Meeting called to order at 11:08AM
  • Permanent File:
  • Discussion occurred regarding development of a spreadsheet to organize the timeline and tasks. It was agreed a spreadsheet would not be necessary and the organization of a permanent file will begin on Tuesday, August 13 with Chair Thompson and Ms. Weidner at a working session.
  • Biennial Review Discussion:
  • Ms. Malkin requested that Ms. Christy remind the subcommittee every few weeks regarding zoning bylaw revision work to ask the Building Inspector, the Zoning Board of Appeals and other Boards/Committees for their input, if they’re ready to give it.
  • Discussion occurred regarding the impact of the new zoning bylaws. Certain current projects were discussed with Mr. Jason.
  • Mr. Greenbaum noted that it is important to gather information throughout the two year period in order to make a relevant biennial review.
  • Bylaw Revision Work:
  • Ms. Weidner reviewed her initial work in looking at the Definition section of the ZBLs: Windmills, Home Occupation and Tennis Courts. All three need to be reviewed, she noted.
  • Ms. Weidner continued to note that there were issues in the Lighting section and that there are definitions mixed in with the restrictions.
  • Ms. Malkin responded that all defined terms should be placed in one section.
  • Ms. Malkin continued to note that she worked from Chuck Hodgkinson’s memo regarding possible changes to the ZBLs.
  • The subcommittee went through the points made in the Hodgkinson memo and discussed the relevancy of each one.
  • Discussion occurred regarding pool houses and whether the total living area includes the structure around the pool or just the pool in the structure, as the definition seems to state in the new bylaws. Mr. Jason was asked for his opinion and he stated he felt it was a matter of common sense and that more definition is not needed.
  • Discussion occurred regarding Barns. Mr. Jason stated the structure is already defined and more definition is not required. Ms. Malkin inquired what would happen if an existing Barn were to be changed to include a rec room. Mr. Jason stated that the owner would have to get a special permit from the ZBA if the Barn was preexisting and did not meet setbacks, for example. The rec room would be included in the calculation of the total living area. Further discussion occurred about what things are stored in Barns and whether the storage of boats, and other non-agricultural items, would violate the use of the structure of a Barn. Ms. Weidner stated the definition of the Barn should be left as is until it proves to be a problem. Ms. Malkin suggested that the definition may need to be changed to allow for various incidental uses. Mr. Jason opined that incidental uses of a Barn do not change the use of a Barn if the primary use of the Barn is agricultural.
  • A change may be needed to change the gallons amount in the Swimming Pool bylaw be changed to 10,000 gallons rather than 7500 gallons. The fire chief will be consulted when this bylaw is reviewed.
  • Ms. Malkin reviewed the definition of Dwelling, 2.2. It states, “used, in part, for dwelling”, and noted that the definition of Dwelling needs to be reviewed.
  • Ms. Malkin reviewed the definition of Guest House. The restrictions portion of the definition should be moved to a different part of the ZBLs and not be included Definition section.
  • Ms. Malkin reviewed the Wireless Communications definitions. She noted clarification is needed.
  • It was noted that there is no updated definition of a wind mill and other wind generation structures. Ms. Weidner stated that the draft windmill bylaw, that was never brought for a town vote, may need to be revisited.
  • Mr. Jason inquired why the pool owner has the space included in their total living area but the tennis court owner does not have that space included in TLA.
  • In the section in the ZBLs titled Lighting, it was noted that the definitions portion should be moved up to the Definitions section. The same would need to be done for the Homesite Housing section, it was noted.
  • Discussion occurred regarding basketball courts and tennis courts. It was asked whether basketball courts should be special permitted like tennis courts are now required to be special permitted. Ms. Weidner suggested that the tennis court section should be taken out of the swimming pool bylaw section.
