Meeting called to order at 10:07AM
  • General Discussion & Schedule Planning
  • Ms. Weidner stated she would act as the Chair of the subcommittee until she hears from the new Chair of the Planning Board, Richard Osnoss.
  • Ms. Malkin, Mr. Greenbaum & Ms. Weidner agreed to spend the first part of the meeting planning the next coming weeks of tasks:
  • Ms. Weidner inquired of Ms. Malkin of the progress on her review of the Residential Bylaw permanent file.
  • Ms. Malkin asked Ms. Christy to go back to the minutes to see what Ms. Malkin was tasked to do related to the permanent file. Ms. Christy agreed to review the minutes to find the permanent file information.
  • Ms. Malkin summarized the last meeting of the subcommittee which was jointly held with the Housing Committee & the Building Inspector, on November 25, 2013.
  • Ms. Malkin noted the subcommittee and Planning Board need to engage in more research of the bylaws and need to pinpoint the main changes to be proposed.
  • Review of the Notes from the Nov. 25, 2013 Joint Meeting:
  • The subcommittee reviewed the notes.
Discussion occurred.
The subcommittee discussed at length a change in bylaws that would allow “caregiver”, accessory apartments in main dwellings, attached to main dwellings, or detached. Questions were asked: “What does Chilmark think about duplexes?”, “How would the existence, or even proliferation, of duplexes possibly change Chilmark?”
Ms. Weidner reviewed the two-family dwelling bylaw definition, 2.15.
Ms. Malkin proposed drafting a bylaw that would address the accessory apartment issue.
  • Ms. Weidner asked Ms. Christy to find and send to the subcommittee the Edgartown ZBLs that address the accessory/caregiver regulations.
  • Squibnocket Parking & Beach Plan Discussion:
  • Discussion occurred about the possible ZBLs changes being considered to allow the Squibnocket plan to go forward.
  • Mr. Hodgkinson appeared before the subcommittee and discussed the possibilities.
  • Mr. Hodgkinson noted he would have something to share with the Planning Board by the January 13 meeting. He proceeded to summarize the proposal as it stands. The subcommittee discussed the particular issue of whether the proposed roadway is a structure. Mr. Greenbaum expressed concern with the applicability of the calculation of mean grade proposed to be used by the Building Inspector for the roadway portion of the proposal.
  • Review of Ms. Malkin’s Draft of Changes to ZBL Article 2:
  • For next meeting, Ms. Weidner asked Ms. Christy to make print outs of the ZBLS that highlight the words structure & building.
  • The subcommittee members reviewed the proposed draft changes. Discussion also occurred regarding the priorities of the subcommittee’s work.
  • The definitions, in particular ‘Affordable Housing’ & ‘Family’, were highlighted as needing to be researched and revised.
Ms. Weidner noted her preference to look at particular sections in order to reconsider Definitions in their context, rather than consider the Definitions separately.
  • It was decided the next meeting should start with a review of Article 3 and then will proceed to a review of the draft changes in Article 4, returning to the Definitions in Article 2 as needed.
  • Minutes:
  • Nov. 12, 2013 Minutes were reviewed. Ms. Weidner made two changes to the minutes. Mr. Greenbaum moved to approve the minutes as amended. Ms. Weidner seconded the motion. The two members voted to approve the minutes as amended.
  • Next Meeting:  January 13, 2014.
