Minutes
December 8, 2004
Members Present: Molly Flender-chairperson, Jim Feiner, Thaw Malin, Josh Scott, Bill Randol, Steve Schwab, Steve Gallas and Deborah Cini.
Absent: Zelda Gamson.
Members of the public: John Abrams, Derrill Bazzy, and Warren Doty.
Molly Flender opened the meeting at 7:30p.m.
The Implementation Guidelines for the Homesite Housing Bylaw were discussed and the
changes listed below.
Part II
Income limits of applicants for Homesite lots on land made available through the town or on land owned, controlled or managed by the town shall be certified not more than six (6) months prior to the distribution of the land by lottery.
Part IV 10/b and 10/c:
“For homesites lots on land made available through the town or on land owned, controlled or managed by the town:
A designated Heir who shall be the spouse or child, or children of the owner, whether or not such heir qualifies as an eligible purchaser, provided that his/her property ownership is encumbered by the terms of the Deed Restrictions including the obligation to reside full time on the premises, the provision for resale, and the restrictions regarding leasing.”
-“For Homesite lots on land made available by private property land-owners: A designated Heir, whether or not such Heir qualifies as an Eligible Purchaser. Provided that his/ her property ownership is encumbered by the terms of the deed restrictions including the obligation to reside full time on the premises, the provision for resale, and the restrictions regarding leasing.”
The question was raised do we want to keep OR CHILDREN in or out. It was agreed to keep it in. Jim Feiner motioned to pass the Guidelines. Thaw Malin seconded and the motion was carried. All approved.
The idea of CORI checks was discussed. Molly Flender stated that she had spoken to town counsel who had spoken with the woman at Criminal History Systems Board. The woman mentioned that she did not think we could use DCRHA to certify the applicants. We would have to be our own certifier. Steve Gallas mentioned that we should have control over the appeals process. Molly mentioned that we need legal opinion for this topic. The discussion was tabled until further notice.
The budget was discussed. The first issue that was brought up was the administrative assistant’s hours. Are eight hours enough and should we increase the hours to ten? Steve Gallas mentioned that with the increased work on the Middle Line Road project that the increase in hours would be wise. It was decided to ask for ten hours.
The only other change to the budget was to reduce advertising from $1, 000.00 to $800.00. Molly Flender made the motion to pass the budget with these changes. Josh Scott seconded the motion. Motion carried all in agreement.
The Chilmark contribution for the Dukes County Regional Housing Authority this year is $17, 383.00. After much discussion the committee approved the payment to the DCRHA. All towns on a proportional basis to support the administrative expenses of the DCRHA incur this expense.
The Public Meeting to discuss the amendments above was opened at 8:00p.m.and with no public input was closed at 8:05p.m.
The minutes from November 10, 2004 were discussed and Josh Scott made the motion to approve. Minutes approved as written.
John Abrams came before the committee with his first update on the Middle Line Road project. Mr. Abrams presented the committee with a rough draft proposal for the plotting of house and rental units. See attached copy.
John Abrams also agreed to deliver the preliminary report to Deborah Cini on December 22, 2004. The committee would then discuss it with him at the January 12, 2005 meeting.
