Call To Order:
Janet Weidner, Chair, opened the meeting at 4:35 p.m.
Meeting Minutes
Board reviewed minutes from April 13, 2009 and approved as amended.
New Business:
Wind Bylaw Discussion:
The board had a brief discussion during which Ms. Weidner informed the board that Mr. Poole, town Moderator, suggested the Planning Board “indefinitely postpone” the WECS proposed bylaw. This would allow the board to rework the bylaw and bring it to the town again at a later date.
Proposed Noise Abatement Bylaw:
The board discussed how this bylaw came about, evolving from complaints registered by neighbors who were exposed to various kinds of constant noise generated by electrical generators, air handlers and pool equipment. The board read through the proposed bylaw, looking at each line. The discussion included the fact that this will not change the current situation for noise generated by neighbors’ equipment, but it will give some recourse to future situations. There was some discussion concerning the line, where to measure noise and it was agreed to change sentence to “…measured at the property line.” So, from town floor, the amendment will be made to remove the line “…or at the nearest abutting residence.” The board discussed the need to state the intent of this
bylaw and the reason for bringing it to the town.
Updates:
North Tabor Farm: The Administrative Assistant briefed the board on a meeting with Ben and Suzanne Clark and a conversation with the Dix/Miller Attorney concerning the need for lease of Farm Lots. The Clark’s would like to have a Farming lease and according to the Clark’s, the Miller/Dix’s would like to continue farming as is without a written lease. It was suggested that the Planning Board try to get these parties together to work out the lease issue.
DAS Hearing:
The DAS hearing that took place April 6, 2009 in the Chilmark Community Center involving the members of the Chilmark Planning Board was continued to June 22, 2009 at 4:30 p.m.
The Planning Board will not hold its regular meeting that day due Planning Board member’s involvement with this joint hearing. There was some concern raised over the issue of the DAS going in on town property and will that acceptance open the way for other competitors to use town land for future system installations. The board was asked to vote appointing Ms. Weidner proxy for the board to voice the approval of the continuation of the DAS hearing.
Mr. Walton motioned to appoint Ms. Weidner proxy, the motion was seconded and the board voted 6 in favor, 1 opposed.
Administration:
The Board signed the letter of release for the Healy Form A Subdivision. This will allow Ms. Zell to take the 1.0 acre unbuildable parcel, (Map 11, parcel 29-4) and create a Homesite Lot through ZBA special Permit.
(Administrative Assistant informed the Board of Homesite Applicant, Suzy Zell’s intention to use a single driveway into the recently established property, as the board had suggested she do during the approval process of the Healy Form A subdivision.)
