6. DEPARTMENT REQUESTS:

Conservation Commission - legal bill   MGL Ch.131 sec. 40
  The Wetlands Protection Fund Expenditures are restricted to those related to the administration and enforcement of the WetlandsProtection Act.  Including budget offset, salaries, consultants. "Examples of expenditures that could not be charged to the revolving fund are attorney's fees for drafting conservation by-laws, the conservation commission's membership dues to a statewide organization, subscriptions, conferences and other general travel expenses. These expenditures are not directly related to the administration or enforcement of the Wetlands Protection Act, but rather relate to the operation of the conservation commission generally."  Until 2011 USE OF THIS FUND HAS REDUCED THE TAX BURDEN.  

MGL Ch.44 sec. 53G  Special Revolving Funds For Hiring Outside Consultants - conservation
commissions that impose fees on applicants for permits or approvals for the purpose of hiring expert consultants to assist in reviewing the applications may now deposit those fees into a special project account and spend them without appropriation to pay the consultants.   THIS IS A DIRECT USER FEE WITH NO TAX PAYER IMPACT
