Chilmark Board of Selectmen July 2, 2013 Meeting Minutes
Present: Chairman Warren Doty, Bill Rossi, Jonathan Mayhew, Tim Carroll, Jonathan Revere, Brian Cioffi, Whitney Hyde, Elizabeth Hourihan, Jeffrey Madison, Vernon Welch,
Hannah Nichols, David Stork, David Norton, Marshall Carroll, Margaret Maida, and
Remy Tumin.
At 7:30 PM chairman Doty called meeting to order in the Selectmen’s Meeting Room.
Minutes:
Draft minutes from Selectmen’s June 18, 2013 meeting were postponed as they were not yet complete. These draft minutes will be reviewed at July 16, 2013 Selectmen’s meeting.
Conflict of Interest Disclosure:
Town counsel Ron Rappaport sent the Selectmen a letter disclosing his representing an abutter to the Squibnocket Pond Blacksmith Valley Association property. Mr. Rappaport is representing Chilmark Zoning Board of Appeals against the Blacksmith Valley Association Appeal to a ZBA decision. Mr. Doty said this was clear and he did not see a problem with this. Mr. Rossi moved to sign the disclosure letter. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Squibnocket Beach Committee:
Mr. Rossi gave an update of the Squibnocket parking lot and the on going plans for access to Squibnocket Farm. Mr. Rossi said the resurfacing of the parking lot was completed and should last for the season.
A concept plan for a bridge was submitted to the Squibnocket Beach Committee. Mr. Rossi said that no action will take place this summer. Mr. Rossi said the committee hopes to have a proposal this fall to present to the town. Vineyard Open Land Foundation, Squibnocket Farm Association and the Town will work together to formulate a plan.
David Stork asked when a plan will be open for public comment. Mr. Rossi said a date has not been set yet but a plan will be presented to the Town of Chilmark for comment. Mr. Mayhew said he thought they might have something by the end of August. Mr. Rossi said he would like to have all parties of the Committee, Squibnocket Farm, and VOLF in agreement of a plan prior to public comment.
Chilmark School Repairs Update:
Mr. Rossi said that the Chilmark School Repairs committee has received today the Plans for the repairs in hand. Mr. Doty said that they will distribute these plans to island contractors and seek 3 quotes and move forward on this project.
Mr. Rossi said that the patio was omitted from these plans but can be worked out.
Harbor Updates:
Mr. Doty said that the harbor list that the Selectmen drafted to be taken care of is being taken care of. Mr. Mayhew said that there is a sign stating Parking for Harbor and Shellfish Only that was posted up.
Harbor Continued…
Mr. Mayhew said he has an issue with the size of the sign, that it is very large. Mr. Doty said that the Selectmen would like the Park & Recreation Committee to review this sign and its size.
Chilmark Road Race:
Hannah Nichols the interim director of the Summer Program at the Community Center presented the Selectmen the annual road race plan and asked for their approval. Ms. Nichols said that they plan on running the same plan as last year. The date for the race is proposed for the Saturday August 10, 2013.
Chief Cioffi said that the race last year went fine and if that is the plan for this year he did not have any problems with race this year. Mr. Rossi moved to approve the Chilmark Road Race for August 10, 2013 with condition that the Police and Board of Health are in support of the set up and running of Road Race plan. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Police Chief Response to Creek Lots:
Chief Cioffi told the Selectmen that the department has been getting calls concerning trespassing on Creek Lot A. Chief Cioffi said that this is a civil litigation issue. Chief Cioffi said that Aquinnah police Chief Belain and he have discussed response to these complaints; both department chiefs agree they will not respond to the trespassing complaints until the court has determined ownership. Chief Cioffi said that his jurisdiction is within Chilmark land.
Mr. Doty said that the Selectmen of Aquinnah and Chilmark had a joint meeting on June 18, 2013. Mr. Doty said at this joint meeting the Selectmen agreed that Creek Lot A & F would me managed by Aquinnah and the Mayhew Lots (4 & 5) will be managed by Chilmark.
Mr. Doty said a concern that has been raised an should be addressed is the historic significance of the shack on Creek lot A. Mr. Doty recommended that both Aquinnah and Chilmark Historic Commissions address the historic importance of this historic fishing shack.
Chairman Doty asked if Mr. Madison had input for the discussion. Mr. Madison said he was present to represent his client Vernon Welch and he asked for the Selectmen to make determination about Lot A. Discussion ensued.
Chairman Doty said that no decision will be made tonight as this topic was not a posted agenda. Chief Cioffi has spoken tonight to let the selectmen know about this issue. Mr. Doty said that discussion is ok but prior to any decisions a proper posting will be made to be fair to all interested parties.
