Subcommittee Meeting
February 4, 2014

Meeting called to order at 9:00AM
  • Proposed Zoning Bylaws:
  • Chair Janet Weidner opened the meeting, summarized the task of the subcommittee, currently, and outlined the plan for the meeting.
  • Discussion occurred about the proposed ZBL amendments that would affect the Squibnocket Beach, Parking & Roadway project currently being proposed.
  • Chair Weidner noted the main concern of the Planning Board is the avoidance of amendments to the ZBLs that would effect unintended consequences.
  • Chair Weidner noted the direction of the subcommittee is to propose amendments to Article 12 and to explore the idea of requiring a special permit .
  • Chair Weidner noted the most recent amendments the subcommittee has recommended is still summarized in the January 16, 2014 document written for the subcommittee by Ms. Malkin.
  • Extended discussion occurred between Ms. Rehrauer and the subcommittee, with periodic input from other members of the audience, about the merits of the proposed ZBL amendments as Ropes & Gray has put forward and the merits of the ZBL amendments that the subcommittee has drafted.
  • Special permit guidelines and definitions were discussed. In particular, the definition of ‘municipal use’.
  • The definition of ‘municipal’ was considered.
  • The concept of design review was considered.
  • Ms. Rehrauer noted that the Squibnocket project would be referred to the MVC and the town would be voting, at the Annual Town Meeting in April, on the lease, but not the project as proposed
  • Continued discussion occurred about the special permit guideline topics that were suggested by Ms. Weldon at the last meeting, on January 27, 2014: abutter and others’ opinions re view shed, materials for built portions, noise effects, need.
  • Ms. Weldon noted the need to avoid unintended consequences by making guidelines that possibly follow the example of the amendments to the ZBLs when the DAS was proposed.
  • Discussion occurred regarding Mr. Greenbaum’s suggested criteria for a special permit, submitted after the last meeting on January 27, 2014.
  • The concept of appropriateness of size for the proposed parking lot was considered. Ms. Weldon noted the need for the designers to make clear, in the Squibnocket project, a consideration of the problems associated with a full parking lot at the height of summer and possible waiting cars.
  • The appropriateness of materials usage was addressed.
  • Height of any objects in the roadways was discussed.
  • Storage of boats was discussed and thought was given to whether this would be regulated by the special permit, the town or the lease agreement. The discussion merged into discussion about overnight parking. It was discussed whether the Park & Recreation Committee would be the entity that proposes regulations for the activities at the beach/beach parking. It was discussed that the Board of Selectmen would be able to discuss and decide about beach parking and storage issues when they arose.
  • Minimization of roadway/viaduct length was discussed. Discussion occurred about how to limit length and how to determine the sustainability or viability of the roadway for the long-term.
  • Ms. Malkin inquired whether the guidelines/criteria for a special permit should address alternative locations.
