Meeting called to order at 9:17 AM:

  • Biennial Review of Residential Building Size Zoning Bylaw Amendment (voted at ATM 2013):
  • The Board discussed the date of the joint meeting of the Planning Board and the ZBA: Wednesday, May 27, 2015 at 5PM.
  • Ms. Weidner asked Ms. Christy to send a reminder email to all Board members about May 27th.
  • Ms. Malkin asked Ms. Christy to provide Chuck with the tape recorder for May 27th.
  • Ms. Malkin, reviewing the document provided by Mr. Greenbaum titled Residential Size Bylaw Impacts (March 9, 2015) and Comparison of Size of New Houses Before vs. After New House Size Bylaw (3/23/15), asked that the date upon which the amendment became effective should be placed at the top of the documents (voted at ATM 4/22/2013).
  • Mr. Greenbaum agreed to walk the ZBA through the two documents on May 27th.
  • Ms. Weidner stated a written report should be provided to the BOS regarding the joint meeting and the results. This would be in preparation for a presentation of the review at a fall special town meeting.
  • Ms. Malkin noted it would be helpful to provide conclusions on the documents. Ms. Weidner agreed and noted one conclusion is that the amendment has not resulted in an appreciable increase of special permit applications. Another possible conclusion noted was that total square footage of new construction and additions has gone down, even though the number of structures went up.
  • Mr. Hodgkinson gave feedback on the special permit applications from the perspective of the ZBA.
  • Mr. Hodgkinson stated a major problem with applying the criteria (section F of the Section 6.11 of the amendment) had to do with number 10, “minimizing fossil fuel use.”
  • Mr. Hodgkinson stated that number 10 is not clear, to the Board members, as to how it is to be implemented.
  • Mr. Greenbaum noted that West Tisbury has adopted the “stretch” energy code and stated that code may be something the Board would like to consider reviewing for the use of criteria.
  • Mr. Hodgkinson suggested some changes to the criteria and discussion occurred regarding the applicability of the criteria.
  • Ms. Malkin noted that after the meeting on the 27th, the Planning Board will create a report, possibly develop amendments to the bylaw and revisit the ZBA to see if the proposed changes would satisfy their issues with the criteria.
  • Ms. Weidner asked Mr. Greenbaum to update his March 9, 2015 document with the most recent information. Mr. Greenbaum stated he would also check his documents to confirm the information is correct for the ZBA meeting on the 27th and that the information on the March 9, 2015 document concurs with the March 23, 2015 document.
  • Ms. Malkin asked, in the course of a year, how many hearings for special permits are conducted in a 2014, what is a typical length of time that a hearing lasts (hours) and how many separate hearings is typical for a special permit (one night, two…) Ms. Malkin asked Ms. Christy to ask Chuck to find this information.
  • Ms. Weidner asked Mr. Greenbaum to send the updated documents to Ms. Weidner and Ms. Malkin before Monday and then Mr. Greenbaum will send the updated documents to Dilly in order to print in color in preparation for Wednesday, May 27th 5PM meeting with the ZBA.