Public Record Request:
Fire Chief David Norton said that he has a public record request from Steve Gallas and a woman named Allison Conboy. Mr. Carroll said that it seams to be an issue about health insurance. Mr. Doty said that Selectmen will not take action but the Executive Secretary, Fire Chief and Human Resource board will be dealing with this public request of records.
Wareham Request:
Selectmen’s office has received a request in writing from the Wareham Selectmen to join them in supporting Affordable Housing legislation allowing mobile homes to be counted as affordable housing. Mr. Doty moved to not respond to this request. Mr. Mayhew seconded the motion.
SO VOTED: 3 Ayes
Dogs in Chilmark:
Mr. Doty said Selectmen’s office has received complaints about dogs being on beaches and in town not under control of their owners. Mrs. Maida said that Squibnocket beach has had dogs running around and their owners are not cleaning up after them. Mrs. Maida recommended having the Dog Officer visit Squibnocket a little after 5:00 PM.
Mr. Doty asked if the traffic officers could enforce dogs be on leashes in Menemsha. Chief Cioffi said not the traffic officers but a special officer could. Chief Cioffi recommended having the Dog Officer address the issues and possibly increase the Dog Officers hours.
Mr. Doty said that the Beach Department and Dog Officer need to be notified of the need to address the uncontrolled dog issue.
Police Department:
Chief Cioffi introduced two of the new officers to the Selectmen; Elizabeth Hourihan and Whitney Hyde. Chief Cioffi gave an update of the vehicle replacement process.
Mr. Doty said that the joint operations procedure with the Menemsha Coast Guard and Chilmark Police Department is printed here for Selectmen to approve and sign. Mr. Mayhew moved to approve and sign the memorandum of understanding between USCG and Police Department.
Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
Conservation Commission Appointments:
Mr. Doty moved to appoint Chris Murphy and Robert Hungerford full members and Thomas Bena an associate member on the Conservation Commission. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Solar Array Update:
Selectmen Doty asked Tim Carroll for his recommendation of either a 30B or a 25a Solar Project RFP. Mr. Carroll said that the 30B was a good choice. Mr. Carroll said that 30B does not guarantee returns %. Mr. Rossi moved to move ahead with project using the 30B RFP. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Clean Vessel Act:
Mr. Carroll said he has been notified by the State that the Town of Chilmark is being awarded up to $18,750.00 for the pump-out station in Menemsha. Mr. Doty asked that the pump be moved south of old unit so it is not in the entrance of Harbor Shack. Mr. Rossi said to make this placement of pump-out station work with (future) layout of new harbor shack.
Phase III Harbor Project:
Mr. Doty said that there are still two items to be completed in the Phase III project; the ADA hand rails on the ramp leading to the transient floating dock and the cement fill in the steel extensions to piles on the West Dock.
Mr. Doty said that they are holding back the final payment of $24,000.00 which exceeds the amount of work to be done. Mr. Carroll said that ASI (Atlantic Support Installation) is completing work in Oak Bluffs and will be coming back to Chilmark very soon to finish up.
Assessing Software:
Mr. Carroll said he has met with Assistant Assessor to work out what the specifics on new software will be. During these meetings Mr. Carroll said he found that the old software is still needed along with the new. This will increase Assessors expenses and it will bring cost over the budget this year, anywhere from $1,000.00 to $3,000.00.
Beach Department:
Mr. Doty said that Jennifer Fragosa sent a letter to the Selectmen’s office confirming Beach Superintendent Martina Mastromonaco’s completion and passing the Lifeguard certification process. Mr. Mayhew said that Mrs. Fragosa went above and beyond in writing the letter as the Red Cross certificate would come too late for this year’s appointment. Mr. Mayhew said he wanted a letter of thanks sent to Mrs. Fragosa.
Mr. Doty moved to appoint Martina Mastromonaco beach superintendent till June 30, 2014 as it is a yearly appointment. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Shellfish Oyster Grants:
Mr. Doty said that Shellfish Constable Isaiah Scheffer is posting a meeting for the entire Oyster Grant holders to be updated on the new rules and regulations from the DMF. Mr. Carroll said that he received from the DMF a permit for Vinny Iacono. Mr. Doty said that makes all of our grant sites permitted by the state now.
Police:
Chief Cioffi said that at the Selectmen’s Meeting May21, 2013 Mr. Fielder was appointed an officer. Chief Cioffi said Mr. Fielder will be a traffic officer this summer.
At 9:00 PM Mr. Rossi moved to adjourn. Mr. Mayhew seconded the motion.
