Subcommittee Meeting
September 9, 2013

Meeting called to order at 3:10PM
- Zoning Bylaws (ZBLs) Review: Ms. Weidner’s Organizational Chart
- Review of bylaw review list created by Ms. Weidner. Additions were made to the list of items that the subcommittee feels need a review but may not need alteration. The additions to the list are:
- Right to farm
- Right to fish
- Aquaculture
- Swimming Pools
- Home Occupation/ Home office
- Measurement of living area in guest houses and other structures
- Ms. Malkin suggested the Planning Board be notified that the subcommittee reviewed the 5-year ownership prerequisite for guest houses and feel that regulation does not need to be altered. If the Planning Board feels differently, they may then direct the subcommittee to review the bylaw and suggest alterations.
- Ms Malkin proposed more additions to the list of bylaws or new bylaws/regulations that may need the review of the subcommittee:
- Detached Bedrooms (DBR), i.e. the limit to the number of them.
- Solar energy bylaw (glare, appearance, types of structure.)
- Huge underground furnished spaces
- Ms. Weidner stated she would update the list for review at the next meeting, on Sept. 23.
- Correspondence: Email from Sergio Modigliani:
- Mr. Modigliani’s emailed question was addressed. Ms. Malkin will review the questions of Mr. Modigliani and will return to the subcommittee to share her understanding of his questions on Sept. 23. Chair Thompson stated the Building Inspector should be the person who answers all questions regarding what can be built. She further stated the Building Inspector can seek input from the Planning Board if needed.
- Chair Thompson reiterated that questions concerning how the new bylaws are implemented should be directed to the Building Inspector.
- Zoning Bylaws (ZBLs) 4.2A, 8 Satellite Dishes:
- Ms. Malkin suggested a phrase, “in any season” may be added at the end of the section. Discussion occurred and it was determined that no change would most likely be needed due to the infrequency of use of these types of technology.
- Zoning Bylaws (ZBLs) 4.2B Non-Accessory Uses:
- Discussion occurred about the introductions to 4.2A and 4.2B and how they may be made clear. The subcommittee agreed the descriptions at the beginning of each section, 4.2A & 4.2B, are confusing and unclear.
Ms. Weidner suggested the introductory wording be drafted to more clearly describe what each section regulates. She stated that a definition for Non-Accessory Use needs to be drafted. Ms. Weidner stated that a phrase could be added to the beginning of 4.2B, 1. to give the definition of non-accessory and then insert, “such as” and continue with the list.
- Mr. Greenbaum questioned the rationale behind the section 4.2B, 1. He wondered why the particular uses were listed, like gasoline station and Laundromat, but other things like a bookstore or pizza parlor are not specifically listed. It was decided that more understanding is needed about the 4.2B, 1. Section and how it came to be. Ms. Christy offered to look back in the town meeting minutes to see whether there is something there to describe the thinking behind the 4.2B section. It may be in the mid to late town meeting minutes from 1970s.
- Zoning Bylaws (ZBLs) 4.2B Non-Accessory Uses:
- The subcommittee reviewed the section, 2. Conversion of a one-family dwelling, and 3., Conversion of a barn. The need to keep in mind where the town is heading while the subcommittee reviews and revises the bylaws was discussed. Ms. Malkin suggested Ms. Christy look at the 1973 amendments to the bylaws in the town meeting minutes to see why two-family dwellings were not allowed.
- Chair Thompson suggested that a review of the bylaws for how the document as a whole affects or may affect the town may be a job for a consultant. Chair Thompson suggested that what was discussed and thought in the past may not be relevant today.
- 4.2B Non-Accessory Uses, Cont’d.:
- The subcommittee did not see a need to revise 4. , in 4.2B.
- The subcommittee reviewed 5., “An Inn, subject to the following” section.
- The subcommittee noted that g. would need rewording.
- The subcommittee decided to review up through 4.4, on page 4-11 at the next meeting.
- Minutes:
- August 26, 2013 Minutes were reviewed. Ms. Weidner moved to approve the minutes as written. Ms. Malkin seconded the motion. All ayes.
