Chilmark Planning Board Subcommittee Meeting
July 14, 2014

Meeting called to order at 3:00PM:

  • Accessory Apartment Bylaw Draft:
  • Committee members reviewed the draft #9 bylaw presented by Ms. Roddy.
  • The subcommittee also reviewed the draft #8. Ms. Roddy led the subcommittee through the changes that were made to draft #8 to produce draft #9.
  • It was noted that a change should be made to the section to say in “a” cases, in “b” cases and in “all” cases.
  • A change was suggested to rephrase the portion of the draft bylaw to indicate that costs are more general.
  • Ms. Weidner suggested the elimination of #3. Discussion occurred about the incentive to voters to pass this bylaw. She further suggested combining #1 and #3. Ms. Roddy agreed and suggested that she add an addendum afterwards noting the benefit to homeowners of extra rental income.
  • Ms. Weidner suggested the need to retitle the draft bylaw. Ms. Roddy suggested, “Exception for Affordable Rental Housing on Privately-Owned Land.”
  • Discussion occurred regarding the possibility that an accessory apartment be grandfathered so that if you did rent the apartment for an affordable amount for 10 years then the structure may remain as living area but it does not have to be an accessory apartment. It was suggested that an amendment be ready to submit at town meeting.
  • Mr. Greenbaum inquired whether sales of lots with accessory apartments would be depressed due to this bylaw.
  • Historical Building Draft Bylaw:
  • Ms.Weidner presented the draft bylaw.
  • Ms. Wetmore inquired about tax consequences for retaining a historic structure. She noted the need to meet with the Historical Committee members to discuss more.
  • Ms. Wetmore stated she would share the bylaw draft with the Historical Committee on July 15 and invite the other members to the next meeting of the subcommittee or have them submit comment to Jennifer Christy prior to the meeting.
  • Minutes: June 23, 2014 minutes were reviewed. Motion was made to accept the minutes with no changes. The motion was seconded. All ayes.
  • Residential Bylaw Biennial Review Discussion:
  • Discussion occurred regarding the procedure for this review process.
  • Ms. Weidner suggested the Planning Board determine when and how the process will proceed. It was suggested the Planning Board have the topic on upcoming agendas so that the process may be planned and occur.
  • Next Meetings: July 28 & August 11, 2014, 3PM
