July 28, 2014

Meeting called to order at 3:08PM:

  • Historical Building Draft Bylaw Amendment:
  • Pam distributed a copy of the latest Historic Houses draft bylaw amendment with the addition, at the suggestion of Chuck Hodgkinson, of where to find the definition of ‘total living area.’
  • Joan suggested the amendment be re-titled to, “Amendment to Article 6, 6.11 Residential Building Size Regulations, B. 3, d.” before the draft bylaw is distributed further.
  • Discussion continued. Pam suggested a sentence of intent at the beginning of the amendment. It was suggested the amendment begin, “This section is intended to encourage the preservation of historic houses.” Joan, Jessica and Chuck suggested revisions to the amendment draft. Discussion occurred regarding when an applicant would need to apply for a special permit. Joan stated she would draft the next draft of the amendment and then send it to Pam for further revision, and possible simplification of language.
  • Accessory Apartment Bylaw Draft Amendment:
  • Committee members reviewed the draft #10 bylaw amendment presented by Jessica.
  • Discussion occurred regarding the changes.
  • The Board of Health is meeting to review the amendment and make comment. The report from the BOH will be available at the August 11 meeting.
  • Discussion occurred about seasonal owners building an accessory apartment for a person(s) who is a year-round resident. It was noted that the amendment should make clear that the owner of the lot and main house does not need to live here year-round, and still be allowed to build an accessory apartment.
  • David noted that there may be unintended consequences of the multiple scenarios that could be permitted. He suggested regular review of the amendment in order to respond to problems that arise. He noted that the DCRHA clearly emphasizes to the lot owner, in the case of accessory apartments, that they are the landlords and they inform them of their responsibilities.
  • Joan & Jessica discussed the addition of a “sunset clause” that would eliminate the amendment after a period of time. Dan discussed excluding the accessory apartment living area from the total limit. Joan noted the need to state in the amendment the identity of the enforcer.
  • Noise Bylaw Amendment Discussion:
  • Discussion occurred regarding the correspondence that was sent during the time period between last meeting and this meeting.
  • Joan suggested waiting to see whether the amplified music problem is solved this fall before forging ahead with an amendment to the town bylaws regarding amplification. Joan noted the need for more research on the issue before the Planning Board could begin to draft an amendment to the bylaws. Dan suggested decibel level monitoring would need to be done.
  • The subcommittee suggested waiting until September to see if there is still a problem. Joan suggested the Armstrongs attempt to measure the amplified sound.
  • Joan recommended the Planning Board request that Jennifer please communicate with the Armstrongs that the Planning Board considered the issue of amplified music and recommended waiting to see how the fall proceeds with the mitigation plan put in place by the Beach Plum Inn. She also recommended asking the Armstrongs to attempt to measure the sound.
  • Minutes: July 14, 2014 minutes were reviewed. The minutes were approved as written.
