Meeting called to order at 3:06PM
  • Discussion occurred regarding the numbering of the articles in the bylaws and the confusing nature of the system.
  • Mr. Greenbaum stated he would like to consider further the suggested change, proposed at the last subcommittee meeting, to change the districts the town is separated into.
  • Zoning Bylaws (ZBLs) 4.2A, 2: Home occupation
  • Ms. Malkin read aloud the preamble and noted the lack of definition of ‘home occupation’.
  • Extended discussion occurred about home occupations and the need for a special permit.
  • It was suggested that the preamble be rewritten to exempt telecommuting, working individually and not inviting a great number of customers to the home.
  • Ms. Malkin proposed to rewrite the preamble and to try to define ‘home occupation.’
  • Ms. Malkin asked Ms. Christy to speak with the Building Inspector about the idea of rewriting the preamble to make clear that the intent of the bylaw is not to restrict home occupations that do not incur large amounts of traffic.
  • Ms. Malkin proposed eliminating ‘k.’, on page 4-4, because the same requirement is stated on page 4-2 in 4.2. She noted it may be redundant.
  • Zoning Bylaws (ZBLs) 4.2A, 3: Swimming Pool and/or Tennis Court:
  • Ms. Malkin noted that section ‘a.’ is unnecessary. Chair Thompson noted it was inserted to be able to alert applicants to all of the requirements of installing a swimming pool or tennis court.
  • Ms. Weidner stated that the entire section 4.2 needs to be clarified so readers know what exactly needs to be specially permitted and what does not need to be specially permitted.
  • Discussion occurred about how to reword the section to include all sports that occur on a court. Discussion continued about how to reword the section so as not to discourage informal basketball  ‘courts’ in parking areas outside garages, etc…
  • Zoning Bylaws (ZBLs) 4.2A, 4: Windmill:
  • Ms. Malkin noted the draft bylaw the Martha’s Vineyard Commission(MVC) has drafted for the use of all towns and asked Ms. Christy to obtain this draft from the MVC. And, Ms. Malkin asked Ms. Christy to obtain the MVC model wind mill bylaw/regulation and the state model wind energy regulation.
  • Zoning Bylaws (ZBLs) 4.2A, 6: Conversion of a Barn:
  • Discussion occurred about the difference between ‘6.’  On page 4-6 and the item, on page 4-8, under Non-Accessory Uses in Section 4.2B, 3.
  • Zoning Bylaws (ZBLs) 4.2A, 7: Room Rentals or Bed and Breakfast Accommodations:
  • Ms. Malkin noted the discrepancy between Permitted Uses, Section 4.1, E., on page 4-1 and Accessory Uses, 7.  She suggested making the wording consistent between the two areas. Discussion occurred regarding restricting the Permitted Uses, Section 4.1, E. to say “by a family resident in a dwelling.”
  • It was decided the wording of the two sections should be made consistent and to indicated that the owner is the renter.
  • Zoning Bylaws (ZBLs) 4.2A, 8: Satellite dishes:
  • Chair Thompson noted that solar panel units should be added to the accessory use section. Ms. Malkin proposed reaching out to South Mountain company regarding a draft of a solar panel regulation. Chair Thompson suggested South Mountain be consulted but not asked to draft.
  • Ms. Malkin suggested a public hearing regarding solar panel regulations. Ms. Malkin asked Ms. Christy to research other island towns regarding solar energy regulation.
  • Minutes:
  • August 5 & 21, 2013 Minutes were reviewed. Ms. Malkin moved to approve both sets of minutes as written. Mr. Greenbaum seconded the motion. All ayes.
