Present: Janet Weidner, Chair, Joan Malkin, Dan Greenbaum, Andy Goldman, Jennifer Christy, Administrative Assistant

  • Meeting Called to Order: 9:30AM. Chair Weidner summarized what occurred at the November 26 Planning Board meeting and detailed what the tasks would be for the meeting.
Residential Bylaw Discussion:
DBRs & DCPCs
  • Ms. Malkin invited Mr. Murphy to speak of his concerns with the proposed bylaw.
  • Mr. Murphy stated his opinion and noted the following salient points:
  • The Planning Board should definitely present the Detached Bedroom bylaw
  • Town Counsel has given the opinion that the residential bylaw would be most successful in the long run, would withstand litigation and would be less costly for the town in the event of litigation if the MV Commission was involved (i.e. if the residential bylaw was included in the current DCPCs only).
  • Suggested the Planning Board bring the Detached Bedroom bylaw to town meeting and a proposal to seek ‘large house” regulation within the existing DCPCs.
  • Would like the town to be as protected as possible in the future and felt the regulations, placed under the MV Commission and within the DCPCs, would be the most protected position for the town.
  • Chair Weidner expressed support for the idea of placing the proposed Residential Bylaw regulations with the existing DCPCs.
  • Discussion occurred about the pros and cons of utilizing the MV Commission and placing the proposed bylaws in the existing DCPCs. The Chair expressed her intent to move ahead with the December 17 public hearing and, through the public hearing process, settle the issue of whether to go the route of applying the proposed regulations to existing DCPCs.
  • Mr. Goldman expressed support of Mr. Murphy’s proposed way of applying the Residential Bylaw to existing DCPCs.
Residential Bylaw Final Draft Discussion
  • Chair Weidner stated the purpose of the meeting is to produce a final draft of the proposed Residential bylaw for dissemination at noon.
  • Changes were made to the proposed Residential bylaw. Ms. Malkin described her meeting with Pam Bunker, Asst. Assessor, regarding how Pam defines “Residential Built Area.” The subcommittee agreed that the phrase “gross living area” would remain as the way the square footage in measured in the proposed bylaw. Continued discussion occurred to refine the wording of the bylaw. The subcommittee went through the proposed bylaw line by line to discuss all points and ready the proposed bylaw for its final draft.
  • Chair Weidner alerted all to the Board of Selectmen meeting on Tuesday, December 4.
