Chilmark Board of Selectmen July 1, 2014 Meeting Minutes
Present: Chairman Bill Rossi, Jonathan Mayhew, Warren Doty, Tim Carroll, Chuck Hodgkinson, Everett Poole, Brian Cioffi, Lynn Christophers and Alexander Elvin.
At 7:30 PM Chairman Rossi called meeting to order in the Selectmen’s Meeting Room.
Minutes:
Draft minutes from the Selectmen’s June 9, 2014 joint meeting with Harbor Advisory Board were reviewed. Corrections were made to the 06/09/14 draft minutes. Mr. Mayhew moved to approve minutes as corrected. Mr. Doty seconded the motion. SO VOTED: 3 Ayes
Draft minutes from the Selectmen’s June 17, 2014 meeting were reviewed. Corrections were made to the 06/17/14 draft minutes. Mr. Doty moved to approve minutes as corrected. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
After reviewing the minutes from the June 17, 2014 Mr. Mayhew said that the cap for runners of the Chilmark Road Race should be 1600. Possibly back down after this year’s test addition of 100 from 1500.
Police Department Appointments:
Police Chief Brian Cioffi was present to request the Selectmen approve and appoint the following positions at the Chilmark Police Department for the coming season;

Chief Cioffi requested that the selectmen not reappoint Steven Pupek as a full-time police officer for the town.
Discussion turned to police department staffing shortages. Mr. Doty asked how Spider Andresen as a special officer was working out for the police department. Chief Cioffi said he has worked out well; he is primarily on a voluntary basis for the Town on Wednesdays. Mr. Doty asked about Jack Collins as well. Chief Cioffi said he has donated a lot of his time too.
Mr. Mayhew moved to approve the Police Department appointments as presented by Chief Cioffi. Mr. Doty seconded the motion. SO VOTED: 3 Ayes
Menemsha Off-Site Parking Update:
Mr. Doty spoke about ways to communicate the lot’s existence to people with information cards and signs. VTA director recommended closing North Road parking entirely so people will utilize the Landfill Parking. Discussion ensued. Chief Cioffi recommended signs on spots that seem like parking combined with thorough publicity about the free parking and shuttle available.
Mr. Mayhew recommended signage on North Road “no parking from 4pm to 9pm”.
Mr. Doty recommended that enforcement for no parking will start when signage is available. Chief Cioffi was in support of this plan.
Discussion turned to Menemsha traffic. Chief Cioffi and Selectmen shared concerns that the “Jersey Barriers” would hinder emergency vehicle access to the West Dock. Chief Cioffi will communicate his concerns with the contractors and remedy this problem.
Mr. Carroll confirmed the signage request from the Selectmen for the parking restrictions.
Discussion turned to the miraculous recovery Chris McCloud has had since his cardiac arrest last week. Mr. Mayhew credited the quick thinking and response of Rodney Bunker, in bringing Chris to the Ambulance barn on Menemsha Cross Road where EMT and (trained) town employees immediately started CPR. Chief Cioffi said that the LUCAS machine also played a very important role in helping Mr. McCloud.
Public Access Over Crick Hill:
Mr. Mayhew expressed concern that the residents on Crick Hill are making moves to close access over Crick Hill. Mr. Doty said he spoke with Ron Rappaport and the information that

Town counsel gave was individuals may have rights to access from one side of Crick Hill to the other but the Town of Chilmark has no jurisdiction. Mr. Carroll explained that we do not pave, plow or supply streetlights in this area giving us no precedence. Mr. Poole said the Town maintained a flag pole there.
Mr. Doty said he could not speak for Ron Rappaport on this issue and recommended Selectmen talk to Ron Rappaport with questions that came up tonight. Chairman Rossi and Mr. Mayhew agreed to talk with Ron Rappaport further on this issue.
Further on Off-Site Parking at Landfill:
Mr. Doty said that the Parking Lot at the Landfill is almost ready for the season but he would like to have the edges mowed. Mr. Carroll said he has not ordered the car stops as they are $60.00 each and he wanted to see how the VTA bus turning around worked prior to putting barriers possibly in their way. Mr. Carroll said that lines could be painted in for definition of parking spots.
Nab’s Corner Update:
Chuck Hodgkinson has supplied the Selectmen with a time line and a budget estimate. The estimate includes surveying bounds, construction roads & curb cuts along with utilities. Chairman Rossi recommended that the Town not buy the well pumps and to leave that up to the home builders.
Mr. Hodgkinson said that this timeline and budget differ from the Middle Line Road in the NSTAR requirements. NSTAR requires a utilities plan approved by NSTAR prior to sending out RFP. The fee that NSTAR charges for the utilities plan is an additional $500.00.
The estimated cost of this part of the Nab’s Corner Project is $119,300.00. Mr. Doty moved to approve and move forward with the plans as presented in the plan presented by Mr. Hodgkinson. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Harbor Update:
Mr. Doty reported that the barge left Menemsha Harbor at 2:00PM today and 15 pilings have been put into place. This completion of pilings work will allow the regular boats that have been displaced back into their regular slips.
Mr. Doty also said that the (harbor) staff seems well trained and is managing well this season. The maintenance jobs are being checked off the “to do list”. Mr. Doty said that the Selectmen met with the Harbor Master and our finance team (Accountant and Treasurer) to work on procedures for payroll spreadsheet and financial reports. The town accountant went to the harbor shack to check on the computer software to see what sort of report she can utilize with the harbor turnovers.
Discussion turned to moving forward in utilizing the new pump-out system. Mr. Carroll said it is unclear what still needs to be done to satisfy our Board of Health so we can proceed in offering -

