Chilmark Board of Selectmen March 4, 2014 Meeting Minutes
Present:
Chairman Doty, Bill Rossi, Jonathan Mayhew, Tim Carroll, Lynn Christophers, Mark Lovewell, Curtis Schroder, Brian Smith, Fred Hancock, Mark London, Dennis Jason, Linda Coutinho, Riggs Parker, Frank Yeomans, Joan Malkin, Evelyn Malkin, Jim Malkin, Bruce Golden, Sam Hart, Lynn Ditchfield, Brian Cioffi, Margaret Maida and Candy Shwedder.
At 7:00PM Chairman Doty called meeting to order in the Selectmen’s Meeting Room.
Chairman Doty made an announcement about the Squibnocket Beach Plan. Mr. Doty said the next presentation will be held here March 11, 2014 at 7:00 PM there will be reports presented from 2 consultants. These can be found on the Chilmark Web link: http://www.chilmarkma.gov/Pages/ChilmarkMA_BBoard/
Mr. Doty introduced members present from the FinCom the reason they are here is in response to a letter sent to the Commission concerning their budget.
MV Commission Budget:
The members of MVC who came in response to budget inquiry; Fred Hancock chairman, Brian Smith clerk/treasurer & appointee from West Tisbury, Curtis Schroder admin, Joan Malkin Chilmark appointee. Discussion ensued. The outcome was the MVC director said that if the town doesn’t pay its percentage of the bill for MVC FY15 budget it will be responsible for the 8% interest penalties until it is paid in full. Mr. Hancock recommended the budget concerns come to the MVC prior to the budget being set. The FinCom will be involved in the MVC budget prior to the budget being approved for FY16.
Adult Continued Education:
Lynne Ditchfield and Sam Hart are present to defend the request of $9,567.00 from Chilmark for continuing the ACE program. Discussion ensued, no action was taken.
Police Department Vehicle Replacement:
Police Chief Brian Cioffi has returned to discuss vehicle replacement for the police department. During the FinCom budget hearings it was discussed to have the vehicle replacement in the budget rather than as an article at town meeting. Chief Cioffi said there are now 4 cruisers in the department the plan is to replace one every other year. Chairman Doty recommended the police cruisers will be in our 5 year capital plan.
Beach Committee Appointment:
Chairman Doty said the Selectmen received 2 letters requesting to be appointed to the Beach Committee by Candy Shweder and Margaret Maida. Candy Shweder has withdrawn her request, and supported Mrs. Maida’s appointment.
Mr. Rossi moved to appoint Margaret Maida to the Beach Committee. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Home Rule Petition:
Chairman Doty read the wording that will be on the Town Warrant, it is as follows:
An act relative to the Squibnocket Pond Overlay District in the town of Chilmark.
SECTION 1. Notwithstanding chapter 132B of the General Laws or any other general or special law to the contrary, the town of Chilmark may prohibit, in the Squibnocket Pond Overlay District as defined by the town of Chilmark, the use of chemical fertilizers, herbicides, fungicides, pesticides, chemical septic system cleaners and such other substances as may be determined by the town of Chilmark board of health.
SECTION 2. The adoption of section 12.6(H)(1) of the town of Chilmark zoning-by laws by the town of Chilmark is hereby validated, ratified and confirmed.
SECTION 3. This act shall take effect upon its passage.
Annual Town Meeting Warrant:
Selectmen reviewed all of the articles set forth for the ATM warrant. Discussion ensued. Mr. Mayhew asked to be recused from discussion and voting to approve article 29 as he is a creek lot holder and the Aquinnah town line affects his property.
Mr. Rossi moved to approve all of the articles as put forth tonight except article 29. Mr. Mayhew seconded the motion. SO VOTED 3 Ayes
Mr. Rossi moved to approve article 29. Mr. Doty seconded the motion.
SO VOTED: 2 Ayes, 1 Abstain Mr. Mayhew
Clean Vessel Act, Pump-out System:
Harbormaster Jason said that the plan submitted is too elaborate for Menemsha and recommended amending the system making it more suitable for our needs. Discussion ensued. Mr. Carroll recommended Mr. Jason and Mr. Mayhew and himself meet at the site and return with recommendations at the Selectmen’s March 18th meeting.
Harbor Staffing:
Chairman Doty said that the Human Resource Board has recommended keeping the same number of Assistant Harbormasters (2). And same number of Assistant Wharfingers (2). Mr. Mayhew recommended eliminating the second Assistant Harbormaster position when Richard Steves retires.
Mr. Doty moved to advertise for 2 Assistant Harbormaster positions and 2 Assistant Wharfinger positions. Mr. Rossi seconded the motion. SO VOTED 3 Ayes
Mr. Carroll said he will be advertising for all the seasonal employees; Library, Beach, Harbor and Police Department Seasonal Staff.
Oyster Season:
Chairman Doty said the Selectmen have received recommendation from Constable Scheffer to close oyster season in Tisbury Great Pond on March 5, 2014. Mr. Mayhew moved to close oyster season in Tisbury Great Pond March 5, 2014. Mr. Rossi seconded the motion.
SO VOTED 3 Ayes
Middle Line Road:
Mr. Carroll said the Selectmen’s office has received the Middle Line Road FY2015budget and the annual audit from Dukes County Regional Housing Authority. Mr. Rossi moved to approve the MLR budget and accept the 2013 end of year audit. Mr. Doty seconded the motion.
SO VOTED 3 Ayes
At 9:15 PM Mr. Mayhew moved to adjourn. Mr. Rossi seconded the motion.
