Town of Chilmark Board of Selectmen March 15, 2011 Meeting Minutes Present: Warren Doty, Jonathan Mayhew, Frank Fenner, Jonathan Revere, Tim Carroll, Chuck Hodgkinson, Jane Greene, Isaiah Scheffer, Wayne Iacono, Bob Sloane, Brian Cioffi, Jim Hickey, Max McCreery, David Norton Chairman Doty called meeting to order at 7:30 pm in the Selectmen’s meeting room.Minutes: Minutes from March 1, 2011 reviewed and 2 amendments made. Mr. Fenner moved to approve minutes with the amendments. Mr. Mayhew seconded the motion.
SO VOTED: 3 AyesHarbor, Concrete Floats:Selectmen invited commercial lobstermen to hear their concerns of bait barrel weight overloading the new floating docks. Bob Sloan who is one of the lobstermen voiced his needs and agreed to move some of his bait barrels to the west dock landing. This solution will be changed if needed. Selectmen asked Mr. Sloan to meet with engineer Kent Healy at their regular scheduled meeting at the west dock Thursday morning at 8:00 am. Mr. Mayhew said to limit storage of bait barrels to one deep. Mr. Fenner moved to allow 4 bait barrels on the floating dock (per slip) and 6 up in the parking lot. Mr. Mayhew seconded the motion. SO VOTED: 3 AyesShellfish Department:Chilmark’s shellfish constable Isaiah Scheffer presented the selectmen with his annual propagation
report. Selectmen commended Mr. Scheffer started with the Bay scallop: The department has been encouraging spawning sanctuaries to enhance population growth. There is an estimation of 1,000,000.00 seed.
The oyster enhancement is hatchery spawned. Tisbury Great Pond has almost 700 bags and in each bag is estimated to have 200-250 oyster juveniles.
Quahog enhancement is also hatchery spawned approximately 1,000,000.00 seed in rafts till they grow to 15mm.
Predators: the green crab eradication program is ongoing, there are 200 pots, and they caught 40,000.00. The Eider duck has become a very formative enemy this past year. They are attempting methods of eradication.
All are invited to attend Mr. Scheffer’s presentation on the shellfish propagation being held at the Chilmark Library May 18 at 5:30 pm.Mr. Scheffer asked for permission to advertise this week for an assistant shellfish constable. The selectmen approved to advertise.
Harbor Master Dennis Jason arrives 8:05pmMr. Jason said he is concerned that the weight from the 8 barrels (approximately 3200 lbs) will put a wrack on the dock causing the warranty to be void. The lobster pots being dragged across the wire conduit is another concern. Mr. Jason said that the docks must be clear within 3 days of unloading gear. Selectmen all agreed that keeping clear access to area is important.
Middle Line Road Affordable Housing Project:Chuck Hodgkinson said that with rental duplexes being finished mid summer we need to start the process of tenant applications. Mr. Hodgkinson has been working with the Dukes County Regional Housing Authority in getting information on income level qualifications. The information that Mr. Hodgkinson has gathered from all of the affordable housing developments should help with setting our qualifications.Mr. Hodgkinson said that Seaver Construction has replaced the manager of the MLR construction project. The new management is to address the concerns that the town has concerning the framing and trim and have project back on track for completion by mid summer.The fire suppression tank will be installed soon and the cost will be distributed to the entire MLR neighborhood.Fire Chief Salary:The personnel board has completed the evaluation and review of job description for the fire chief position. Mr. Norton has requested a salary of $33,000.After
lengthy discussion Mr. Doty moved a $ 6,000.00 increase to Mr. Norton's stipend, bringing total to $27,000.00. Mr. Mayhew seconded the motion. SO VOTED: 3 AyesHealth insurance, inspection fees and .50 per mile (National rate) for vehicle compensation will remain the same.Chilmark Community Center:The New England Aquarium requested to hold a volunteer training day for marine rescue on Saturday June 4th. Mr. Fenner moved to approve of the volunteer training day at the CCC. Mr. Mayhew seconded the motion. SO VOTED 3 AyesLand Bank walking trail:MV Land bank has asked to build a walking trail on the MLR property, along the landfill sight. Mr. Carroll recommended that the trail be reconfigured in the future if needed. Mr. Mayhew agreed. Mr. Fenner moved to allow trail with a pending change of use. