Meeting called to order at 3:08PM
  • Zoning Bylaws (ZBLs) Review: Ms. Weidner’s Chart & Discussion
  • Mr. Greenbaum  suggested a close reading of the bylaws to identify whether the correct term has been used regarding a special permit or a variance.
  • Chair Thompson requested Ms. Weidner note the need to confirm that the phrase ‘special permit’ and the word ‘variance’ are used correctly in the zoning bylaws in her spreadsheet re “bylaw revision review.”
  • Zoning Bylaws Article 5, 5.2:
  • Discussion occurred about how the first sentence of this section is unclear.
  • Zoning Bylaws Article 5, 5.3:
  • Discussion occurred about how the first sentence of this section is unclear.
  • Zoning Bylaws Article 5, 5.6:
  • Discussion occurred regarding why definitions are located here.
  • Zoning Bylaws Article 5, 5.7:
  • Discussion occurred about bug zappers and why the regulation of those devices are in this section.
  • Further discussion occurred about the topic of lighting. Ms. Weidner suggested more thought be given to the entire Article 5 to see if what needs to be regulated in lighting regulation will be regulated.
  • Zoning Bylaws Article 6, Section 6.0 & 6.1: DIMENSIONAL AND DENSITY REQUIREMENTS, MINIMUM LOT SIZE AND SETBACKS
  • Discussion occurred about when a variance is given. It was asked, “Would a variance be given to allow an applicant to not comply with setbacks?”
  • Ms. Weidner asked Ms. Christy to send all members a copy of the The Zoning Act via email again. (MGL Chapter 40A)
  • Mr. Greenbaum questioned the meaning of Section 6.1, A. Chair Thompson suggested consulting Lenny Jason.  Ms. Weidner explained that A., of Section 6.1, addresses “any zoning districts” whereas C., of Section 6.0 addresses AG-RES DIST IV.
  • Mr. Greenbaum noted  A., B. & E. could be combined in Section 6.0.
  • Zoning Bylaws Article 6, Section 6.2 & 6.3: DIMENSIONAL AND DENSITY REQUIREMENTS, HEIGHT LIMITATIONS & special permit for 28 ft. roofs:
  • No comments were made on these two sections.
  • Zoning Bylaws Article 6, Section 6.4: EXCEPTION TO MINIMUM LOT SIZE REGULATION
  • Ms. Weidner suggested no changes to this section.
  • The subcommittee consulted with Chuck Hodgkinson regarding the meaning of ‘variance’ and ‘special permit’. Mr. Hodgkinson noted section 6.6 which allows for a setback relief. Mr. Hodgkinson notified the subcommittee about two applications that have been submitted to the ZBA to exceed the permitted total living area. The ZBA meeting is on the October 23, 2013.
  • The subcommittee asked for information from Mr. Hodgkinson regarding Section 4.2B, Non-Accessory Uses. Mr. Hodgkinson was not able to explain the origins of this particular section and why the particular list of non-accessory uses was included.
  • Zoning Bylaws Article 6, Section 6.5 & 6.6: EXCEPTION TO MINIMUM LOT SIZE REGULATION
  • Chair Thompson noted there is a definition of ‘young people’ and that should be in Definitions.
  • The subcommittee decided to review the bylaws beginning at Section 6.7 at the next meeting.