the pump-outs for the public. Mr. Doty said he would follow up with the Board of Health to move this forward.
Mr. Doty said that the Selectmen approved a very slight move of the replacement pile at the Wlodyka slip so the width is now 13”.05”. Mr. Carroll said the town will charge $1,000.00 to Wlodyka for the replacement pile as their larger boat broke it.
Squibnocket Committee:
Mr. Carroll said that the Squibnocket Committee has started spending money in mailings to the public but they do not have a budget set up and recommended discussion as to where the expenses will be billed. Mr. Rossi spoke of the Administration cost and other expenses but would like the Committee to determine what their expenses might be. Until then chairman Rossi recommended allotting $500.00 from the Selectmen’s maintenance account. Mr. Mayhew moved to approve up to $500.00 from the Selectmen’s account until the committee has submitted their budget. Mr. Doty seconded the motion. SO VOTED: 3 Ayes
Beach Department:
Mr. Mayhew expressed his concerns that Menemsha is not being staffed properly with guards. Mr. Doty said he has seen 30 to 40 people in Crab Corner at times with no guard supervision.
Mr. Carroll said today is the first day of staffing Menemsha and it’s also the beginning of the fiscal year. Chairman Rossi said he believed the Selectmen requested at the financial budget hearing that Beach Committee would add additional guard to “Crab Corner”. Mr. Carroll said he would check with the Beach Department to see what staffing they will have. Mr. Mayhew said that Menemsha should have 2 guards during beach hours.
Mr. Carroll said Karen Pietruska has asked to be paid as acting Beach Superintendent. Mr. Doty moved to pay Ms. Pietruska as acting superintendent in Martina Mastromonaco’s absence.
Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Financial Bonding:
Selectmen discussed the financial bonding that was on agenda of their June 25, 2014 meeting with FinCom and Treasurer Melanie Becker. The Town financial advisor has sent information on the refunding we are issuing for 1.7 million. Discussion ensued.
Special Election:
Mr. Carroll will place Special Election for override on the next Selectmen’s agenda for the July 15, 2014 meeting.
Human Resource Board:
Mr. Carroll said there is conflict of interest webinar available to parties that are interested.
Mr. Carroll discussed the re-graded Accountant & Treasurer positions and comparison to other towns. Mr. Carroll also supplied a drafted letter based on the June 17, 2014 Selectmen’s Meeting, for the Selectmen to review and sign concerning the HRB.
Human Resource Board Continued….
The letter asks that an impartial review of all paid positions be done periodically. The letter also recommended a review be done every 5 years of the towns’ compensation plan.
Mr. Carroll asked for the Selectmen to direct him in moving forward with the annual staff election for representation of a non-voting elected representative to the HRB. Chairman Rossi directed Mr. Carroll to precede with the process of staff representative elections for representation on the HRB.
Shellfish Constable:
Mr. Carroll said Isaiah Scheffer requested the Selectmen to approve purchasing lunch for the volunteers who help move shellfish seed. Mr. Doty moved to approve lunch expense from the Shellfish Department budget for the volunteer lunch. Mr. Mayhew seconded the motion.
SO VOTED: 3 Ayes
Fireman’s Association:
Fireman’s Association president Jeremy Bradshaw has sent a request into the Selectmen’s office to hold a “boot drive”. Mr. Carroll explained that this is a one day fundraising event proposed for July 5, 2014 from 10:00 AM to 6:00 PM to be held in Bettlebung Corner.
Mr. Mayhew moved to approve this request from the Fireman’s Association. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Chairman Rossi wished them success in their fundraiser.
Tropical Storm:
Selectmen discussed the possible effects the Vineyard will experience from storm Arthur from July 2nd -4th.
Cape Light Compact:
Mr. Carroll spoke about a pilot energy audit signup project. Discussion ensued.
NSTAR:
NSTAR has sent notification to the Selectmen’s office of the Tree Trimming plans in Chilmark for the next 4 weeks. Mr. Mayhew said that July is not the ideal time for this project and hopes that next year this is done in the spring.
At 9:04 PM Mr. Doty moved to adjourn. Mr. Mayhew seconded the motion.
