Continued Public Hearing for addressStreetMiddle Line Road (MLR) Community Housing Program Form C
Mr. Osnoss, Chairman, opened the hearing at 4:33 p.m.  The Board reviewed the placeMartha's Vineyard Commission's decision on MLR Form C, which was approved with conditions.
The Board also reviewed the conditions on the Form B and confirmed that the Form C plan has met all these conditions.  At 4:50 pm, a motion was made, seconded and all members present voted to close the Middle Line Road Community Housing Program public hearing.

The Board suggested the following conditions on the MLR Form C plan:
1.  This subdivision plan is limited to nine (9) habitable buildings / twelve (12) unit complex.
2.  The road within the subdivision and the access road to the subdivision (addressStreetMiddle Line Road)
     shall be brought up to Town specifications before any of the lots are released.
3.  There shall be a note on the linen stating, "Roads shown on this plan are adequate for the
    number of lots on this approved plan only."
4.  A well for each site within the subdivision shall be drilled and pumped to the satisfaction of
    the Board of Health before any of the lots are released.
5.  A well for the Fire Water Source shall be drilled and pumped to the satisfaction of the Fire
    Chief.
6.  A septic plan for each site shall be approved by the Board of Health before any of the lots
    are released.
addressStreet7.  Holman Road shall be protected by placing split-rail fencing at three locations; at the
     entrance of addressStreetHolman Road on addressStreetMiddle Line Road and on either side of the subdivision road
    where it crosses addressStreetHolman Road.  The fencing shall be erected prior to any construction on
     the property.

Mr. Posin made a motion to approve the Middle Line Road Community Housing Program
Form C plan with the aforementioned seven (7) conditions, in addition to the placeMartha's Vineyard Commission Form C conditions.  Mr. Meegan seconded the motion, and all members' present voted to approve.

The Board postponed review of the April 7, 2008 meeting minutes.

Scheuer Property, Map 33, placeLot 4
The Board read the letter from PersonNameGlenn Provost, Vineyard Land Surveying, which requested the opinion of the Board concerning an application before the Conservation Commission.  The Scheuer's are proposing a house on their property; Map 33, placeLot 4.   There are two existing curb cuts on this property, as well as wetlands on either side of the proposed home location.  The Scheuer's are exploring a third curb cut along addressStreetState Road for the driveway as opposed to using an existing curb cut for the driveway due to wetlands.  Zoning Bylaw Article 11, Section 11.6.C.d. which states that roadways within the Roadside District to access a lot shall be located at least 1,000 feet from any other such way located on the same side of the road.  Mr. Meegan made a motion to respond to PersonNameGlenn Provost's inquiry by stating that the Planning Board would not support a third curb cut.  Mr. Posin seconded the motion, and all members present voted to approve the motion.

North Tabor Farms, Map
Christina informed the Board that Bonnie Franks, owner of Map 13, Lot  9-25, asked the Town whose responsibility is it to fix the pump and dry hydrant for the pond, which is a water source for the fire department for the North Tabor Farms subdivision.  Although the Planning Board requires all subdivisions over eight lots to have a water source for the fire department, the Town does not have any obligation to repair or maintain the water source.  After doing some research, the covenants for the subdivision indicate that it is the responsibility of the owner of the farm lot to maintain the lot.  Christina has forwarded this information to Ms. Franks.  The Planning Board discussed including in the protective covenants of future subdivisions the maintenance of the water sources, pumps, dry hydrants, etc.

Helena Price, Map 8, placeLot 2
George Sourati, Sourati Engineering, presented an Approval Not Required plan, showing a subdivision of Map 8, Lot 2 (+10.2 Acres) into two parcels, Lot A +3.05 acres and Lot B +7.13 acres.  This property was originally part of the Spring Point subdivision and thought to require a Form C application; however, the approved Form C plan dated October 22, 1980, approved on July 12, 1982, satisfied that condition.    Mr. Sourati stated that the applicant offered a "no further subdivision" condition on the "Lot B".  Mr. Meegan made a motion to accept the "no further subdivide" condition offered by the applicant, to note this condition on the linen, and to approve the ANR plan.  The motion was seconded and all members present voted to approve.  Mr. Sourati confirmed he would provide the Planning Board with a new linen that will include the notation.

At 6:00 pm, Mr. Osnoss excused himself from the meeting and assigned Ms. Weidner as acting Chairperson for the remainder of the meeting.

Community Affordable Housing placeOpportunity (CAHO)
Jim Feiner and PersonNamePerry Ambulos came before the Planning Board for an informal discussion concerning their affordable housing proposal on a 12-acre parcel off addressStreetSouth Road.  Mr. Feiner explained that the plan would create 3 one-acre Homesite lots and 3 three-acre market rate lots.  Mr. Meegan stated that the twelve-acre parcel does not exist, and he suggested the following steps:  Step 1 would be to research the first subdivision and confirm its validity.  If valid, Step 2 would be the owners would need to present a Form C subdivision to the Planning Board to create the 12-acre parcel.  This would possibly trigger a Development of Regional Impact (DRI) review for the placeMartha's Vineyard Commission.  Step 3 would be for Mr. Feiner and Mr. Ambulos to present the Form C subdivision affordable housing plan to the Planning Board.  The Board noted that the proposed new entrance illustrated on the plan was a great improvement to the existing entrance.  The abutters present voiced a concern with the density of the project and asked if the homeowners would be able to build guest houses.  Mr. Feiner stated that he assumes there will be a "no guest house" condition on the properties.  The Board suggested Mr. Feiner contact the property owners to advise them to initiate the process of filing the subdivision application.