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Planning Board:Planning board has a final draft of the pool bylaw. the selectmen approve the draft for approval at the town meeting. Mr. Fenner moved to place the pool bylaw from the planning board on the town warrant. Mr.Mayhew seconded the motion. SO VOTED: 3 AyesAnnual Town Meeting Warrant:Corrections and final draft of warrant for the Annual Town Meeting were completed for 36 of the 37 articles. All of the money articles are ones the Selectmen and Finance Committee have already agreed on. The wording and order of the articles has been improved and Selectmen said they are ready to approve them for ATM. Article 37 is the Personnel Board: Personnel Bylaw Article.Page 8 of 21 in the Personnel Bylaw, Mr. Fenner moved that the Board of Selectmen of Chilmark as the appointing authority for all town
employees. Mr. Mayhew seconded the motion. SO VOTED: 3 AyesMr. Carroll said that the Board of Assessors clearly has a law in the books stating that if there is an Assistant Assessor that position is appointed by the Assessors. This could change if the position was an Administrative Assistant to the Board of Assessors that position would be appointed by the selectmen.Mr. Fenner said his concerns are that with the power of appointing comes the responsibility of termination if warranted and liability to the town becomes a possibility if there are a number of different appointing parties who might act differently. Mr. Mayhew agreed.Mr.Fenner said the Selectmen intend to continue the standard practice of collaboration for hiring employees. Mr. Carroll said that the section in yellow in the by law, are the changes proposed by the HRBC / Human Resource Board of Chilmark aka Personnel Board. The sections in red are his additions that he would like to have made that were agreed upon
but not written. Selectmen decided to leave the by law the way it is.Mr. Fenner moved to approve article 37 for ATM. Mr.Mayhew seconded the motion. SO VOTED: 3 AyesMr.Fenner moved to approve the Annual Town Warrant. Mr.Mayhew seconded the motion. SO VOTED: 3 AyesPier Connector Project Up Date:The construction is on track, even with the weather delays.Grant from the Sea Port Advisory Council is moving forward. The next meeting for another grant is coming up and Selectmen Doty advised to call Tim Madden and Nell Coogan as well as our contacts with the grant organization.

Railing for the West Dock was re-designed by Kent Healy to have wooden hand rails instead of the steel piping with mesh. Mr. Doty said he met with the building inspector and it was decided that the dock does not fall into the law of having to have chain mesh at the railing. So Selectmen will add rails instead of mesh if the budget allows. Mr. Doty asked to review engineer / surveying expected costs, to keep in budget. Mr. Mayhew moved to pursue wooden railings as per discussed. Mr. Fenner seconded the motion. SO VOTED: 3 AyesThe utilities are another part of project to get an estimate from. Mr. Carroll thought it would be approximately $80,000.00 for electrical portion of project.
Annual Nomination of Animal Inspectors:Mr. Fenner moved to nominate Christopher Murphy and Joan Jenkinson. Mr. Mayhew seconded the motion. SO VOTED: 3 AyesMLR lot 35 Usage:Mr. Doty would like to see a plan formulated for this property. Mr. Mayhew said he would like to see it left alone. Mr. Fenner moved to walk this property and formulate a plan. Tri-Town Ambulance:The Tri- Town Ambulance is asking Selectmen to appoint administrative assistant Barbara Silk with a permanent appointment. Mr. Fenner moved to approve a permanent appointment of Ms. Silk. Mr. Mayhew seconded the motion. SO VOTED: 3 AyesApproval of Mortgages:Middle Line Road affordable Lots for Wlodyka and Slosberg are ready for mortgage approval. Mr. Fenner moved to approve. Mr. Mayhew seconded the motion. SO
VOTED: 3 AyesPolice Chief Contract:Mr. Doty said that the contract for the police chief is ready for signing. Mr. Fenner moved to approve and sign contract. Mr. Mayhew seconded the motion.
SO VOTED: 3 AyesPolice department would like the Selectmen to decommission the 1998 cruiser. Mr. Fenner moved to declare the 1998 police cruiser surplus. Mr. Mayhew seconded the motion.
