Town of Chilmark Board of Selectmen March 1, 2011 Meeting Minutes
Chairman Warren Doty called meeting to order at 7:30 pm. in the Selectmen’s meeting room.
Present: Warren Doty, Jonathan Mayhew, Frank Fenner, Tim Carroll, Jonathan Revere, Remy Tumin, Jim Hickey, Brian Cioffi.
Minutes: February 15, 2011 minutes; Mr. Doty amended the sentence about the harbor to clarify that Art Nelson is our computer program consultant. Mr. Fenner moved to approve minutes with amendment. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Menemsha Pier Connector Project:
Selectmen discussed a payment requisition from C. White Marine. Clerk of the works Kent Healy reviewed the materials listed on the payment requisition and recommended contacting C. White Marine because the materials listed are not on the sight yet. Mr. Doty recommended authorizing up to $397,577.18. to receive the prompt payment discount.
Mr. Carroll said that the Selectmen’s office has made contact with C. White Marine and will have clarification on the matter soon. Mr. Fenner moved to approve payment up to $397,577.18.
Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Railing System for the Pier:
Mr. Doty would like to have the material for the railing system made from wood instead of the plans specifications which is pipe. Mr. Fenner said that it might be too late to make this change.
Mr. Mayhew asked to price out the cost of pressure treated wood rail system as well as plastic composite cap rail. Selectmen decided to meet at 9:00 am Monday at the Chilmark Town Hall to decide on the estimates.
Sea Port advisory Council:
Mr. Doty said that he and Tim Carroll have been in touch with Nell Coogan and Tim Madden to move forward in our request for more grant funds to apply to the pier connector project. The next meeting of the Sea Port Advisory Council is April 7, 2011. Mr. Carroll sail that we need to attend the Port Professionals’ Meeting first. Mr. Carroll will find out when this is and try to be on their agenda.
USCG Claim:
Mr. Carroll has filed a claim of loss to the USCG this claim has been sent on down to Virginia.
Mr. Doty would like to contact the Congressmen and inform them we have filed this claim. Mr. Carroll will make contact on this matter.
Chilmark Community Center Water System:
Selectmen reviewed the action plan that the Chilmark Board of Health has sent to the State. Selectmen will move forward in pursuing the water safety plan.
Annual Town Meeting article updated list:
Mr. Carroll supplied the Selectmen packets to review of articles. Selectmen will make final decision on articles at their March 15 meeting.
Mr. Doty moved to withdraw article 34 which would post a pro and con for articles. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Mr. Mayhew moved to approve the articles in concept. The Selectmen will review personnel bylaw with Councilman Jack Collins and comeback to finalize decisions on March 15, 2011. Mr. Fenner seconded the motion. SO VOTED: 3 Ayes
DAS:
American Tower has provided a draft letter to send to NSTAR to ask for their cooperation in the Distributed Antennae System in the town of Chilmark.
Mr. Fenner moved to support the letter. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Town Hall Office Configuration:
Virginia Jones has asked to move the Harbor Department to down stairs where the Conservation officer desk was. Shellfish constable is fine to move upstairs. The Selectmen think this is fine.
Tri Town Ambulance Lawsuit Update:
Mr. Carroll reported that the Insurance companies have opted to settle with the family that filed a wrongful death suit. This will increase our premiums.
Menemsha USCG Boathouse Fire Update:
Insurance investigator will be coming to view boat losses March 8, 2011.
Shellfish Department:
Shellfish department asks Selectmen for permission to advertise and post for a assistant shellfish constable. The position will be part time with a grade of 6, step of 1. Mr. Fenner moved to approve advertising for this position. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Town Clerk:
Town Clerk Jennifer Christy asks for the Selectmen to approve the postings on our web page as our alternate posting site. Mr. Fenner moved to accept this as our alternate posting site and do away with outside book. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Town Clerk also asked selectmen to approve our single precinct facility for town elections be the Chilmark Community Center. Mr. Fenner moved to approve Mrs. Christy’s request. Mr. Mayhew seconded the motion. SO VOTED: 3 Ayes
Menemsha Harbor:
Selectmen ask that Mr. Carroll to invite boat owners, and Park and Rec. to attend next BOS meeting 3/15/11 to prepare Menemsha harbor for the coming season.
Chairman Doty said executive session will begin concerning labor negotiations and pending lawsuit. Not to return to regular session. Fenner: Aye, Mayhew: Aye, Doty: Aye. 8:50 pm
