wass (U), Ann Wallace (U)
Mr. Doty moved to appoint all officers as listed. Mr. Rossi seconded the motion.
SO VOTED: 3 Ayes
Mr. Carroll said that the Selectmen’s Office received a request from Susan Heilbron to be re-appointed as a Registrar. Mr. Doty moved to appoint Susan Heilbron as a Registrar.
Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
Chilmark School / UIRSD:
Chilmark representative Robert Lionette was present to discuss the ongoing West Tisbury discussions to withdraw from the Up Island Regional School District UIRSD. Mr. Lionette said it seems to be a 5 year cycle that there is talk of disbanding the UIRSD usually by West Tisbury.
Extensive discussion ensued. Mr. Doty stated the importance of keeping Chilmark School open. Mr. Rossi confirmed the importance of keeping the Chilmark School open but open to hear why other changes are desirable. Mr. Mayhew said he is opposed to loss of leadership or teaching staff at the Chilmark School.
Chilmark School / UIRSD Continued…
Mr. Carroll said that the School Superintendent Matthew D’ Andrea asked that Chilmark Selectmen meet at his office in Vineyard Haven August 11, 2015 at 11:00 AM.
Executive Session: Mr. Carroll said that the Executive Session part of tonight’s meeting with town counsel about Squibnocket agreement has been postponed. Mr. Rappaport (town counsel) requested rescheduling to Monday morning July 27, 2015. Mr. Carroll said he will post a Selectmen’s meeting for 8:00 AM 7/27/2015.
Menemsha Path Updates:
Mr. Carroll said that Matt Flanders came and talked with him about installing the jute netting to keep sand from eroding over the new pathway. Mr. Carroll said that the boardwalk is expected very soon. Mr. Doty will talk with the Fish House to ask if they will help unload the boardwalk from the truck with their forklift when it is delivered to Menemsha.
Menemsha Shuttle & Signs Updates:
Mr. Carroll asked if 20” walking path signs (brown background and white lettering similar look to State parks) at Comfort Station and beach entrances to the path. Chairman Mayhew recommended a third sign for the center of the path. Selectmen directed Mr. Carroll to order the signs.
Mr. Carroll said he put a sign at the turn of Basin Road and North Road that says if full please try the Tabor House Lot & Free Shuttle. Mr. Carroll said if Selectmen would like to ask the police traffic officers to turn sign if lot full; on the flipside of the sign is Menemsha Lot Full use Tabor House Parking & Free Shuttle. Mr. Doty said the signage seems to be working the ridership on the Menemsha Shuttle better this year. Mr. Doty said the Police department reported an average of 30 vehicles parked at the Tabor House lot on the weekends.
Mr. Carroll said he will continue to have the engineers monitor the gas and emissions monthly at the Tabor House Landfill till the end of August ( as it is costly to have them do these tests ) and in the fall submit this data to the DEP.
Mr. Carroll said that Police Chief notified the Selectmen’s Office that the West Dock signage parking by permit only is missing. Mr. Doty directed Mr. Carroll to order replacement signage. Discussion turned to sign posted prior to end of North Road notifying drivers that it’s a not public throughway.
Mr. Carroll said that the new Highway Department mower has been fitted with orange lights. Mr. Carroll asked if the Selectmen will authorize him to purchase the installer’s family oysters and lobsters as a thank you because they would not bill for this. Selectmen agreed this would be good.
Mr. Doty reminded everyone that the Meet the Fleet in Menemsha will be August 6th 4pm -7 pm.
