Subcommittee Meeting

Meeting called to order at 11:00AM
- Chair Janet Weidner opened the meeting, summarized the work of the subcommittee on February 4th and outlined the plan for this meeting.
- Discussion occurred about the new draft of proposed ZBL amendments dated 2-5-2014.
- It was discussed whether the addition of ‘parking areas (or lots)’ should be added to this preliminary paragraph (before the special permit criteria.)
- Discussion occurred regarding the changes proposed to Article 11, section 11.6 A. 2. B. on the 2-5-2014 draft. The subcommittee chose to recommend the first of the two proposed amendments.
- Discussion occurred about proposed changes to Article 11.6, A. 2. c.4. A change was proposed at the end of the paragraph to add in the following sentence: “…and any project for which a special permit under Article 12 section 12.4 B2 has been granted.”
- Discussion occurred about whether the Site Review Committee would be the appropriate entity before which a project would be reviewed and not the Zoning Board of Appeals (ZBA.) Ms. Rehrauer referenced Article 12, Section 12.6, A. Chair Weidner noted her preference to develop a special permit process rather than relying on a process involving the Site Review Committee. There was general consensus among the subcommittee members that a special permit mechanism would be preferable.
- Discussion regarding Article 12, Section 12.4, B. Zone B1 Special permit criteria:
- It was proposed to take out a.) & c.)
- It was asked whether the ZBA could condition the special permit in order to require the removal of the road and other parts of the site, in the event that the roadway/bridge were destroyed or abandoned. It was noted that the section of the ZBLs, 4.2 B Non Accessory Uses, 6. K., provides a model to allow for the owner to be responsible for restoration and to show financial viability to follow through on the project and maintain it.
- d.) was simplified.
- The subcommittee decided f.) is encompassed by e.). Further discussion occurred regarding alternative solutions. Ms. Rehrauer noted that it would be very difficult to give definitive performance appraisals of the alternative solutions, compared with the proposed project, that would lead to the creation of a clear evaluation of the best course of action.
- Chair Weidner noted that it may not be possible for the ZBA to evaluate other alternative solutions in the consideration of a special permit for a particular project. Discussion continued about whether it would be appropriate for the ZBA to evaluate merits of other projects in the midst of evaluating a project that is before the Board seeking a special permit. It was agreed by the subcommittee to ‘bracket’ e.) & f.) and not make a decision on whether to recommend the particular criteria yet.
- Discussion occurred regarding g.), h.), i.), i.-viii. Discussion occurred about the relevance to including criteria in Article 6 (viii). It was agreed to eliminate vi and viii.
- It was agreed that j.) may be eliminated. The final sentence of the draft was discussed and amended to say, “except section” instead of “provided that”. Further discussion concerned roads in the Shore Zone.
- It was noted by Chair Weidner that the section in the ZBLs, USES ALLOWED BY SPECIAL PERMIT, Section 12.4, C., is supposed to reference Zone B1, not B2. Ms. Malkin agreed to add this to the proposed amendments.
- January 16 & 27 Minutes were reviewed and approved as written. February 4 minutes were reviewed, amendments were made and approved.
