Present: Janet Weidner, Chair, Dan Greenbaum, Cathy Thompson, Andy Goldman, Joan Malkin, Jennifer Christy, Administrative Assistant
Public:  Thomas Bena (filming), Russell Maloney, Miles Jaffe, Jessica Roddy, Ken Iscol, Lenny Jason
Not Present:
  • Chair Weidner called meeting to order at 9:00 a.m. and alerted all to the filming being done by Thomas Bena.
  • General discussion occurred concerning Peter Temple’s visit to the Planning Board meeting on the previous evening, September 10, 2012.
  • Discussion occurred concerning the measurement of “living area”.
  • The committee reviewed Mr. London’s Sept. 10 emailed response to Ms. Malkin’s Residential Building Regulations draft #4 (September 6, 2012)
  • Ms. Malkin reviewed her Residential Building Regulations draft #4 (9-6-2012) in the marked form, under “3. Applicability.”
  • a. through d. were reviewed by committee.
  • Mr. Goldman noted the ZBA’s apparent reluctance to perform the duties of the permit granting authority in these proposed regulations. Mr. Goldman suggests further discussion concerning the permit granting authority.
  • Wide-ranging discussion occurred concerning the topic of visibility, Development Guidelines and FAR (Floor Area Ratio).
  • Mr. Jason questioned what his role would be within the implementation of this bylaw. Chair Weidner and Ms. Malkin clarified the Building Inspector role.
  • Mr. Jason noted:
  • Owners should have broad rights to build on their own lot.
  • Cemeteries, as included in Ms. Malkin’s Residential Building Regulations draft, should not be cited. (see 8. Consideration by the ZBA, c. Relative Visual Impact, (ii))
  • Confusion re the “waterways” provision.
  • The importance of creating bylaws which “create neighborhoods” rather than “ruin neighborhoods”.
  • A preference for regulating just what Planning Board wants to regulate (i.e. large houses) rather than creating a wide-ranging, complex bylaw.
  • Discussion continued concerning the current character of Chilmark and how it has changed over the years.
  • Ms. Malkin noted three key issues that need to be determined:
  • The trigger number of square feet
  • The permit granting authority: ZBA or other entity
  • Top limit of size-is this a good approach?
