Chilmark Board of Selectmen     April 16, 2013    Meeting Minutes
At 6:30 PM Chairman Mayhew moved into Executive Session to discuss land acquisition with town counsel and to return to regular session at 7:00 PM. Mr. Mayhew: Aye, Mr. Doty: Aye, Mr. Rossi: Aye. Tim Carroll and Ron Rappaport also present.

At 7:05 PM Selectmen returned to regular session.
Present: Chairman Jonathan Mayhew, Bill Rossi, Warren Doty, Tim Carroll, Amy Tierney,
Dr. James Weiss, Mary Boyd, Robert Lionetti, Steve Bernier, Barbara Walsh, Gary Roy, Margaret Verrets, Jonathan Revere, Remy Tumin, Jim Hickey and  Dennis Jason (8:25pm arrival).

Chairman Mayhew called for a moment of silence in honor of the Boston Marathon bombing victims.

Minutes:
Draft minutes from March 26, 2013 were reviewed. Corrections were made to the draft minutes. Mr. Doty moved to approve minutes as corrected. Mr. Rossi seconded the motion.
SO VOTED: 3 Ayes

At 7:12 PM Chairman Mayhew opened Public Hearing for Proposition 2 ½ Override. There were no questions asked from the public about the override. Mr. Carroll said the FinCom recommended articles during the budget hearings.

Mr. Rossi reported on the plans for Chilmark school repairs. Mr. Rossi said the committee recommended addressing the drainage problem first.  

Mr. Doty moved to close public hearing, Mr. Rossi seconded the motion. SO VOTED: 3 Ayes
Public hearing closed at 7:25 pm

MV Regional High School Roof Repairs:
On April 2, 2013 Dr. Weiss notified the Selectmen in each town of the $2.6 million dollar loan needed to repair the MVRHS roof.  Ms. Tierney discussed the process. There was discussion of new maintenance plan for the roof.

Harbor:
Selectmen discussed memo received from Harbormaster on enforcement of regulations and fines. Mr. Doty thought this was a good letter. Mr. Rossi said the same. Mr. Jason was present to clarify his plans with the Selectmen. Mr. Rossi recommended handing the fines policy to the offending parties so that they are clear on our town policy.



Harbor Continued….
Menemsha Harbor Dock Notice 2013        
1. The dock area needs to be kept clean, and washed down at all times.
2. The number of bait barrels is limited to three barrels per boat and they must be placed so as not to impede public access to, or passage along the dock.
3. Bait barrels are to be covered and the exterior kept clean.
4. The dock area is to be kept clear. No gear is allowed to be left or stored on the dock. No gear is to be left or stored on the bulkhead in such a way that public access to the dock is impeded.
5. No petroleum or toxic/hazardous products are to be left or stored on the dock or bulkhead.
Fines and penalties to be imposed:
A verbal warning for failure to comply; a second warning would be in writing. Failure to comply after these two attempts would result in a $100.00 fine for a first offense and $250.00 each subsequent offense.   

Mr. Rossi moved to endorse this memo from the harbormaster. Mr. Doty seconded the motion. SO VOTED: 3 Ayes
 
Discussion turned to Emmett Carroll’s request to have his up Weller in his slip in Menemsha.
Mr. Doty said Alec Gale requested an updated permit for his mussel long line. Mr. Doty said that should be completed with Mr. Gale for this year.  

Selectmen decided to continue these topics at their May 7, 2013 selectmen’s meeting. The fee schedule for Harbor summer fees and next FY year fees as well. Mr. Doty asked that the schedule for harbor job positions be firmed up and position filled.
The plan for the harbor is as follows but will be clarified at the May 7, 2013 meeting.

1 Harbor Master (Dennis Jason)
2 Assistant Harbor Masters
2 Assistant Wharfingers.
12 hr daily 7am-7pm. 7days a week.
This schedule would have a mature responsible adult on duty at all times the harbor is open.

Annual Town Meeting:
Tim Carroll said that he has met with the Town Moderator and the Town Clerk and believes there will be an Australian ballot for the proposed bylaws at the ATM April 22, 2013. Mr. Carroll said that he has received an update from our Town Accountant concerning the certified free cash. Town Accountant Ms. Biskis believes there will be a reduction in our free cash figure as amended by the DOR.

Mr. Carroll said that the stabilization fund of $30,000 and the OPEB retirement fund of $50,000. is what he recommended to strike if need be. Mr. Carroll said these are two items that will need to be funded at the Special Town Meeting.




Squibnocket Committee Update:
Mr. Rossi reported that the committee’s plan is to determine the wetlands and the property lines first. The committee is looking at possibly leasing beach property and moving the parking lot back.   

Squibnocket Farms is working on their long term plans and a bridge is a possibility in their plans. At this time the committee has yet to see the Farm’s plans. Mr. Rossi said that Squibnocket is a town asset and we should look into keeping it as long as possible. Mr. Doty said he endorses that plan. Mr. Rossi said plan is to cleanup the parking lot for this coming season.

Harbor Continued:
Dennis Jason said he talked to Richard Steves just now and confirmed that he will work 6 days a week for 5 hours a day no more than the thirty hours. Mr. Doty and Bill Rossi said they could work with that.

Mr. Doty said that Harbormaster is on a shift for 30 to 32 hours per week with a day off each week. But will work when needed as Harbormaster.

County Budget:
Mr. Rossi discussed the County budget for the FY14. Mr. Rossi Recommended that Selectmen approve the contracts for Vineyard Health Care Access and Integrated Pest Management.
Mr. Rossi said that the County has reimbursed the town $23,742.60 (Chilmark’s portion)of the $150,000.00 they were overfunded. Doty moved to approve and sign the contracts for Vineyard Health Care Access and Integrated Pest Management. Mr. Rossi seconded the motion.
SO VOTED: 3 Ayes    

Chapter 70:
The town of Dudley has sent Chilmark Selectmen’s office a legislative proposal for Chilmark to support amending Chapter 70. Chapter 70 relates to forcing towns to increase school budgets. Discussion took place. No action was taken at this time.

The Vineyard”:
A production company has contacted the Selectmen’s office requesting permission to film in Menemsha. The dates requested are: May 11, 18, 23, & 30, 2013 June 5, 10, 18, & 24, 2013.
Mr. Doty said he doesn’t recommend 18th and 24 of June. Mr. Rossi moved to grant permission to the filming for May 11,18,23,30, and June 5, and 8th 2013. No filming after the 15th with standard conditions to apply. Mr. Doty seconded the motion. SO VOTED: 3 Ayes   

America Unearthed”:
History Chanel has contacted the Selectmen’s office requesting permission to film in Menemsha.
The filming is America Unearthed and they are hiring a local charter captain during their filming. The dates requested are May 2nd, and 3rd 2013. Mr. Doty moved to approve the request for permission to film for May 2nd and 3rd with standard conditions to apply. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes



Beach Department:
Selectmen asked Mr. Carroll to work on a letter with town counsel Mr. Rappaport. The letter is to be addressed to Beach Superintendant reminding her she has job responsibilities until June 30, 2013 (unless she chooses to resign) and to be lifeguard certified for the coming season. Mr. Doty moved to have Mr. Carroll send letter to Beach Superintendent. Mr. Rossi seconded the motion. SO VOTED: 3 Ayes  

Bulkhead Lot Leases & Creek Lot Leases:
Mr. Carroll said processed leases are ready for Selectmen’s signatures.
Mr. Doty moved to adjourn and sign Leases. Mr. Rossi seconded the motion.
SO VOTED: 3 Ayes
