Selectmen's Meeting Minutes 04/19/11
Town of Chilmark    Board of Selectmen    April 19, 2011    Meeting Minutes

Present: Warren Doty, Jonathan Mayhew, Frank Fenner, Tim Carroll, Jonathan Revere,

Chairman Doty called meeting to order at 7:30 pm in the Selectmen’s meeting room.

Minutes:
April 5, 2011 minutes were reviewed. Amendments were made. Mr. Fenner moved to approve minutes as amended. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes

Public Hearings:
At 7:35 pm chairman Doty opened public hearing about application for Common Victualler application from Joel Glickman and Jennifer Lo Russo. Ms. Lo Russo and Mr. Glickman are the new operators of the Chilmark Store. Jennifer Lo Russo addressed the selectmen asking for approval of their application for the Common Victualler license. Ms. Lo Russo said the hours of operation will be 7:00 am to 7:00 pm and open 7 days a week. If approved they hope to open May 10th and remain open till Columbus Day weekend.

7:38 pm hearing was closed. Mr. Fenner moved to approve Common Victualler license.
Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes

7:40 pm chairman Doty opened public hearing about shellfish regulations. Dennis Jason asked where the draft shellfish regulations were posted. Mr. Carroll said they are located at the reception desk, and the clerk’s office in the town hall. Mr. Carroll said this was advertised in the news paper. Mr. Jason said he had not had a chance to see them. Mr. Doty said that the selectmen will leave the hearing open for another 30 days till May 17th to receive more public input. A copy of this draft shellfish regulation will also be available at Menemsha Texaco.

Selectmen reviewed the draft shellfish regulation and have recommended changes and clarifications they would like to make.

Pg. 2 section b) i) A RESIDENT FAMILY SHELLFISH LICENSE  Family permit holder is not allowed to sell their take, it is meant for their own consumption.

Review of Shellfish Regulations continued from Pg1:
Pg. 4 section 22. Scuba diving Mr. Mayhew suggested no diving for shellfish, instead of no commercial diving of any type.

Pg. 6 Quahogs section 36. b.) the daily limit for the taking of quahogs within the waters of Chilmark shall be set by the Chilmark Selectmen prior to opening the season annually or at any time during the season the Chilmark Selectmen may vote to change the limit.

Pg. 6 Quahogs section 39. The maximum length of a boat used for power dredging shall be thirty (30) feet at the waterline.  Mr. Mayhew recommended maybe more than twenty five (25) bushels outside of the ponds. Hydraulic power dredging allowed in Great Pond, with manual dredging for Quitsa, Menemsha and Stonewall ponds.

Pg. 7 Mussels section 54. b.) the daily limit for the taking of mussels within the waters of Chilmark shall be set by the Chilmark Selectmen prior to opening the season annually or at any time during the season the Chilmark Selectmen may vote to change the limit.

These changes will be sent to shellfish constable Scheffer, and the shellfish advisory committee
Police Department:
Chief Cioffi asked for the selectmen to approve the hire of summer patrolman Andrew Gibbons.
Mr. Fenner moved to approve the hire of Mr. Gibbons. Mr. Mayhew seconded the motion.
SO VOTED: 3 Ayes    
Chief Cioffi said that April 30 is narcotics give back day. Anyone interested can bring unwanted medications for disposal.

Middle Line Road Housing Development:
Selectmen received rental management proposal for the Middle Line Road rental duplexes from David Vigneault.

Dukes County Regional Housing Authority executive director David Vigneault started by thanking Chuck Hodgkinson for all of his hard work on this project and also thanks to Todd Christy for his efforts.  

Mr. Vigneault clarified that local preference will be included in the written policy. Mr. Doty said preference will also be given to volunteer and tri town ambulance employees, Fire department and school employees.

Mr. Feiner listed the guidelines that the housing committee has recommended. There will be no satellite dish attachments to exterior of buildings without written permission. Mr. Feiner said it is the intention of the housing committee not to use CPC funds to subsidize these rental units.

Conversation turned to the rent schedule. The rent will be a sliding scale from 65%-100% income strata. For instance the 1 bed room ranges from $726-$1,179.
Mr. Vigneault said that the pet policy is one pet allowed with a standard pet fee of $250.

MLR continued from Pg.2:
Mr. Fenner asked that the managing fee be negotiated down from 17%. Mr. Vigneault said they are willing to negotiate. Mr. Vigneault stated the DCHA would like this contract as managers of the MLR rental duplexes.

Assessors Department:
Pam Bunker as Assistant Assessor asks that the selectmen approve and sign the reevaluation contract. Mr. Fenner moved to approve contract for J. F. Ryan Associates to re evaluate. Mr. Mayhew seconded the motion.
SO VOTED: 3 Ayes Selectmen signed contract

Slossberg Closing:
Mr. Doty stated that the board of selectmen originally approved a mortgage amount of $200,000.
for the affordable housing lot at MLR to Ms. Slossberg. Ms. Slossberg applied for a mortgage of $220,000. This increase is permissible in her qualifications. Mr. Fenner moved to approve the increase to $220,000.00. Mr. Mayhew seconded the motion.  SO VOTED: 3 Ayes

Harbor Master Position Description:
Mr. Fenner said that at the last Personnel Board meeting he attended they asked that the USCG 25 ton license be put back in as a requirement for position. During the lengthy discussion that followed it was discussed that the USCG does not issue 25 ton licenses anymore. Mr. Doty asked that information be collected about the USCG licenses. No action was taken by the selectmen more information will be required.

Bid Award for Police Cruiser:
The Selectmen’s office received sealed bids for the retired 1998 police cruiser. The highest bid was from Jaron Chaplin for $750.00. The Town has received payment and the vehicle has been delivered to Mr. Chaplin. Mr. Fenner moved to award bid to Mr. Chaplin. Mr.Mayhew seconded the motion. SO VOTED: 2 Ayes, 1 Abstain (Mr. Doty had made a bid on this police cruiser)

Annual Town Meeting:
The towns’ counsel recommends having an amendment to change language in the personnel bylaw back to the way it was originally written. The section in the bylaw is 1.3, the appointing authority.  Mr. Fenner said he would move to make the amendment at ATM. Mr. Mayhew said he would second it.

Storm Damage Report:
Very heavy rain damage incurred throughout Chilmark on April 13, 2011 has been assessed and repairs are being made. Mr. Carroll presented the selectmen with an estimate to cover immediate repairs. The total of assessment is estimated to cost $25,000.00.
Mr. Doty recommended seeking FinCom reserve fund transfer sooner than June. Mr. Carroll will organize a meeting with FinCom Committee.

Planning Board Swimming Pool Bylaw:
Selectmen reviewed hand out that the Planning board will supply for the Town Meeting.  The red type explains the bylaws and clarifies the black type. The black type is the actual bylaw.

Mr. Doty made a motion to move to executive session, to discuss labor agreement and not return to regular session. Mr. Mayhew seconded the motion.
