Meeting Called to Order: 3:35PM
New Bylaw Correspondence/ Discussion:

  • Review of email from Mr. Modigliani which details responses to questions, posed to  Lenny Jason, Building Inspector, by Mr. Modigliani:
  • The subcommittee reviewed each response as shown in the email dated June 8, 2013.
  • Mr. Jason stated that all responses, attributed to him by Mr. Modigliani in the June 8 email and written in the email, seemed to be accurate.
  • Discussion occurred regarding section 1.03 of the Rules & Regulations Governing Subdivision in Chilmark. Ms. Malkin clarified that the subcommittee, in their meeting of May 24, noted that there may be a potential ambiguity in how section B.4, in the new residential building size regulation bylaw, may be interpreted. This section, Ms. Malkin noted, should say,“This Section shall not be construed to limit the number of buildings designed or available for dwelling use which would otherwise be permissible under section 1.03 of the Rules and Regulations Governing the Subdivision of Land in Chilmark (in effect as of April 22, 2013) on one lot; provided, however, that the Total Living Area for each building designed or available for dwelling use on the lot does not exceed the limitations imposed by subsections B.1 and B.2, respectively, which shall be determined by dividing the total acreage of the lot by the number of buildings permitted and built under Section 1.03.
  • Ms. Malkin further reiterated the subcommittee advised the Planning Board, on May 28, that the Board should seek to clarify this section at a time in the future.
Discussion occurred with members of the audience to clarify some questions, mostly concerning the calculation of Total Living Area.
  • Review of Detached Bedroom bylaw:
  • There was brief discussion regarding the Detached Bedroom definition bylaw.~It was agreed that it is probably not necessary to limit the number of detached bedrooms, but that no action be taken until the Attorney General has reviewed and given a decision regarding the new bylaws and the Planning Board has reviewed the recommendations of the subcommittee. The subcommittee also confirmed that the intent of the bylaw is to allow more than one detached bedroom on a lot if there is more than one dwelling on the lot.
  • Dan Greenbaum’s Biennial Review Document:
  • The subcommittee issued a copy of Mr. Greenbaum’s document to Lenny Jason, Building Inspector. Mr. Jason will review and respond.
  • The subcommittee requested that Ms. Christy issue a copy of the biennial review document to Chuck Hodgkinson, administrative assistant to the Zoning Board of Appeals (ZBA) for dissemination to the ZBA. Ms. Christy was also asked to pursue the arrangement of a meeting with the ZBA.
  • Mr. Goldman moved to recommend the Biennial Review Form to the Planning Board for use in the biennial review of the bylaws. Ms. Weidner seconded the motion. All ayes.
