Call To Order:
Ms. Weidner opened the continued Public Hearing at 4:32 pm.
The board discussed the proposed revisions from the last meeting:
Hot Tubs – Spas
-Remove reference to Hot Tubs and Spas
-Retain status quo permitting for Hot Tubs and Spas which currently require just a Building Permit from the Building Inspector.
Building Code:
-Remove reference to IBC. MA building Code should cover all bases
Energy Use:
-Current technology
-Alternative non-polluting
Fire Protection:
-Standpipe required for pools holding more than 7500 gallons
Wall of Building:
-10’ separation of house and barrier/fence
Lot Size: Leave at 3 acres
Definitions: There was discussion to define hot tub and spa. A Hot Tub and Spa are not to exceed a depth of 42” and not to exceed 50 square feet. The lid for hot tubs; when is it too cumbersome to lift? Is there a maximum size for hot tub lids?
Section 3:
Remove International Building Code reference
There was some discussion concerning the occupancy requirement. Mr. LoRusso, Mr. Alley and Mr. Silva had a very good conversation regarding this requirement. This occupancy requirement came out of the same requirement as the Guest House Permit. Much of the discussion concerned the period of time from purchasing an existing home and building a new home with the time to build. Was there a way to show the entire development of a lot, but require a two year waiting period for pool construction to begin? The approval of the special permit could have the condition of a two year waiting period to begin construction of a pool. Mr. Meegan spoke to the fact that this is a special place, unlike other places and that it requires a waiting period to see if your planned development really needs
a pool. The town vernacular of “getting to know your neighbors and town” has relevance to this discussion. That broad term has to be made into language that is definable.
- Tennis Club; permitted by special permit
- 3 acre zoning for pool: this discussion centered on the fact that a guest house currently requires a minimum of three (3) acres for a permit. Should a pool/tennis court require a similar requirement? The discussion included the fact that there could be a sub 3 acre lot in Menemsha, where a pool could be built easily and within the setbacks. 3 acres is required for a guest house, but it may be too restrictive for a pool.
- Setbacks: hide equipment in vegetation? Strike ‘related fencing’. Equipment placement to be determined by the ZBA.
The motion was made to continue the Public Hearing to January 10, 2011 at 4:30pm. That motion was seconded and approved by all ayes.
